  1. It is illegal to use the tourist visa with the intention to go to the United States and get married, it does not matter if you have known the woman for 10 days or 10 years.

    Stop trying to avoid the immigration process everyone else has to endure. Either use the K1 visa, once you have solid evidence to support your relationship and have met AT LEAST once. OR get married in India, your wife can live with you there, or if you believe you have enough evidence and she can apply for a CR1 partnership visa. This will take at least 12 months on average, longer for complicated cases.

  2. Are you an Australian citizen by birth, are your parents? It does not really matter in most cases but it seems to me like you may have moved to Australia at a young age for school/past marriage and adjusted and now are doing it again in the USA. I am by no means judging you but your story just seems a little off especially since your whole extended family lives in the USA. This will be seen as a huge red flag to immigration because they will see it as you are using your parents neighbor to gain permanent residency to be closer to the family. If your marriage is real make sure you have tons of evidence to prove that. Photos of your wedding with your family and husband alone will not cut it because there is no proof that your parents did not arrange this with their neighbor before you arrived for you to gain quick permanent access to the USA.

  3. HELP! My EAD and AP have been processing for 83 days now, FINALLY my EAD changed to 'New Card Being Produced" - Because I currently hold an EAD as I am on OPT I assume is why it states new card is being produced. However, I am really worried because my travel document still says "case was received". I am hoping I will receive the combo card in a week or so but if I don't I am worried because recently a family member back home has been sick and I wanted to go home in the next month to visit.

    Has anyone else had the experience of the EAD being approved and sent with AP even though AP status says "case was received".

  4. Which sentence -- 'with DHS authorization only'? Honestly, I donno but I read that one needs to take it off after EAD or GC. May be I have wrong information.

    Moreover, I am interested in knowing if I need to make any changes to my SSC after EAD or GC. Any advice would be helpful.

    You will still have it while you have the EAD, I only got my SS card while on OPT after I received the EAD. I even renewed my SS card when I married a USC and it says the same thing. I assume it will not be removed till you apply for a new card with your green card when you receive it. It has never been an issue having it on there for me, all employers are about is that you have permission to work.

  5. I'm starting to get worried! My AOS case has been received since December 23 2015, I did my biometrics on Jan 27th and on the 30th my I-485 changed to "case ready to be scheduled for an interview." But I still have heard no word on my EAD or AP. I know the usual processing time is 90 days, which for me ends March 22nd but I have been noticing many people have been getting theirs a lot sooner around the 70 day mark! Anyone else send theirs in around the same time as me and have heard anything?

  6. I am a little confused and I was wondering if anyone else has had a similar situation, I sent in my AOS package along with the 1-130, EAD and Advanced parole on Dec 22nd 2015. I got a notice that the applications were received and they gave me my case numbers on Jan 2nd 2016 and processed the checks a few days later. On Jan 27th 2016 I had my biometrics appointment and I just checked my case status online and my I-485 status says "Case ready to be scheduled for an interview" is this normal considering my husbands i-130 still says "case received" along with the i-765 and i-131?

    How long after you guys had that notice did the interview get scheduled? I just thought it was strange since I assumed my Husbands petition had to get approved before my AOS interview could be held.

  7. You will need a lot of evidence to prove your in a bone fide marriage, especially if he is living in Florida, and you in New Jersey. So make sure you can provide proof of things like joint bank accounts/ co-mingling of finances/and responsibilities, joint car/health and or life insurance, listing each other as beneficiaries or emergency contacts, and a past lease if you currently live together etc, along with secondary evidence like photos, chat logs, affidavits from mutual friends/family members showing they know about your marriage. If you provide some/all of this evidence the process will go quicker and you will be less likely questioned about your intentions for getting a green card like the ability to work/get federal financial aid.

  8. Is your wife adjusting her status, and is currently in the US right now? If so before you send off the I-130 and I-485 you will need to get the medical (i-693) done and submit it with the I-485 application, which should also include the affidavit of support.

    On the USCIS website you can find a list of doctors that perform these physicals, and a list of requirements needed for the medical like immunizations needed and specific tests they require you to under go, all pretty painless so don't worry.

    If your wife had an immigration health screening done by a USCIS approved doctor within the past 12 months in her home country with no issue she may be exempt from this, usually with the K1 fiance visa.

Yeah, I know Australia writes day, month, year but they completely left off some immunizations checking "not age appropriate" which is an issue especially for Hep B as its a mandatory requirement unless exempt due to a medical condition. The dates they messed up on was the year writing 1998 instead of 1992.

    I am just worried about the documents being too back dated before sending them in..

So I finally got all my paperwork and evidence filled out, signed, and dated ready to send off because the only this I was waiting on was the medical exam results to include in my I-485 application. I went to go pick up the medical exam results and asked for a copy of what was in the sealed envelope for my records; upon reviewing it i noticed quite a few errors on the medical form regarding my immunizations as the civil surgeon checked I never had the Hep B, Hep A, and the dates were wrong for MMR even though I brought all my records with me to the appointment, plus the box regarding needing a chest xray or not was not ticked at all, even though I tested negative for TB on the skin test it should of been marked "Not applicable due to negative result on skin test". So I returned it to the medical center, showed them the errors and re photo copied all my records again for them! - MAKE SURE YOUR CHECK YOU RECORDS BEFORE SENDING THE MEDICAL OFF, thank god I asked for a copy or I probably would of got an RFE.

    I am now waiting for my updated medical packed which I was told could take a week or two, all my documents are dated 12/10 along with the check I've written, should I redo the forms and date them when I get my medical results, which is hopefully by mid next week or just leave it as 12/10.

  11. How long ago did you guys apply for an EAD, They changed this process a few years ago. I thought I didn't have one either I left the forms blank but then my lawyer told me to put the USCIS number on my EAD because that was the assigned A number which got when I received my EAD. Maybe they will give me a new one but I was told to include it anyway as my identity will be listed under that number and processing will be easier

    I know I'm full of questions here, but I'm desperate to have everything spot-on before we file. Another one: My wife and I both hyphenated our last names when we got married, which is shown on our official marriage certificates and bank statements. The new names are not shown in our passports or on pretty much any other documents. I would assume they'd understand that her name would have changed, having just gotten married, but I'm wondering if it might be a good idea to include some extra clarification or statement that we are, in fact, the people on all of these documents? I've listed both our names on all of the forms (I-130, etc.) with our hyphenated last name. Is this the way to do it?

    I never changed my name on my passport, but I would recommend updating both your names on SS cards and drivers licences before you send it off, photo copy those side by side, it shows you live in the same residence and you both unified by changing your name. Its also easier to put the new names on bills, insurance etc if you have a photo ID in the new name because a marriage certificate alone doesn't 100% prove you changed your name other than on the certificate.

  13. I thought the same thing, I am F1 on OPT and thought I didn't have an A number. My Immigration lawyer clarified that the USCIS number on the EAD is your A number. If your wife still has the letter they sent with the card when she got it, the return invoice in the event you ever needed to re apply for the card has above your name and address A# xxx-xxx-xxx which is the same number on the EAD card.

  14. Hi!

    I have an unusual question that I am looking for feedback/experiences on. I am about to file for AOS married a US citizen, as I have mentioned in previous posts, I am planning a trip home to Australia with my Husband in April 2016, I am hoping to have my AP before then but if I don't (providing I don't miss any interviews or appointments for my AOS) would I be able to still travel on my valid F1 visa (it expires in May of 2016) or would travel of any kind forfeit my application? I am really hesitant about leaving even though I am still "in status" I just wanted to see if anyone else has had similar experiences.
