Yes, the child HAD to be declared in order to be included with his wife's petition. On the forms it even ask for information on all children even if they are coming with the parent or not. DOn't know why he did not include his son.

He will have to file for a separate petition for his son. Will take 1.5 - 2 years because he is an LPR and not a citizen.

Thanks for your response. He DID include his son on the form but USCIS did not acknowledge it and only shows his wife on the notification. we are also aware of how long it will take but just want to know if a separate petition is needed for his son.

  2. Hi, I have a question!

My brother recently filed for his family to come to the US  but before I get to my question here is a little bit of the situation. They got married in October 2015 after 8 years of being together and they have a 7 year old son which he declared on the form I-130 and include all evidence proving he is the father. December 2016 he received NOA 1 from USCIS that they received his petition but the name of his son is not indicated only his wife so we are concerned that his son will not be included in the petition. my question is that.. does my brother need to file a separate I-130 for his underage son ? I have read somewhere that underage child is automatically included in the petition as long as they are declared on the form.. PLEASE HELP so we could take action asap..

BTW. my brother is a green card holder not a US citizen

    Thanks

  3. I suggest you to get credentials to valid her studies here in USA. Because her degree will be nothing here if you don't make this paperwork first.

Look in Google what are the offices close to you to fill the forms (you can do it online too) and pay for it.

I did it and I am waiting my credentials, I went to AERC in the city of Covina, CA (they take 2 - 3 weeks).

    Good luck !

Thank you. i'll research on that. :reading::thumbs:^_^

  4. Hi VJ's

My Fiancé is coming soon, all plans is in place but im a little worried when it is time for her to find a job. she recently obtained her Bachelor's in Psychology and she is asking me If she could practice her degree here in California, I have no idea what to tell her. so my question is that will she be able to use her degree if she wants to ? or does she need to study again to get credits. ?

  5. Hi again VJ's ! :star:

My fiancé and I are still in the process of gathering documents for her visa interview ( still working on scheduling medical and interview), now most of our documents are ready but am not 100% sure about the affidavit of support. I have read here that to be able to get approved I (petitioner) need to have 125% of the poverty guideline, for 2015 my income is over $32thou but my bank account doesn't look that good because of some personal emergency spending spree and I cant find anyone for co sponsor. so do we really need a cosponsor ? and how much money (est) do I need on my bank account ? please clarify this. :help:

thank you so much VJ's ! :content:

PS: sorry if im on a wrong thread

  6. Hi! We got approved on January 12, 2016 as well and haven't heard anything from NVC yet either. The NOA2 we received said to wait 30 days before contacting them, so I've been trying to wait patiently. I guess we're right at the 10 business days mark now, so hopefully we'll be hearing soon!

are you going to try and call nvc or wait for the letter ? I really hope we hear some good news soon. goodluck to us :joy:

  7. Hi fellow VJ's

I'm new to this site and just want to know if anyone here has been approved this month and have received their nvc case number. we got approved January 12th 2016 and I started to call yesterday to check if they have received our documents (I read some of the tags to wait 2 weeks after approval to start calling) but was informed that they don't have any record for me yet and was told that it takes 35 days for ncv to receive the documents from USCIS then another 42 days to have a case number. is anyone got the same statement ? and for those who had receive their case number did you call or receive a letter and how long did you wait ? apologize if I have so many question its nerve wrecking to wait without any tracking. :clock:

thanks everyone and goodluck to us :goofy:
