We had an interview with the local office in January and was asked to submit more evidence of our relationship (since all we provided was pictures and our utilities bills, they want to see more of our wedding pictures and rental lease etc). I believe he gave us a letter with the address where we should mail the evidence to, but we have lost that letter unfortunately.

     

    In this case would it be possible to request a copy of the same letter again? Which number should I call to get it?

  2. What matters is having AP. Getting marry within the 90 days or not is irrelevant.

    No one gets ban for missing the deadline to marry within 90 days. What matters is having AP.

    Plenty of people have missed the deadline to marry within 90 days. The only difference is having to file an I-130 for missing marrying within 90 days. A person who misses the deadline can still get AP and travel.

    I see. I thought missing the deadline to get married will make the staying in the states illegally and therefore, the ban.

  3. I arrived in the states on April 30th with my K1 visa, got married on June 10th, and have my AOS package sent out by June 25th.

    I have received my EAD/AP combo card in September and planning to go back to my country to deal with some bank issues next month.

    Am I safe to travel with my EAD/AP combo card which has my married name, that is different than my last name on my passport?

    What kind of documents will I need to being with me for re-entry?

    What you can do is call in for an expedite, wait for an RFE for evidence of financial hardship and submit it per fax (fax number is on the letter)

    with a job offer if you have one. That all will take about 3-4 weeks and by then people usually receive the EAD anyway.

    We successfully expedited a renewal EAD because of the 1 year expiration and it was approved one day before the old one expired.

    You can try to do an infopass to expedite having all evidence and job offer with you but at this point I would just wait.

    it's so weird because the status on my AOS application has updated to "ready to schedule an interview" but the status on my AP and EAD remain unchanged. I guess i will call in on the 90th day just to make sure they are working on it lol thanks for your tips!

  5. Your EAD will be approved before the 90 days are over. 99% of cases are. This 75-day bothering them makes no sense and just wastes time. I don't know how this idea got started here, but I didn't use to see it and now I have seen multiple mentions of it.

    Do you happen to know if the purpose of the 90days mark is to have the case prioritized or is to have it proceed? if i call again on its 90days mark is it gonna take another month or i can get the card right away at their office?

  6. I have placed a Service Request last Friday (the day after my 75-day mark) and got a response saying that "the case is within our current processing time and sorry for any misunderstanding".

    I tried to call them again today and they told me there is nothing they can do until my case has reached its 90-day mark. They said the request they put on 75-day mark is to have someone to review it, and the 90-day one is to have the case assigned.

    I thought the Service Request you place on your 75th day is to have someone work on it so you can make sure it's done within the 90days processing time? I mean if people send in their request on their 75th day then according to what she told me the response is gonna be the same for EVERBODY right -the case is within our current processing time, so what is the process of submitting the service request on the 75th day *confused* ???

    May I ask when you submitted the SR online did you do it yourself through the service request website? Or did you call to have the officer did it for you? I called the other day and they said their system was down and gave me the website to do it myself. But a day later i got an email saying that it's within the appropriate timeline (my case receive date is 7/25 though as stated on the letter).

  8. Sent out package on 7/25 and I got my EAD and AP approved on 9/6! I requested to expedite my EAD based on job offer on 8/25 then faxed the offer letter and employer letter on 9/2, then saw online, status changed to approved!

    BTW, my online status didn't work until 9/6. Before that, it showed the case number doea not exist. Even for now, my I485 status still not available so don't worry about that online status thing. It will be updated sooner or later.

    Is expedite request = service request? Or are they different?

  9. Funny thing... I call to speak to tier 2...they're not available and they will not give me any updates or info without the hubby here...and I'm the petitioner!!!!! So frustrating to see people who filed weeks after us already getting ap/ead approval!!!! And I can't even get an update! This is sooooooo frustratingly irritating!!!!?

    Same here! And when I spook to them to make the special request they said the system is down ARGHHHHHHHH

  10. So I just called to make a special Request on my EAD since it's been 75 days but they told me that their service is down and they will not be able to do it. However, the lady gave me a website and told me that I can make the special request myself and it's the same website where they make the special request for people too. have anyone heard about it? https://egov.uscis.gov/e-request/displayONPTForm.do?entryPoint=init&sroPageType=onpt

  11. In my opinion, yes.

    Your mileage might vary, but I think the immigration officer would be more sympathetic to help ensure you are able to work after the statutory processing time has passed. They usually are not very fond of self created emergencies, such as accepting employment before you have a reasonable expectation of getting your work authorization.

    You also will not be able to create an expedite request unless 75 days have passed.

  12. My advice would be to start looking for a new job, and negotiate a start date of Monday October 3rd, which is the Monday after the 90 day mark of you application (September 26th) was received. If the date they received it is different, adjust accordingly. This will give a very high probability of obtaining your EAD card before your start date.

    If you have not received your EAD approval by 75 days (September 11th), put in a case inquiry to verify if its been assigned to an immigration officer. If you have a job offer on hand by that time (or after without your EAD), call and put in an expedite request stating financial loss to yourself and provide them with a copy of your job offer.

    They wont accept a request to expedite before 75 days have passed, and I wouldn't try to use an expedite request to start working before the 90 day mark since the IO might think that its your own fault for not planning, and your new employer might get annoyed to.

    So go ahead and start looking for a job, and relax for another two weeks before you start taking action.

  13. The USC will also need to supply last year's tax return to prove that s/he filed taxes.

    So we will only need to send in his tax transcript for last year then? How about this year, is it required to include this year (he got a gift that's needed to be taxed that wont be filed til the end of this month since he's still working on his tax extension for being out of country).

    If this year can be excluded it would save us from so many troubles!

    Thank you for everyone who helped! Since this week is the week we are finally getting married officially I just realized there are so much needed to be done for AOS!! All the help are deeply appreciated!

    "In order to qualify based on the value of your assets, the total value of your assets must equal at least five times the difference between your total household income and the current Federal Poverty Guidelines for your household size, however, if you are a U.S. citizen and you are sponsoring your spouse or minor child, the total value of your assets must only be equal to at least three times the difference."

    Thanks! So in our case we will only need three times as it's just me (the spouse) and the US citizen? So we will not need a joint sponsor as long as we can provide our bank statement with that amount of money right? Is tax transcripts still required then?

    Sorry, Assets are used at 3 times the amount for a spouse, not 5.

    You have to provide bank statements to show you have that much money in the account for a while, not some sudden transfer from someone to prop up the number.

    NO problem! Now I know where to look for those information ;) Is tax transcripts still required if we can provide the bank statements will that number?

  15. So we have enough saving (assuming the poverty line is 15k?) but with no income yet as both of us just moved to the states (i'm the one on K-1 visa) and have no job yet:

    1. do we still need a co-sponsor when we file our AOS?

    2. If yes, what will we need to get from the co-sponsor besides having them to sign the form?

    3. If we don't need a co-sponsor, all we need to submit are the bank statements and tax form I assume?
