  1. after a better part of 7 months my wife finally got her interview scheduled for her green card. her interview is February 21.

     

    My question is we have all the required originals and documents needed but i for the life of me cannot find my original birth certificate i placed an order for a new one with dallas, tx as that where i was born but they told me it could take up to month to receive the certificate. Is not having the original but have copies going to hurt us in the interview? im starting to freak out a bit,

    Hi @ThisguyJerry! Just to let you know I received my EAD/AP card combo in the mail today! It's my birthday, too, so I can't believe the perfect timing! :) I filed my packet May 15th (a bit earlier than you), so I'm sure you'll receive your card soon enough, if you haven't yet! :D 

    That’s great!!! According to my timeline we are in line for sometime this week so hopefully we hear something. I’m happy for you!! Now get out there and work lol

    if you entered on a K1 then wit would be December 2017. 90 days from when you passed through POE. It will not affect your AOS as long as your are married before the 90 days are up

    You could arrive in the US a few day before your visa expires once you arrive and receive you I-94 that’s when the 90 day countdown starts. Some people wait until a few days till the end of 90 days and are fine. You don’t even need to file AOS right away granted you’ll be out of status admin if your out of samtatus for too long it can affect you.

    Same! Also, at least USCIS sent you an email update. I didn't even get any update since calling to follow up. :( I keep checking my mailbox everyday hoping to find something from USCIS, but alas, nothing yet thus far. Good luck to us all, and hopefully we get our EADs soon.

    Did you submits a service request? They told me I would hear something by September 9th ands didn't get a response until the 15th.

    WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) will begin expanding in-person interviews for certain immigration benefit applicants whose benefit, if granted, would allow them to permanently reside in the United States. This change complies with Executive Order 13780, “Protecting the Nation From Foreign Terrorist Entry Into the United States,” and is part of the agency’s comprehensive strategy to further improve the detection and prevention of fraud and further enhance the integrity of the immigration system.
     
    Effective Oct. 1, USCIS will begin to phase-in interviews for the following:
     
    • Adjustment of status applications based on employment (Form I-485, Application to Register Permanent Residence or Adjust Status).
     
    • Refugee/asylee relative petitions (Form I-730, Refugee/Asylee Relative Petition) for beneficiaries who are in the United States and are petitioning to join a principal asylee/refugee applicant.
     
    Previously, applicants in these categories did not require an in-person interview with USCIS officers in order for their application for permanent residency to be adjudicated. Beyond these categories, USCIS is planning an incremental expansion of interviews to other benefit types. 
     
    “This change reflects the Administration’s commitment to upholding and strengthening the integrity of our nation’s immigration system,” said Acting USCIS Director James W. McCament. “USCIS and our federal partners are working collaboratively to develop more robust screening and vetting procedures for individuals seeking immigration benefits to reside in the United States.”
     
    Conducting in-person interviews will provide USCIS officers with the opportunity to verify the information provided in an individual’s application, to discover new information that may be relevant to the adjudication process, and to determine the credibility of the individual seeking permanent residence in the United States.  USCIS will meet the additional interview requirement through enhancements in training and technology as well as transitions in some aspects of case management.

    Additionally, individuals can report allegations of immigration fraud or abuse by completing ICE’s HSI Tip Form.

    I'm under the impression that it will affect people that file after October 1. Same with when the updated filing fees last December as long as you filed before December 23rd you were fine. Haven't seen an official word

    Yes we did file for the EAD/AP combo card but haven't received those yet. Still doing the waiting game.

    Can scheduling the interview also be done during the AOS process without the actual hard-copy paperwork instructions in the mail if your status shows "Ready"?  Or, is one only able to schedule an interview with the hard-copy paperwork?  

    In the US no. If you came on a K1 then more than likely it'll change to card has been mailed. But if you have an interview it'll tell you it has been scheduled. Or immigration processing times are a joke and are not enforced. 

  8. My wife and I sent her AOS in on May 24th NOA1 May 26th. Had biometrics June 19th. Still no card no nothing from USCIS and feeling frustrated because while my wife's friend who sent their AOS in end on June and received RFE had beeb approved. To me that is a bit unfair but I know how the government works. We called and put in a service request only for the email to say our case will have a decision soon. Called today to maybe speak to a tier 2 with the agent giving us the same ####### the email. Said. Is there anyway to see what's going on with our case. Even the agent was surprised it wasn't approved yet. Feel lost

  9. Filed my wife's AOS May 26th, on June 29th the case status changed to case is ready to be scheduled. EAD and AP still show case is received. Filed a case inquiry August 28th just received response that said case is stil being reviewed. Way to approved it within 90 days. Hope to get it soon my wife is feeling restless not being able to work. Hope everyone has a smooth journey while are wait on the slowvernment.  Eh I mean government.

    Not sure why I would use a joint sponser when I make well above the poverty limit. 

     

    From my understanding. The uscis instructions even say you can use federal individual income tax return. Is that not the same as a 1040 you get after you've filed?  

     

     

  11. I just filed taxes for last year. Misplaced w2 during our move to a new house. Anywho. I ended up owing since wife doesn't have SSN and read that better to just file and amend when she does get SSN. So my question is since I owe my tax transcripts won't be available before we plan to send the AOS package in. Am I able to us my 1040 with supporting w2's, recent pay stubs and last 3 years of tax transcripts. Freaking out a bit since nothing has really gone right with anything lately

    They never returned the check/money order or any paperwork at all? Normally it all gets returned.

    Nope never recieved anything back no petition no RFE. We did get deferal notice after we recieved our rejection NOA. We did get case numbers as we had her biometrics and everything. I'm going to assume we will need to answer yes and just put down why. Damn government.

Hey everyone my wife and I filed for green card in December and we were rejected due to an issue with me bank and we never received anything from USCIS to resolve the filing fee so our petition was rejected due to improper filing fee now we are refilling in and we have to fill out all new forms because we never received our original. But they are a couple questions on I 485 and I 765, that ask if we have ever applied for adjustment of status and if we have applied for EAD. Now do we need to answer yes? Our case was never denied just rejected. I called USCIS and that was a waste of time as they said they can't help me fill out the form yet I asked a simple question. Anyways long story short we aren't sure what to put. Yes or no. They also ask for reason it was denied. Well it wasn't denied it was rejected. To me rejected and denied are two completely different meanings.
