  1. Let me elaborate little bit -

    In US it is considered that both ex-husband and wife are responsible for the child. For example there would be equal rights between both after divorce unless one of them is deemed unfit to look after the child.

    The case was rejected either due to lack of evidence (Sworn affidavit) or based on what you're ur wife said in the interview. There is no document evidence here to indicate the moral character (like drug conviction, or felony etc) based on what you wrote above. It might be good case for immigration attorneys to take up.

    Now there are 2 options

    1.) Wait for period of 3-5 years since incident and file new N-400

    2.) Hire a good immigration attorney and appeal N-336

    I do not know how long your field office takes to process 2. If it takes 3 years for appeal it might be best to wait and reapply.

    Let us see if any one else has any good suggestions.

    PS: I am not an immigration expert, I am just writing based on my reasearch on web and the information you provided above.

  2. Received letter in the mail today, it's 5 pages out of which 4 are rules and regulation. Was not expecting this for sure and surprised both of us. My wife has a child from previous marriage who is with the husband since they divorced in 2006. During the interview she was asked about the child and my wife answered her exactly how it is. The ex has the custody of her and has no obligation to pay anything for her well being. Even got a letter from the ex stating that but 1 major mistake ( i believe ) we did was not having it notarized. Below is their response for denial (sorry a bit long). Please advise / suggest what should we do next..

    On August 16,2012, you obtained conditional permanent resident status through your spouse in immigrant

    classification CR6(Conditional Resident Spouse of a US Citizen) and your conditions were removed on

    December 03,2014. USCIS received your Form N-400 on October 19,2015, and on February 03,2016, you

    appeared for an interview to determine your eligibility for naturalization.

    During the interview and review of your application with an Immigration Services Officer. you testified that

    the information on your Form N-.400. along with any amendments made during the naturalization interview.

    and the documents submitted by you were true and correct. The record reflects that y'ou have a child who

    lives overseas with your ex-husband. You stated that you sometimes send money when someone goes there

    but not regularly. You stated that your ex-husband takes care of her so you do not need to send any money.

    On Feburary 08. 2016. USCIS issued a Form N-14. Request for Evidence. asking you to submit evidence that

    you financially support your child in order to demonstrate good moral character (GMC). This information

    was due to USCIS no later than March 11 2016. On March 08.2016 you responded to the request for

    evidence. You submitted a statement from you stating that you do not support your child from your previous

    marriage"through any means." You stated thaty you had given "less than $500 in the last 4 years". You also

    submitted a copy of a typed lefter from your ex-husband stating that he is financially responsible for your

    child together. He stated that you are not obligated to support your child and that if you wish, you are free to

    send monetary or physical gifts if you choose to do so. USCIS reviewed your response and found it

    insufficient because the letter from your ex-husband is not notarized sworn affidavit. There is no proof that it

    was actuallly him who wrote the letter. Also. the lefter does not state that you have sent money or other items

    to your child. It is your obligation to provide for dependents, regardless of whether ordered by a court. Based

    on your testimony and evidence, USCIS has found that you provided insufficient explanation for your failure

    to support each dependent child. When asked about your failure to support your dependents, you stated you

    don't need to send money because your ex-husband takes care of your child.

    ln order to establish eligibility for naturalization you must demonstrate that you are a person of good moral

    character during the statutory period. October 19.2010 till October 19. 2015. Unless you establish

    extenuating circumstances, you will be found to lack good moral character if^ during the statutory period. you

    willfully failed or refused to support your dependents. See INA 316(aX3) and l0l(f) and Title 8, Code of

    Federal Regulations (8 CFR), section 3 16.l0(bX3)(i), and 316.2.

    USCIS finds that you willfully failed or refused to support your dependents and that you have offered no

    extenuating circumstances to warrant a departure from this finding Since you have not demonstrated that you

    are a person of good moral character during the statutory period, you are ineligible for naturalization at this

    time.

    If you believe that you can overcome the grounds for this denial, you may submit a request for a hearing on

    Form N-336, Request for a Hearing on a Decision in Naturalization Proceedings, within 30 calendar days of

    service of this decision (33 days if this decision was mailed). See 8 CFR 336.2 (a) and 103.8(b). Without a

    properly filed Form N-336, this decision will become final. See INA 336.

    Seems like your case is complicated, I recommend hiring a good immigration attorney when you file for hearing.

  3. Due to disability, I have been receiving SSI and do not need to file taxes. For my wife, we started to file for tax year 2013 and on-wards,For tax year 2013, filed as married but filing separately, thereafter jointly. No letter in the mail today, hopefully will receive it tomorrow.

    Sincerely hope things work out for you. Right now it is all speculation, you will be able to have a better strategy once you have the letter.

  4. It seems the officer asked for everything that we had submitted before plus more proof of our marriage. Also wanted last 3 years of tax script for my wife. My wife landed in here at the end of 2011 and did not start work until 2013. She told the officer about that too but again in the letter she asked for the same, I am not sure why. Besides that, our bank and credit card statements for the past 3 years and any other document showing our names with the same mailing address. I also got 3 of my close friends to write an affidavit knowing us and our marriage. Also sent more pictures of us just together and some with family. We were so sure we have sent all the required documents, but I guess you can never tell until you hear from them.

    Didn't you file taxes (joint) with your wife between 2011 and 2013?. You still need to file tax returns even if income is 0.

    Yes, Chicago is the slowest, I haven't heard a word from them. I am not sure what would be the next step.

    If it reaches October, then you make appointment with USCIS in the field office. You are almost there.

  6. Me and my wife had our oath ceremony today in Campbell, CA and we are both American citizens. It has been a long wait since 1995 for me. My wife came to US in 2002.

    Congrats to all of those who are American citizens and hope that folks who are waiting will get it soon.

    Thanks to all the forum members who has really helpful to us. It would help if some can add my dates since I am not able to preserve the formatting on the mobile device.

    Btw: I got confirmation text 1 week after the interview that my oath will be scheduled (in interview status was to be decided later). We received the oath notice in email last week

    371 folks became citizens at my location - 60 countries, 32 Chinese and 71 Indians.

He asked for my permanent resident card, driver’s license and all passports though he did not check the passports. Asked if I pay taxes, how long I was outside, have any record with police etc. Btw. the officer did not take any paperwork from me.

    He asked me to read a sentence which I do not remember but he asked me to write "we pay taxes to the united states government".

    Question(s):

    What is freedom of religion?

    Name one state that borders Canada?

    How many U.S. Senators are there?

    What ocean is on the East Coast of the United States?

    When was the Constitution written?

    When must all men register for the Selective Service?

    The officer was pretty friendly. However

    The officer gave me form N652 and told me that I passed the English & history test and that I should receive the oath letter in 3 weeks. On the N-652 form the 2 things that were checked were 1) "you passed the tests of English and us history and government". 2) "USCIS will send you a written decision about your application".

    He further went on and said that my case is fine. He just needs to review it once more later in the day :(. He also gave me packet with oath ceremony instruction(s) and application for visa.

    My wife's experience was opposite, they took her printouts for last 2 year of taxes, copy of GC/DL.

    Question(s) for wife:

    What is the name of the Speaker of the House of Representatives now?

    When was the Declaration of Independence adopted?

    Name one of the two longest rivers in the United States?

    What do we call the first ten amendments to the Constitution?

    When was the Constitution written?

    How many amendments does the Constitution have?

    My wife received N-652 with Congratulations! Your application has been recommended for approval. At this time, it appears that you have established your eligibility for naturalization. If final approval i granted you will be notified when and where to report for the oath ceremony. they told her that she should be hearing from them in 1 week for the oath.

    Would appreciate if anyone else faced the same situation on N-652 and can post their experience? My wait is prolonged.

    BTW the officer did ask me to sign N-400, 2 photos and also initial a form with my name, dob details.

    I took my wife (Audy) to lunch today to celebrate her Citizenship. I had to work in the morning, I could not take the time to go to the oath ceremony.

    At lunch she told me all about meeting you. I could not believe you two had actually met at the ceremony. She was very pleased to meet you.

    She was not so happy I was not there to take her photo. :crying: Anyway just over five years and we are all done. Now I need to start preparing Audy for the coming elections and make sure she votes the right way.

    Funny thing:

    I met Audy_Rob's wife at the line in front of the Campbell Heritage theater... When we told each other the countries we were from, immediately I thought about VJ, and asked her about it. She said that yes, it was her husband that uses VJ and had a profile here since her visa. What a coincidence!

    She is a very nice lady. So, congratulations, to her! And all the other being reddened now too! :)

    Get all the chicago cases in 2015 and you could look at the approx time range.

    It is just matter of time, some of the applications probably get delayed for many reasons. There is no point in speculating and worrying about them.

    Try to talk to tier 2 officer at-least once a week if possible.

  12. Hi everyone, I have been following forums on this website since October 2014 after lodging my application with USCIS for removal of my conditional permanent resident visa based on marriage. I arrived in the U.S on 01/12/2013. My entire immigration process with USCIS was smooth. On October 2015, I filed for my naturalization application and got it approved on 02/19/2016 and got sworn on my allegiance of oath on the 03/16 and now I am a U.S citizen. I would like to pledge a warm thank you for everyone in this forum because some of your experiences was valuable in preparation for my interview etc. Also my spouse had been very loving, supportive and encouraging during this entire transition of acquiring a U.S citizenship and I immensely thank her for that.

    I have lodged my application for the U.S passport on the 03/16/2016 ( same day as per my oath ceremony) at the post office. I paid and requested for an expedited passport as I have plans to travel out of U.S in May this year. I will highly appreciate if anyone can give me an overview of how long it may approximately take to receive an expedited U.S passport. On the U.S Department of State website, it states that it takes them 8 business days to process the expedited passport application and adds that it will take 3 weeks to receive the passport door to door. This is bit ambiguous to me. Have anyone applied for an expedited U.S passport service and received their passport fewer then the department's projected timeframe? Again any experience or information regarding this will be much appreciated.

    Congrats, we did this recently for my kid and got it in 10 days. I applied in San jose, CA.

  14. You're stuck in background check.

    It happens to a few applicants every month... just look at me in December :-)

    When your background check is done you'll be placed inline and then have your interview scheduled. But it's best to keep prodding them every few months.

    Thank you all on this form - I got my inline and interview notification today electronically. I do not know the date yet.

    Now for the tense moment of preparing for the interview.

  15. Contacting them again won't hurt your case, but may not be of any use.

    The location you sent the application to in Phoenix is just a receiving facility. Your application was then sent to Missouri for initial processing and when that's done, it'll be sent to San Jose (your local office).

    You'll need to look though the tables for the past few months (go back to January 2015 and check every month). This'll give you an idea of how fast San Jose applicants are processed. You've been waiting 4.5 months. If you find that most San Jose applicants are interviewed 6 months after applying, then you'll know there's nothing wrong. There are other steps you can take when your case goes beyond normal processing times, but in my opinion, it's too early for that. The process takes most people 5-8 months, although there are people who finish in 3 or 4 and others who finish in 11 or 12.

  16. I spoke to the tier 2 officer and she said that they are still processing July for San Jose even though I applied at Phoenix.

    Furthermore she added that they have not touched my application.

    I am not sure what to make out of it. Any suggestions. I am reluctant to contact second time as I am not sure how it will impact my case.

    Please advise.

  17. If you are in the same state as jazz, meaning your status says you are "in line" and does not yet say "An interview has been scheduled..." than similarly you should not yet be expecting the interview appointment letter.

    However, to answer your question, yes, you can call the number and after speaking to the first line agents to which I can now say are there to keep people from making any progress whatsoever on their case, simply say, I would like to speak to a Tier 2 Agent please.

    They way it worked when I did it was, a recording took my information and said I would receive a call back in 13 minutes. I am thinking yea, sure, probably more like 5 hours. Well I was pleasantly surprised. 24 minutes after I hung up I got a call from a polite, knowledgeable and extremely helpful Tier 2 agent. Admittedly he kept trying to rush me off of the phone so he could move on to the next customer but all turned out well.

  18. I do not think you should be expecting an interview appointment letter if your status says you are in line for an interview. "Typically" your status should change to "An interview appointment has been scheduled for you." Then the letter should come in 6 to 9 days.

    Now sometimes people will say that the status is not being updated and you still could receive your interview appointment letter. And then there are problems such as my wife never got her letter at all. I had to make calls to the service number and finally request a Tier 2 officer to find out her interview was scheduled 4 days from when I was speaking with him.
