  1. Question: I'm american citizen, married with a stepdaughter already in US, I married her mother when my stepdaughter was 17, she was unable to come to US back then. In 2023 she is already 24 came with her husband and her daughter seeking asylum, they have not a court date yet. I know the category is no longer inmediate relative, right now it falls into F3 category My question is: Is she able to remain in United States if I apply for a visa for her? Is she able to include her child? I hope to get an answer before she gets a court date or before ICE knock on her door.
  2. Can I file petition for stepchild who is 24, married and 2 children? she is here in United States since 2022 as asylum seeker and waiting for first court date. I married her mother in 2016, my wife came to United States as k-1 visa holder, my stepchild was unable to come with us at the moment.

      Did you marry before her 18th? And is your wife a LPR or citizen now?

      I married her mother when she was 16, but my wife is still legal resident, she has not applied for citizenship yet, she still struglling with the english language.

      We live in TN.

      My stepdaughter got married here in US with the father of her children, 2 months after she arrived seeking asylum.

      Then you can petition for her I believe (double check on the main forum). It'll take a long time though (15+ years), so you may find her asylum claim is quicker anyway.
