I am sorry about your situation, it doesn’t look easy or comfortable. You seem to have two main choices I think. But in both cases, it feels that there are certain elements that indicates that she may got married for a GC... With that in mind:

Option one is to honestly speak with her about all the things you mentioned in a clear and honest way. You seem to have a good idea of what you need and wish in your relationship. You are young and start a new career soon too. That means you look towards future, you have plans and you should be with someone that is aligned with your life goals to be happy on the long term together. You both have an opportunity to reestablish the base of your marriage and honestly share duties and commitment. But as another member pointed out, you should be mindful of her response and evolution because changes cannot happen if she isn’t motivated to operate them or if she lies to you.

Option two is divorce. Same here about honesty, you should communicate the motivation of why you wish to divorce her. That is the hard option that can happened soon or later anyway if you continue to be unhappy in your relationship.

Andrea&Henry, Thanks for your very clear description of the working visa process in the U.S. And indeed, the experience of the Tahitian cook is a clear example of special and unique qualification. It seems like barista is a qualification that US citizens can fulfill without the need of introducing foreign workers in the American workers pool.

JFH, I will introduce the idea of gaining her work experience in Ireland, Australia and NZ to her. she expressed that it was to broaden her foreign work experience.

But as RodDetroit mentioned, Canada seems to offer very interesting opportunities in terms of Holliday/Working visas. I think she will concentrate on this option that sounds more to her reach regarding her professional background.

I look for some advices for a friend of mine that is a barista and wish to find the proper visa to work in the US.

We don't know what category of visa she should target for.

-She is a trained coffee Barista.

-She is french citizen.

-She never applied for US visa before and came several times on tourist visa waiver.

-She never overstayed her tourist visas.

-She has a motivated coffeeshop ready to sponsor her.

Would you recommend a particular type of visa?

I wanted to share my experience at the social security office for a new SSN.

My experience was excellent. I applied for a new social security number as a K1 visa holder and not yet married in may 2016.

I waited 4 weeks after my entry in the US and prepared the SS-5 Application for a social security card before coming in.

I went to The Social security office in New York Manhattan, 3rd Floor, on 123 William St.

The waiting area was empty on a Thursday at 11am. Not a soul.

I went to the automated kiosk and selected; New SSN, and collected a ticket with my waiting number.

After 1 min, i was called to a window. I was directly asked to give my ticket and then asked what they could do for me today. She asked me if it was the first time I applied for a Social security number and I then gave my filled application SS-5, my passport with my US K1 visa and my I-94.

After completing informations on her computer, the officer handed me back my passport and docs and a confirmation letter that i should receive my social security card in two weeks.

It took me 10 minutes in total, it was easy, super fast and the staff was competent and straight forward.

I personally needed for my k1 visa at the Paris embassy:

1-The Certificato Generale del Casellario Giudiziale

1-certificato dei carichi pendenti (certificate of outstanding criminal proceedings)

There are four major challenges that I faced during the process:

-The demand must be asked by written letter or directly at the office in person or by a delegate.

-You need fiscal stamps that can only be purchased in Italy at specialized tobacco shops or at the procura office.

-Rome postal services are unreliable, broken, not working, any adjective that describes a complete mess.

-Rome office made a mistake on birth place on my certificate.

I made a trip to Italy on the 7^th of dec 2015 to buy directly the duty stamps needed at a Tabaco shop since I can’t buy those in France.

7DEC 2015/ I sent from Venice my letter to the Ufficio del Casellario Giudiziale della Procura della Repubblica -Piazzale Clodio -00195 Rome (RM) Italia.

The letter was containing:

<>-Photocopy of passport

<>-Letter with my address for the return of the certificates (without postal stamps)

<>-two Marca da bollo di 19.84 € for the two certificates I asked

<>-two Marca da bollo di 0.93 € for the expedition of the certificates.

<>-(check the fees on the official website, the fees can change, and you may need less stamps or more depending of your situation)

10DEC 2015/The Procura of Rome received my letter.

11DEC 2015/ The procura sends my certificates to my address in France.

Meanwhile I used the following email address to ask the procura if my certificates have been sent and they answered me in the day: procura.roma@giustizia.it

2JAN 2016/I finally received my two police record, the general and the pending charges. The second one had an error on my birth place, I was suddenly born in a French city in Argentina.

At that point I decided to personally go to the procura to have the record be corrected.

13JAN 2016/ I took a flight from Paris and went to Rome at the procura that is precisely at this address below:

The office of police records in Rome is like a big waiting room. There are kiosks and you have to pick a number and wait your turn to present your demand.

I directly went to a kiosk for explaining my situation and an officer came and asked me to come in his office. He apologized for the mistake and made directly a correct and new police record in front of me.

At the Paris American embassy, all documents that are not written in English or French need to be translated.

I hope my long post will help some people that need these precious documents.

Finally, I may have made mistakes and inaccuracies. Your situation may differ from mine and I encourage you to check all the information, fees, address etc on the official website of the Italian ministry of justice. Good luck.

I would suggest to use the nationality of the country you are born in.

USCIS Seem to give more importance to your place of birth than other nationality you may have, even if you are a dualcitizen.

What makes me think that is the registering system in place for the DV lottery each year. Applicants are registered using the nationality of there place of birth. You cannot use another nationality even if you have it.

I would suggest that you use your Australian nationality for the Aos.

I wanted to share my experience with everybody about asking police certificates/police records from Italy for my K1 visa.

There are forums that talks about this topic, there is references here and there, but I never came across a full experience and full description of the process. So I will tell about my experience with the hope it helps some VJ folks.

NOTE/ The following post is only based on my own experience and what I have learn from this process. My post may contain mistakes and inaccuracies. Your situation may differ from mine and I encourage you to check all the information and your own personal situation that may have variations from mine, to avoid delays and problems that I cannot be accounted for.

Definition and Process:

The Certificato Generale del Casellario Giudiziale is a certified national record of final court convictions and decisions regarding mental incompetency and bankruptcy or a statement that no such record exists (Nulla).

The Certificato dei Carichi Pendenti is a certified record of pending criminal charges, or a statement that no such charges exist, from the office of the Procura della Repubblica.

. I requested Both certificates for my K1 visa in Paris.

Persons within Italy can obtain the Casellario Giudiziale by applying in person or by mail at any office of the Procura della Repubblica. Those who apply in person must submit a written request, a photocopy of a photo ID and all fees; the certificates are usually provided the day of the request.

Persons outside of Italy can obtain the Casellario Giudiziale and the Carichi Pendenti by writing to:

Those requesting the certificate by mail, whether from within or outside Italy, must submit a written request, a photocopy of a photo i.d., and all fees, along with a stamped, self-addressed envelope. Mail requests are normally processed within three working days.

Information concerning fees and application procedures is available from any office of the Procura della Repubblica or online at https://www.giustizia.it which is the website of the Ministry of Justice.
