Is it the home the joint sponsor is living in? I'm not completely certain but I think this won't work since it would leave the sponsor without a home in case he would have to make it to money to help the beneficiary. Just like a car wouldn't work as asset in case it's the only car.

Like I said I'm not 100% sure about it but that's what I recall.

Yes it's the home the sponsor is living in.

Yes.  It's a judgment call, not a goal line.  They are going to judge based on the totality of circumstances, not just exceeding a number on a page.

Would it be wise to add a second joint sponsor who makes around the same as the present joint sponsor? I see that a second joint sponsor is usually added when the applicant is being accompanied by others but I wonder if it's possible to have 2 for 1 applicant in order to improve chances of approval.

If the joint sponsor is single, and there is only one immigrant, their household size is 2.  However, that income is pretty low.  I would find somebody else with a better income.

You mention your and your potential sponsor's 2020 income, but what is your and their "current income".  Unless self employed, current income does not come from a tax return.  You could make any amount last year, and have a different or zero current income NOW.

Their income is still the same for this year. I was denied over 4 years ago because the sponsor had a dependent. Now the joint sponsor is single with no dependents is it really possible to be denied even though it surpasses the 125% poverty guidelines by $6000?

Without seeing any specific information. why did you wait 3 years for the co-sponsor to make enough money? Why didn't you yourself improve your working and financial situation? In three years could have done a lot on your own. You are always the primary sponsor anyways.

I live abroad with my wife so the salary here isn't that great. Everyone that I asked pretty much rejected being a sponsor.

Looks like your application was sent to the Consulate and is not at the NVC. Did they tell you to get a joint sponsor and submit the documents to the NVC, or to bring the joint sponsor documents to the interview. ?

My wife went to the interview and was denied because the original sponsor didn't make the minimum income. Yes they told her to get a joint sponsor but we were unable to find a sponsor until now.

  6. That's strange I thought I was contacting them this whole time.  I was contacting them thru ASKNVC regularly. I contacted them in December and this was the message that I received "

    Dear Sir/Madam:

The National Visa Center (NVC) received your inquiry regarding the immigrant visa petition: **** filed by **** on behalf of *******.  The NVC completed its processing of this visa petition, and forwarded it to the U.S. Embassy or Consulate in ******.

We forwarded your immigrant visa petition to the U.S. Embassy or Consulate on 08-FEB-2016.

If you have any questions about your case you should contact the Embassy or Consulate. You can find how to contact the Embassy or Consulate by going to http://usembassy.gov. Click on the region your Embassy or Consulate is in, and then click on the city name. Once the page loads, click "Contact Us."

You should also tell the Embassy or Consulate if you change your address, email address, or if your personal situation changes in a way that might affect your case.

  7. I was finally able to find a sponsor after over 3 years. I acknowledge that the visa application is expired but what about the I-130? Do I have to start from scratch?

When I check my case status the one that starts with LIN which I assume is the I-130 I get this message

"On March 18, 2015, we sent your case, Receipt Number ******, to the Department of State for visa processing. You can find general information on Consular Processing by visiting our website at www.uscis.gov . The website will provide information on what to do next, who to contact, and how to inform us of any changes in your situation or address.

When I check the IMMIGRANT VISA APPLICATION  I get the following message hat it is expired.

"You have been notified that your registration for an immigrant visa was cancelled, and any petition approved on your behalf was also cancelled. We informed you that your application might be reinstated if, within one year, you could establish that your failure to pursue your immigrant visa application was due to circumstances beyond your control.

Since you have failed to do so, the record of your registration and any petition approved on your behalf and all supporting documents have been destroyed; any Department of Labor certification has been returned to your prospective employer.

If you are still interested in obtaining an immigrant visa, the petitioner should contact the Department of Homeland Security's (DHS) Office of U.S. Citizenship and Immigration Services (USCIS) regarding filing a new immigrant visa petition.

For more information, please visit TRAVEL.STATE.GOV."

The name might give you a hint - apply for tourist visa.

I was thinking about that but she doesn't have any assets or any proof that she wouldn't stay in the US especially since we have an approved  I-130. So wouldn't the US officials think she's going to stay in the US?

  9. Me and my wife have been married for almost 5 years, have had an approved I-130 for 4 years and have had our CR-1 waiting for interview for 2 years.  Our initial CR-1 interview was rejected because our sponsor did not make meet the 125% poverty guidelines. Now our sponsor meets the poverty guidelines but our plans to move to the USA has changed. I am an American citizen and our daughter is an American citizen. We have no intention of immigrating to the US at the moment hence why I have delayed the interview. I wanted to know what is the best way to visit the US for tourist intentions and not for immigration reasons.

  10. My wife received a 221g yellow paper last week because she needed a joint sponsor and an updated police record. They told her to send the needed documents through the cargo trans box. They also returned her passport. My mother was the original joint sponsor. Now I have a couple of questions.

Q1. Does she send her passport in with those papers?

Q2. Will she have to wait for another interview?

Q3. If she doesn't have to wait for another interview, how long does the process take?

Q4. My mom's income situation has improved in a way that there are less dependents. Can she send in a new i-864 or do I have to adhere to the request of a second sponsor?

  11. I had the same question couple of months ago. I coundnt find a definitive answer here on VJ as some people were saying its automatic while others were saying something different. I had my USC wife call NVC and the call rep told her we would have to call them to upgrade and also provide them with a marriage certificate.

I feel like it gets upgraded to IR-1 in some case and not others. When is your 2 year anniversary? Mine will be in June 2016 so I wont know about upgrading for a while.

It was last Monday. I sent a message to NVC and I'm currently waiting for a reply.
