    You’re right - your new income should qualify you, even in the absence of prior qualifying returns, but without a joint sponsor you will need to work even harder to keep your application alive now that they think you don’t make enough to sponsor alone. 

    At least, send another copy of your employer’s letter, along with a letter acknowledging that you didn’t previously make enough, but that you do now, and you will, going forward.

    Not sure if I could do taxes for 2018 by their Jan 5 deadline. Cutting it close. 

    I have made more than the minimum this year yes. 

    Hopefully there's a way to proceed. The phone call I made was fruitless. Basically was told that they can't advise me on rfe matters other than to say I must follow the letters instructions exactly or I'll be denied.

    I submitted 6 months of pay stubs yes. But they didn't show qualifying income as I applied literally the same week I got promoted. The only thing showing qualifying income was my employment letter.

     

     

  3. Ive been back for awhile but was waiting for my income to exceed the minimum. Once promoted to management, my new salary is high enough, so, we immediately applied to adjust her status.

     

    Submitting an employment letter stating my new salary and my previous tax returns (that didn't meet poverty guidelines) along with the other requirements.

     

  4. Having lived in Asia for a cpl years..I had no tax returns showing I

     Met 125% of the poverty guideline. I got promoted at a new job once we settled back in the states, then applied for AOS...submitting last 2 years taxes (basically no income) an employment letter stating my new salary that far exceeds the mark..and my most recent pay stubs.

     

    Perhaps I was misinformed but I was under the assumption that one could apply if they could show that in the future, the income would be sufficient.

     

    I have no cosponsor, nor any assets to compensate. Yet my current income definitely qualifies me. 

     

    They've given me until January 5, 2019 to respond. 

     

    Any help would be greatly appreciated.

    Perhaps I misspoke . im referring to the stamp at entry which states sept 8th. will they not wish to see proof we did something to make her legal by that sept 8th date?
    What should I call it if not an expiration? regardless, it seems youre saying it doesnt matter and if we left after sept 8th, no one would ever question her or need any documents?

  6. Ok, so we're in Guam. We got married yesterday and we want to fly home to the mainland thru Hawaii, which we know we can do since Guam/ Hawaii are USA. Her K-1 visa to Guam expires on Sept 8th. should we shoot for flying out of Guam before that sept 8th deadline, or does it matter?
    We are in a bit of a rush to leave and her passport has her maiden name. we have no time to do AOS beforehand.
    whats the best course of action? leave b4 sept 8th? if so is there a 10 day before expiration rule?
    Are we over thinking this? yes we have marriage certificate, but her passport is in her maiden name.
    She got an SSN but thats in her maiden name also.
    if we were to leave after sept 8th, how could we in theory prove she met the required deadline for marriage for the k1?

  7. So I been reading supplying copies of money transfer receipts as proof of support isn't necessary and could looked as the us petitioner being scammed by the CO.

    Would sending a letter as to how the funds were and the reasoning behind it as why they were sent help?

    Can my fiancée bring this evidence to the interview to discuss with out them being sent to the embassy for the CO to review before hand? (If she'd to say persuade the CO further)

    I included a copy of every money transfer I ever sent.

    I we were approved just fine.

    Include them. It shows proof of on going relationship

  8. You went to the interview with her right? How was it like, were you interviewed separately or the CO interviewed her with you right there? My husband is going with me to the interview.

    Also, did the Filipino consul took some docs or just checked it and you gave everything to the American consul? Do I need to make duplicates of everything, and how many? Thanks in advance :)

    Yes I went to the interview and stood next to her the entire time.

    Filipino asked for nbi, cenomar, and birth certificate is all they asked for from us.

    The American only asked us for our ds160 and eligibility letter..and that was it.

    But, yes, make copies just in case..and have with you, everything they might ask for..

    Just in case. Because even though they didn't ask us for our pictures, or other things, it might be different for others..

    Better to be safe than sorry

  9. Congratulations! I won't be able to attend her interview because I didn't have enough vacation to both visit her family later this year and attend. I suspect she will have built a lot of confidence by getting her CFO certificate and medical complete - hopefully she will be glowing - as I think her friends are probably sick of hearing about me. It's also nice to see stories like this that I can share with her. Thanks for sharing! Good luck! Ours is May 23, and I am hopeful to get her here for Memorial day so we have several days together without burning up too much vacation time.

    awesome! Oh, i noticed your fiance had her medical the same day mine did. I bet they saw each other there. Anyhow, hopefully she does get there in your time frame. I'm sure you are very anxious to see her. Have faith! It's all going to work out :)

    perhaps team up with each other. Helps to have a friend to talk to for sure. We're also members of a Facebook group and we were able to meet up with 2 other members of that group. Made my fiance more calm for sure
  10. So they don't normally fix a cavity there? Just replace the whole tooth?

    no, they do repair cavities, but probably, more often than not, by the time they get to the dentist, the tooth cant be saved.

    Ive paid for my fiance and two of her siblings dental problems.. Her bros teeth were saved.. But her sister's had to have 2 extractions.

    Wow congrats! I was gonna ask how you organized your photos, but you already said it in your response. It's reassuring to read stories like this, and actually a lot of cases being approved as long as you have everything and followed the correct steps.

    Maybe later on you could also post about your experience when she gets to the US and finally starting your life together there :D

    My fiance got a photo album and filled it FULL of pics of us. We have lots of pics together since we've spent a total of 10 months living together in Calasiao. She captioned each pic, and decorated each page with hearts and flower stickers.

    She was kinda miffed that they didn't even look, hehe " my efforts were sayang" she said haha

    But yes. Breath deeply..as long as you've dotted the I's and crossed all the T's, and have solid proof of a bona fide relationship, you're golden.

    My k1 packet (which they had in front of them) was compiled very thoroughly.. I included many pics and captioned them..maybe that was enough for them..not sure

    But when you're there just relax, give off a friendly vibe and smile lots hehe

  12. Actually, my fiance has really nice teeth, but had one visible cavity on her back molar..so before we went to Manila, we decided to go to the dentist to fix it.

    Turned out she had a total of 13 small cavities. We repaired them all for 3500..

    At the medical exam, the doctor asked her about her teeth and whether or not they are false. When told," no they're all real" the doctor seemed to nor believe her and asked again,"are you sure they're real"?

    " yes mam, I'm sure "..

    Still not believing, she asked her to open her mouth and proceeded to pull on them to check if they'd remove...

    They didn't of course, but the doctor still asked," you have all your teeth still?"

    Hellooooo? "Yes, I still have them all mam"

    I was hoping someone out there might benefit, so walang anuman..:)

    They told us 4 business days. But as with the earlier parts of the process, you can track the status of it.

    One thing I have taken away from all of this is, worry is a waste of time.

    Relax and let it flow..we spent so much time, money, effort on gathering things, compiling it all, assembling it neat and pretty, and low and behold, they didn't ask for ANY of it.

    Didn't get affidavit of support, didn't look at the color screenshots we had printed...heck they didn't even look at our picture album my fiance made..

    I think if all your paperwork is in order, and you have no red flags, they scrutinize the case less.

  14. So, we hopped on the Five Star bus in Dagupan City, (I prefer Five Star for the air con and free Wi-Fi)

    And headed off to Manila on May 9th. Fare is p371 each.

    Traffic was light due to the election, and we made it in less than 4 hrs.

    We had chosen Casa Bocobo for our hotel due to the proximity to SLEC and the US Embassy and what a great choice it was. SLEC was a mere 3 min walk from the hotel.

    My fiances medical was the following day which was the 10th. So that first night we just relaxed, walked around the immediate area, had a casual meal, then spent the remainder of the evening watching movies in the hotel room.

    The next morning we woke up at 4 a.m. with a plan to be "early" @ SLEC at 5. When we arrived, we were surprised to discover that there was approximately already 100 ppl lined up before us.

    Fortunately the line moved quick, and painless.

    I was turned away at the door so i returned to Casa Bocobo to take advantage of the free breakfast, which btw, was surprisingly good.

    Afterwards I strolled around the area a bit more, not really knowing what time to return to SLEC. Even though the hotel is close, she wanted kasama with her back to it, so, at 10 a.m.,i returned to await her.

    It was of course super maiinit, and shade was limited. I took a seat on some stairs across the street, but was promptly yelled at to stand up, as "sitting is prohibited" hehe.

    Just then I was approached by a guy renting chairs. 15 pesos.. I declined but in hindsight, I should of taken the deal hehe.

    Hours trickled by, and finally at 1:30 pm, my fiance emerged finished with day one. Needless to say, I was elated to see her after standing in the hot sun for soo long.

    We returned to the hotel to discuss the process, and relax in the aircon.

    Later we ventured out for dinner.. Then bought some bottled water and snacks at the pure gold that's located one block away from Casa Bocobo.

    She was scheduled to return to SLEC the following day at 8 a.m. for the results and her vaccines... So we watched some HBO and relaxed in the room for the night.

    The next morning we returned to SLEC and I dropped her off. We didn't have any sense of how long it would be and after the first day of waiting outside for her, I played it smart and went back to the hotel, where I accidentally fell asleep..

    I awoke to her knocking on the door.

    She was all smiles because her X-ray was clear and she had her injections, and was cleared to proceed with the interview which we had scheduled for the following morning at 6:45.

    We got up at 5 a.m. and had the free breakfast, then took a 50 peso cab ride to the Embassy.. Arriving at 6:25. There were about 80 ppl ahead of us.. But again, the line moved quickly and we were inside in a handful of minutes.

    Went through security and were seated in some chairs by security. Eventually we were put in line leading to the first window..and the process began.

    We went from window to window as directed, submitted requested forms or answering required questions.

    All relatively smooth with no complications. Relatively straightforward. Finally we made it to the last phase: the interview.

    He asked her only a few questions. Such as:

    How did you meet?

    Where does he work?

    What's his birthday?

    Does he have family?

    What does he do for fun?

    Then he said, " congratulations you're approved "

    And that was that.

    We were done by 9:30 and took the walk back to Casa Bocobo.

    For a treat and to celebrate our victory, I told her to choose any place for lunch.. She wanted "Shakey's Pizza" so we headed there and had a good time.

    All in all, I'd say it was a smooth process. I assumed that it was would be daunting, stressful, more difficult. Yet I found it to be easy going. I wasn't stressed, and was pleased with the Embassy's professionalism and friendliness.

    The choice of hotel was a perfect fit for our needs. Although the room was relatively simple, it was clean, the staff is amazingly professional and courteous. I'd definitely stay there again.

    I lived off savings (in Philippines) for plus one year before deciding to go to guam to find a job that'd qualify for the k1..only worked at it for 5 months..

    Can't you find a sponsor?

    How long were you working your old job? Why are you just going to give up, you have to keep going ahead for both you and your fiance.

  16. So I am/was living and working in Guam making above the minimum to qualify.. Took a few days off to fly to the Philippines to see my fiance.

    I got contacted from my manager telling me my salary deal was revoked then next day we got noa2 approval notice.

    Been a roller coaster of ideas and thoughts since then. I didn't fly back on my return flight... Deciding "all was lost" and made a plan to just stay here long term..

    But now fiance and I have basically decided we should continue on with the process and see what comes..

    I'm jobless now..although i have employment letter paystubs and the like..

    Just blown away by the bad luck and horrible timing of it all.

    Dunno what to do frankly..

    Feel completely devastated by this unforeseen course of events..

    Theres really no hope of finding a quick job that will make above minimum in guam..took me 2 months to find this last one and i had to beg them to let me work 60 hrs a week..

    Feel like i should throw in the towel on k1 and just stay here in the Philippines with her and get married here..but am too confused
