  2. Your peition got sent to the NVC. Now give it about two weeks for the NVC to get your case and you cna either call them or get an email from them.

    They will ask you to send in some paperwork and assign you a case number, you will also have to pay some fees. After this you will fill a form called DS 260.

    Eventually your paperwork will be sent to the embassy and you will get an interview assigned where you will have to take the papework they request.

    After that, if youre approved you will have to leave your passport and in about to weeks after that you will get your visa.

  3. I'm not the OP, I was just curious why people keep applying for the K3 if it only has downsides compared to the CR1/IR1. Apparently it's just lack of information.

    I've never applied for either.

    I initially had the worst kind of attention in that embasy.

    Even going with my husband, and him being a US citizen he wasn't allowed in. I'm not surprised they gave us the wrong information.

  4. Guess I misunderstood because you said you were approved for a k3, which you were not. Embassies do the approving not the NVC. Seeing how it was closed out at NVC, a K3 was never approved...only the paperwork was. Just where my confusion came from....sorry.

    No no no, its okay! I saw that! One of the fellow Vj'ers corrected it. I did apply for the K3 but once it reached the NVC it changed. I filed the I129 and I130.

    When we contacted the USCIS they wererefering to if as a K3, I'm guessing it is because it hasn't reached the NVC yet which is the one that determinates the visa route. So your confusion is perfectly reasonable.

    Unfortunally my embassy never told us there was even a CR1 cathegory. We found out once the peition was at the NVC.

  5. Are there any benefits to applying for a K3? It's not faster, it's more expensive, so why?

    I am now learning about the Cr1 visa hun, as i said; my embassy never told us about this type of visa.

    I applied for a K3 and once it reached the NVC and I saw the change happen; that's when I found out there was a CR1 visa type.

    People are really giving you the right info and advice hun, some are being more approachable than others but you should listen to them. Have you applied for a visa type already? Or youre just planning on it?

  6. I applied for a K3 visa in April 2014, when it approved at USCIS and sent to NVC it was changed to a CR-1. I contacted my state Senator regarding this, it is completely out of our hands and they don't grant them anymore. I know it's disappointing. Sorry.

    I got the same thing!

    So to apply for a K3 visa is still possible in your country; it just changes once it reaches the NVC. Awesome!

    I got a CR1 even though I applied for a K3 one. K3 visas are not obsolete IN MY COUNTRY but at one stage of the process it will be processed as a CR1.

    You're better off trying for the CR1 given that all the petitions reach the NVC. Unless you had already applied for a k3 one, it will still not change the process or the amount of time you'd have to wait. If you have any other questions you can inbox me sweetie.

  8. So you basically got the CR1 and your K3 got closed down. And looking at your timeline it didnt really get you here any faster...

    I didn't get it any faster because my paperwork was missing at the USCIS.

    Also, I wasn't trying to get the visa any faster. I was just trying to be with my husband. The options that were presented in my embassy were either K1 or K3 and we decided the K3 was better. However, I didn't find out the CR1 existed until after i started the process. The embassy in my country never gave us that information.

  9. Hey guys, as you cna all see in my timeline, my interview got set for Dec 2nd.

    I got all the paperwork needed, but only copies. The originals were with my husband in the US. He's sending it via DHL. We're xpecting to have it by then but the odds are not in our favor.

    I got the originals and recent criminal background and more than enough evidence of our marriage and relationship before it.

    Since our case was expedited and this was an even smaller chance of happening we didnt prevent the original paperwork being needed.

    Would there be any trouble if i take the copies with me instead of the originals to the interview?

    Note that my husband already sent the paperwork to me and its already on its way, but he also make a request to push the interview date from Dec 2nd to Dec 4th; just so we can have a bit more time for the paperwork to arrive. But they havent replied that request yet so its prossible that my interview is on the 2nd no matter what.

    Any advice?

  10. Well before you get into any legal matter the first thing I'd do is settle the situation with the ex.

    I understand she doesn't live with him but you stated that was his apartment.

    Once the AOS comes they will see this and either if you love her or not, wont matter.

    At the moment for the all the questions youre asking on "how often will these visits be" and so on... It sounds like you want to commit fraud.

    If theres a kid involved and you really love this woman, wouldn't you want the best for the baby too? Does this sound like a healthy start to you?

    Cause it sounds sneaky and a bit desperate.

  11. Well you're ina tricky situation sweetie. The easiest solution would be to bring him to Holland with you to be honest.

    But I understand that means giving up the SS income and on top of that with him being disabled might be a problem for him to move.

    But at the moment I would start considering the posibility of him going there. Given that what you really want is to be with him, the location doesnt matter at all.

    I wish you a loving and happy journey with your boyfriend. Hopefully you will find the solution.

    I am extremelly happy to give you all the news that my expedite was approved. As I stated in other post this was a very rare chance of approval but here we are. I tried it and Im glad I made it.

    So this post might be able to help other venezuelans or anyone else who's looking to expedite but doesnt know how.

    Well first you need to know what the grounds for the expedite are: Severe financial loss to company or ​person, emergency situation, humanitarian reasons, nonprofit organization whose request is in furtherance of the cultural and social interests of the United States​, department of defense or ​n​ational ​i​nterest ​s​ituation, USCIS error or compelling interest of USCIS.

    In my case, I think the most accurate ground for Venezuela was Humanitarian crisis. Yes, I understand no one has declared it but that doesn't mean is not happening. ​

    First thing I did was finding out how to start the expedite process and this is where the fun part begins!

    The email you want to contact the NVC to speet up your process is this:
    NVCExpedite@state.gov (yes, also take notes I requested the expedite two days after I got my NOA2, asking the NVC to expedite it as soon as they got it)

    Well next, this is how you start the email. Is important that you put in the first line of the email whats the grounds for expedite you're requesting this on. And of course, the expedite request must be from the petitioner, not the beneficiary.


    Example of me being the petitioner:

    Name of the person submitting the inquiry: ______________________

    NVC case number or USCIS receipt number: _____________________

    Petitioner's name: ___________________

    Principal Applicant's name and date of birth: ____________________


    I, Arelys Weimer, I'm formally requesting that the (whatever visa type is) be expedited on the grounds of (Humanitarian Crisis) as soon as it reaches you (in case that is not at the NVC yet).

    NOTE: If it's already at the NVC or at the USCIS, leave at "...reaches you".

    On the second paragraph you want to explain how you got to the conclusion that the expedite is neccesary and the grounds for it are correct. In my case, my husband explained how theres a serious lack of primery products here such as toilet paper and medicines. Added to this he explained that my country has the second highest crime rate in latinamerica and there has been rapings, murders, kidnappnings, people are breaking into houses, robberies everywhere.

    He explained how this has put a lot of stress in the marriage and how he can't even sleep knowing that Im here and I cant even be safe at my own home.

    On top of this he explained that theres airlines leaving the country and even if I get the visa I might not be able to find a plane ticket to leave. Of course, there's the upcoming elections and we don't know for certain whats going to happen. Maybe something, maybe nothing but he wasn't wiling to risk it.

    Once you've explained everything in your email, the next part is doing a bit of research. Add to your email all kinds of news covering what you just said in that email. News in english and spanish. You do wanna find the news that cover stuff close by where you live, thats what will be the most helpful tool for you.

    Note: if you dont know where to find english news about the country you're requesting the expedite on, I recommend you this portal: http://www.insightcrime.org/

    You will find travel warnings in the Department of State's website http://travel.state.gov/content/passports/en/alertswarnings.html (Find your country on the list) Get the warning printed, scanned and attach it to this email as well. (They can't contradict you on something they know).

    Make sure you explain to them how serious the situation is.

    I tried this with little to non chances to getting it, and here I am. Do not be afraid to try.

    IMPORTANT: IS A FREE INQUIRY SO YOU DONT HAVE TO PAY TO GET IT EXPEDITED. ALSO, IT DOES NOT SLOW DOWN THE PROCESS IF IT GETS DENIED. So as you cna see, there's no downside of trying. If you think it meets the requirements, try it. The worst thing they can do is say NO and keep working on your paperwork on their ussual timeframe.

    NOTE: If you didn't get to pay the fees in the NVC because your case got expedited, don't worry. The embassy will let you pay the fees and submit the original documents the day of your interview. In your currency.

    Keep out for this post since I'm now in contact with the embassy, I will explain how the rest of the process goes from this point and on.

    I agree with you and that "tocar, no es entrar" is a great motto to live by, I apply it everyday in my life, as well as "la peor diligencia es la que no se hace", and "el que no llora, no mama", and such. So I support your positive attitude and wish you the best of luck in trying to get your case expedited based on the situation in Venezuela. I hope it works out for you and I hope you can come back here and share that experience with the rest of us. And if you are unable to get it expedited, then just continue to be patience, you are already in the home stretch, and you will be in the US with your hubby sooner than you think.

  14. Hi guys, I'm at the NVC stage.

    The NVC Wiki (provided here) says I only need the last year tax return for my husband and if we have a co sponsor we could do the same. (Either last year or last 3)

    But im seeing some post where people are being told to bring last 3 years. My co sponsor and my husband got last two years. Is this enough?
