  1. I think the police should not take the family at their word in this case but rather insisted that Hu go to the nearest police station to prove she is alive and well.

    It doesn't make sense to me that if she was seeking to avoid her husband that she a) returned to the U.S. and B) gave her spouse the correct flight information as to when and where to meet her.

  2. i added my husband to my medical and dental. he couldnt use it until he arrived here but i wanted more proof of our validity. i couldnt add him to my credit union account until he received a soc number. i also applied for a tax id so i could file as married for IRS.

    I don't know how you were allowed to do that since most insurer's won't add beneficiaries that are out of the coverage area. But I agree on your point that most banks will not give accounts to people without a valid SSN.

    One sure proof way of proofing that it is a bonafide marriage is having a child together.

  3. We didn't file for K-1. We were visiting here, with no visa because we're Canadian and don't need one to visit. We didn't intend to stay. We came to visit and while visiting the first week my divorce was finalized back in Canada. I didn't know it had been finalized for another few weeks, when they mailed me the papers, and my grandmother called to tell me they had come in the mail.

    When you entered to visit, did you not have a job and an apartment of your own to return to?

  4. Aren't you the same user from Montreal that posted this story before? Except, you didn't know if you should return or not because you and your husband didn't want to wait it out?

    In any event, if they suspect you entered the U.S. with the intention of getting married and staying, then your petition will be refused and you will face a ban.

    As far as the over stay, I beleive I read somewhere that over stays of less then 182 days do not come with a penalty but I can't confirm that.

    I think you need to consult an attorney.

    Hopefully an easy question here :)

    Our I-130 was approved on Jan 9th 2007. NVC processed our case but US CIS requested it back. They finally released the case and it's back at the NVC getting ready to get sent to the embassy. The question I have is that the expiration date shows at January 9th, 2008. Since the US CIS was the one screwing around during this past year and since the embassy is running months behind on interviews in Montreal, are we going to get screwed yet again by our I-130 approval expiring? Or do they take into consideration that most of the past year has been their delays? Not sure what happens when Jan 9th 2008 comes and we haven't completed the interview yet.

  6. Does anyone have the Montreal K3 packet 3 checklist in digital form? Or at least the documents that will be needed. Our packet 3 from montreal is on the way and I wanted to get everything sorted as soon as I can. I figure if I know what they're going to want we can get it organized.

  7. It took months to get mine back I had to contact local Congressman for help

    He informed me to fill form G-22 from USCIS web site in which i did and pestered him 2 weeks later i got them back

    I did send 4 letters to UCIS in Vermont called about 6 times they have no clue whats going on one even told when they follow step 1-4 but out of those steps there lost

    I did have copies for back up but i did send originals births if i had to replace it would take weeks to replace them

    tomcat, where did you find that G-22 form? I'm looking around the USCIS site and can't find it.

    Ricker, we're in the same boat. Our case was approved by CIS, completed by NVC but CIS requested the case back. That was a month ago and CIS still says they never requested it back and have no clue where the documents are. This is after multiple phone calls and a few in person CIS visits.

  8. If it takes CSC as long to open and act on the letter as it does for them to receipt the I-130 petition you may be in luck. I would suggest calling USCIS or making a quick infopass appointment to see what your options are.

    I have an infopass appointment setup already. With my luck opening the letter and acting on it will be the only thing they do faster then a snail :(

  9. Yeah, I thought about that as well. The problem is that the I-130 was approved 8 months before the I-129F. It was sent to NVC and NVC completed the case and was ready to send it off to the embassy but CIS recalled it. Can't get any info from CIS. They said that they did not request it back. Went and spoke with an immigration officer in Santa Ana and she checked with the storage place your talking about and they said they don't have it.

    The fun part is we got an attorney involved, she said that the I-129F/I-130 combo might be messing it up, so she sent a cancellation letter on the I-129F 2 days before it was approved. If that gets canceled then we're really screwed I guess.

  10. My wife and I have had nothing but problems with the immigration process. My mom decided to help out and get us an attorney. I gave her power of attorney and she ended up sending in a cancellation letter for our I-129F because she thought it was messing with our I-130. 2 days after she sends the letter I get an email that our I-129F is approved. So are they going to cancel the I-129F or is there still a chance to save it?

    I called CIS and they said they can't do anything. Would sending another letter only mess things up more? Or will seeing an officer in person help?

    I need to get my family here ASAP. We now have a daughter who has health problems and she is not getting the care there that she could be getting here. Every day she remains there is a day she falls behind developmentally :(

  11. I was just curious if anyone can tell me what CIS could possibly be doing when they touch your case?

    Our I-130 has been approved by CIS and was completed at NVC. NVC said that CIS requested the case back so they couldn't send it to the embassy. Now we've been sitting in limbo for over a month with neither agency telling us jack. But the I-130 was touched on 9/14/07, even though no one at CIS, including seeing an immigration officer in person, will acknowledge they even have it.

    We had both the I-130 and I-129F processing, we got a lawyer involved and she sent a cancellation letter for the I-129F. Of course, 3 days after she sent the cancellation they approved the I-129F (After it sat with nothing being done for 9 months heh).

    I have not been able to get any information at all from either agency, NVC or US CIS, as to why our case was returned to CIS.

    What pisses me off the most is that we've been in this process for 1 1/2 years now and we have a 6 month old child with health problems that can't get the treatment she needs there.

    Has anyone had their NOA2 from USCIS, IV packet approved from NVC only to have their I-130 sent back to USCIS?

    I just called NVC and they said that our application is complete but they sent it back to USCIS. They couldn't give me any reason why it was returned.

    Contacted USCIS and they said that the State Department requested that the USCIS to review the application?

    #######? The USCIS already approved it, so why do they have to go through it again? Now they said I gotta wait another friggin 90-120 days for them to make a decision.

  15. Yeah, ridiculous amount of time. I don't know what happened with the I-129F. Every time I called they said it was in process and wasn't out of their processing timeline yet. It's now out of their processing timeline but I can't call them because I am up in Canada dealing with a sick daughter (which we conceived and had since we started this process heh) and you can't the USCIS 800 number from here.

  16. Just had to send my wife and kid back up to Canada so they could get the baby shots, help her pregnant sister out and wait for the interview time. Really sucks, miss them a lot already :(

    So I just was updating my sig and I noticed something amusing. 1 year to the day after I mailed the I-130 to USCIS I mailed the DS230 to NVC.

    Every day the jerk me around with this paperwork is another day I don't get to see this :(

    I feel for you! We havent got touched either and we are also waiting two weeks now on NOA 1 on 129F.

    We sent our 129F with "normal mail" by the way, just clipped it on the mailbox. Any idea if you can check if it got there in some way?

    Don't know of any way to check besides calling them and they'll tell you once it's in the system. That's why you want to always go with registered (learned that the hard way myself).

    As for touches, mine hasn't been touched since nov 2006(when it got transfered to CSC). And of course I get to hear about it daily from my wife :( lol

  18. I orginally posted this in the K3 forum, guess it belongs here.

    So we're in the NVC process now and I'm trying to figure out what to do about a problem I can see happening.

    My wife is currently moving to her sisters house in preperation of the birth of our little one. I'm trying to be proactive and get her DS-230 ready to go when the time comes.

    The problem is that all the USCIS paperwork is listed with her current address. If I put her sisters address is this going to cause a red flag and have them halt the process? Is there a simple way to change her address in mid process?

    I'm registered as the agent from the DS-3032 form, so I don't know if they'll send any paperwork to her old address. Don't want to get it returned and have them red flag us heh.

    I also want to ask about #20. My wife has lived in the same city in Canada since she was about 3. She doesn't know the exact date that they moved there, so do I just put the day she turned 16 as the first day? Or do we guess-timate? Or do we have to dig through her paperwork to find out the exact date?

    Last question, maybe some Canadians can help with it. On question #23, my wife never really finished school. She went through grade 12 but has only taken some adult education classes outside of that. She's a credit short of her grade 13 (wacky Canadian school system lol). So no clue what to put for that.

    Any advice is appreciated.
