    The intending immigrant is the principal applicant for the I-485.  Your sister is the one seeking to adjust status with the I-485.

  2. Good day everyone! 

     

    I'm a U.S Citizen, and 3 years ago I sponsored my younger sister to come here in the U.S under F1 student visa. She is still here under F1, just turned 18, and currently on her first year of college. 

    My mom who I petitioned, just got here last year and she is a permanent resident, as soon as she got here last year, she filed  a Form I130 for my younger sister and we just got a letter that it's has been approved and my sister can now submit Form I-485. My question is who is the principal applicant? Is it my sister or my mom?I'm helping my sister to fill this form out.  I'm also attaching a photo that got me confused. The part 2 about principal applicant and derivative applicant. Do I need to fill out the number 3 and 4 or just number 5 to 9? Thank you so much for you help.

    Hi, thank you for your response. I don't see a i551 on her passport. Is that a stamp? I will have to take a look again.

  4. Hi, my mom just got here  in the U.S under IR5 one week ago , She hasn't receive her green card yet. I'm wondering when can she file a petition for my minor sister? Does she have to wait to file petition until she receive her actual green card or she can file now? And when can she apply for social security and actually work? The USCIS told her upon entering the U.S that she has to wait for her green card to be mail to her up to 6 months. Any info with this matter would be very appreciated. Thanks

    How long did you wait for your mom visa interview date?

    The sent my case to NVC around February and it was completed about a month and then I sent the IV Packet to them around end of April and they gave me the interview date around June second week. Mom interview date was July 06. Sorry I can't completely remember the exact date. Hope this will help ya! :)

    Hi, my mom passed her interview! She'll have to wait 5-10 days for her visa to be delivered. She said the officer asked her first why her Birth Certificate was late registered, also asked about my younger sister that's here on a student visa. The rest will be all about you and your partner, like when and how did you get in the U.S, address, work and income. I'm sure your mom visa will be approved!

    my question is that my own salary is above poverty line already but I’m filing taxes jointly with my husband does my husband needs to complete I-864A form?

     

    My Husband is very much aware about my petition for my mom and his OK with the application of bringing my Mom into the US.

     

    But I don’t want my Husband to be liable for my Mom being here in the US,  

    I feel like my Mom is my own responsibility not his specially if my salary alone is above poverty line.

     

    my question is there anyone ever got RFE for having your Spouse not filing I-864A ? Specially if the petitioner is filing TAX jointly with Spouse?

    Hi, I did the same thing. I completed and submitted the I-864 Form. I did not have my husband fill out the form I-864A since my income is above the poverty line. We have joint bank accounts  and we filed taxes jointly. They accepted all my papers and emailed me an interview date for my mom.

    Last week I received an email that the Affidavit of Support that I sent them was incomplete, and they need my husband signatures in Form I-186A and my mom will need to bring this upon her interview. I thought everything was good until they emailed me about the Form I-864A. So I guess just submit it with your form to avoid any delays. I had to mail it express to the Philippines because my mom interview is coming up which is on July 06.

  10. Hi, guys. I petitioned my mom last year and her papers got approved a couple months ago. I have paid all the fess and I am now filling out the DS 260  online for her.  I got confused about the child immigrating question. I put all of my brother and sisters name on the form.  My 16 years old sister lives with me here in the U.S and she is on a student visa. My mom is planning on applying my lil sis a green card as soon as she gets hers. I  don't know what to answer on this questions for my mom DS 260

    Q: Is this child immigrating to the US with you? (My lil sis is here already in the U.S with me on F1 visa)

    A: Yes or No

    Q: Is this child immigrating to the US at a later date to join you? 

    A. Yes or No

     

    Any help with this matter would be very appreciated :) Thank you so much.
