    I'm sure you wont be waiting long now, I was frustrated at those after me who were approved then realized we were all approved on the same day, just the mail took longer to reach me!

    I never had a site update or touch until the letter. USCIS website update , personal email and hard copy letter all arrived on the same day.

  2. Thought Id post this as i was really expecting an RFE... but happy to say it was not so and thought I'd let everyone know what we sent in, especially for those worried.

    One cover letter stating:

    1.our house has been family owned and passed down since it was built 50 years ago. Currently owned by M- in law and will be transferred to her son on her retirement next year, therefore we do not have a mortgage or a lease. ( no affi from M in law)

    2.Our joint bank account was set up for savings, so hadn't had a lot of action-we divvied up the bills so that after we had paid what we needed to out of personal accounts, would know exactly what was left over for play money and not overdraw with co mingled salaries in one checking ac.

    3.we do not have utilities in both our names as they either wont do it, or are in previous relatives names and they cant seem to understand that those people have passed away and dont live here any longer!

    so along with the form and green card photocopy

    2 years joint tax returns with w2's ( not transcripts)

    photocopy of refund check

    copy of letter stating eligibility for Govt rebate in 08

    his work benefits package/ policy showing me as beneficiary.

    my Australian super account showing him as beneficiary.

    photocopy of our health cards, both in his name

    copies of our joint ac over 2 year period despite little action.

    copies of our personal accounts at the same banks with highlighted purchases at the same stores near our home over a 2 year period.

    photcopy of our library cards and a couple of late notices.

    copies of bills that he paid with our address

    copies of bills that I paid with our address.

    photos of a friends visit from oz

    photos of dads visit from oz

    photos from random holiday events, birthdays

    letters showing our names on envelopes

    couple of vet bills in our names

    reminder from county to renew dog licenses

    couple of mail order invoices with both our names

    couple of invitations to social outings

    random business and personal emails regarding both of us covering the 2 year period.

    a couple of silly facebook snapshots with us gossiping with friends and family.

    I did not have a drivers license as I work in Manhattan so am also not included on his auto insurance.

    at this time we don't own the house or have a mortgage or lease.

    we dont have private life insurance polices other than mentioned on benefits package.

    we dont have children

    we didnt have affidavids from friends- I just wasnt comfortable with it and felt it was tacky to ask.

    I did get transcripts in case of an RFE and a NYC drivers permit once I heard that people were asked for them. Luckily it didnt matter.

  3. Hi Matt,

    I haven't heard anything yet, but am also nervous about evidence. We don't have some of the "joint" evidence,( the house and uitility bills are tied up with generations of family members which I explained in the cover letter. This is NY, I dont have a car here, but I did get a learner's permit in case of an RFE) But, as they say each relationship is unique... I feel that mundane living evidence is just as important. You can put someone's name on anything, but you can't fake a life that involves your partner and an address! A couple of things I threw in to cover this - you'd be surprised what you can dig up..

    photocopies of our Library cards and some mailed naughty notices saying that we were overdue stuff. Go to the library, get cards, borrow a 2 day movie or book and voila, they are mailing you within a week.)

    Invoices from UPS deliveries, (barnes and noble, victorias secret, pet accessories)

    A couple of our NY magazine subscription front pages from different months.

    Xmas cards, party invitations from friends and family- valentines and b'days to each other.

    Cable bill and my AT&T bill which I pay. All our heating oil bills which I put on my Debit card.... ( I certainly wouldn't pay $400 a month for a house I don't live in!)

    Bank statements over 2 years highlighting the same pet store and grocery store where Ive been shopping a 1 mile from home a couple of times a week.

    photos from birthday dinners, thanksgiving,xmas, visits of relatives or good friends who came to the USA.

    random emails to and from friends, family/ businesses- mentioning us both or service we need. ( ie our accountant)

    Notice from the Vet that our animals need shots

    Mail from Town authority to renew dog licenses.

    Snap shots of my facebook page showing silly bantering between us and friends jointly. Snap shot of his page gossiping with my sister...

    Along with the joint tax returns we sent the letter informing us we were eligible for the rebate in 2008

    I received a "card production ordered" email today from good ol' CRIS!

    Is it really possible, is this really an approval coming my way???

    We haven't received ANYTHING in the mail yet. My husband thought maybe someone was playing a sick joke on me, but it's a real USCIS email and case status is updated too.

    I really hope this is for real :unsure:

  5. Hi Gang,

    around 9 weeks ago, hubbie found 3 starving abandoned kittens in our garage. One had just died. At the time they were probably 3 weeks old. He hand fed them with a dropper and goat milk formula then got them onto real food.

    They are now around 12 weeks old, happy, boisterous and loving. VERY curious about our dogs. Unfortunately we have four dogs, one loves kittens ( a lab) the others are mastiffs and lets just say not into cats. They know how to use the litter box. One female one male.

    We are terrified of Craigslist having heard horror stories of kittens being picked up for pit bull bait, snake food, animal testing etc. Cat rescue orgs say they are flooded with ferral cat breeding season and told us to put them on Craigslist! I did try, got one lead who flaked out, then one who sounded a bit creepy so I ignored it...

    We are in Long Island NY, but I work in Manhattan so can transport...anyone nearby or with a friend nearby, or connections to a rescue???

    they'll need shots etc. With our own animals and resposibilities, finances are tight.

  6. My husband and I sent out our I751 February 29 of 2008 to the VSC and just now we receive this blue letter telling us that the documentation we sent was insufficient, the evidence is insufficient.

    We sent a lot of proof. I am really desperate and I don't know what to do. We learnt about the letter yesterday and I cannot stop crying. I cannot think the possibility to have to leave and leave my husband.

    We started our life here not always easy economically speaking. We passed laid offs, bad financial moments we have to move to my in laws because we cannot afford living in a separate place. That's why we don't have a lot of stuff that they asked such loans, proprieties, etc.

    We sent

    Financial:

    1. Joint tax return

    2. Joint contract lease

    3. Joint Auto insurance

    4. My 401k where show that my husband is my beneficiary

    5. Join Affidavit of support: of my husband best friend, one friend of my family who is living here, one of my sister and my brother in-law proving the relationship is bona fide.

    6-Photos - family/daily not only photos of us we sent phone of family dinner, Christmas..etc.

    We are thinking send

    1- Joint utility bill (we never bother to do that, same utilities are under my name and some under my husband name) I will call tomorrow and request to have both names in the bills.

    2- Title our cars in both names (again my car is under my name and my husband under his)

    3- Joint utility bank accounts,

    4- My husband 401k where show that I am the beneficiary.

    5- More affidavits of support.

    My worry is all these changes will show now. I don't what to do.

    I am so sad because I feel we have to prove we are no lying, we are not fake. I'd love to have the possibility to go to interview and show them that my marriage is TRUE. Did any of you receive the same letter? Any suggestions?

    You didn't mention if you sent a copy of your greencard?

    otherwise it may be possible that you need more evidence showing commitments to your residence, like the utility bills, mail, cards, subscriptions etc. and yes the joint bank accounts are very important :thumbs:

  7. sorry but Canada is not an option. I tried it when I was here on holiday's back in 05 and knew it would be a long wait through the K1 process. I went to Canada and was permitted re-entry only for the time left on my initial 90 days which was one week.

    The immigration officer told me I cannot use Canada as a means to gain another 90 days- it doesn't "count"

    However, when traveling in 04 ( when I initially met my husband) through central and sth America I went through Miami three times as it was cheaper to fly back into the states and out to my next country than direct flights on international carriers. Three times I was given a brand new 90 day stamp. Go figure!

    To the OP, sorry to hear of your situation, good luck.

    I should clarify, i was at the end of my VWP 90 days when I went to Canada, not my K1! As mentioned its a one time visa, with 90 days to marry, not 90 with the option of coming or going.

  8. Is there anyway for me to stay in the states "Legally" without having to marry him?What processes would there be? If none, I am more than happy to go home and restart a life and hopefully get my job back.

    Not to deny anything that has been said by others so far, which is all essentially correct information.

    I did just think it worth pointing out one fact that may be of relevance here.

    JimVaPhuong put it very aptly that your legal status in the US is under your I-94, valid for 90 days from entry. And that you must leave when those 90 days are up.

    However, the requirement from the US perspective is that you leave the United States. Not necessarily that you "go home". There may be a difference,

    and it may be relevant to you.

    The flag on your profile is Australia. I don't know if that's "home" for you, but on the likely assumption that it is, and you are an Australian citizen, then you can leave the United States by going to another country rather than returning immediately to Australia. For example, you could travel to Canada, thereby legally complying with the need to exit the US within 90 days. Bearing an Australian passport, Canada should admit you legally as a tourist. After spending some time there (as little or as long as you like, subject to your Canadian admission - potentially a day or two , even an hour would suffice, or more), you could then legally re-enter the United States as a tourist on your Australian passport. You don't require a visa to do this.

    Does this buy you anything? Perhaps, perhaps not.

    You wrote that you want to "stay in the states". If you mean permanently - then no, this won't help.

    However, if you mean "temporarily", like to take care of some unfinished tasks, or other reasons, then you could potentially do this legally as a way to extend your stay in the US a bit longer. Your US re-entry would be on a VWP (as an Australian) and likely valid for an additional 90 days. You cannot work during that time, but you would be in the country legally.

    Did your husband get charged with a felony? I'm curious because if he was, i wonder if immigration would allow the same thing (letting him stay in the country after the abuse charge).

    Also you mentioned about them letting it all go after the dust settles...

    he's on a CR-1 conditional resident card. He has to adjust status in 2 years (2011). I'm hoping that they will see that i withdrawed my I-864 at my local uscis office and add it to his file, but who knows with immigration. They "lose" things when its convenient

    As far as I know an even an unconditional GC, does not protect you from deportation. I remember when hundreds of El Salvadorians and Cambodians were deported after being charged with a felony. The uproar came as most had arrived here as babies with refugee parents. The parents hadn't followed through with citizenship, and these kids grew up and joined gangs etc. and after prison release were dumped back in countries they had no knowledge or memory of.

    I know because I was living in Cambodia at the time. They couldn't speak the language and were for all purposes totally American. But, they f**d up and consequently were kicked out for life.

  10. Oh I was told by one of my former co-workers that if you have a baked-on mess in your casserole dish or roasting pan to let it soak with warm water and put a dryer sheet (bounce) in it. I tried it and it works like a charm! Other than doing dishes, thank goodness for dishwashers! I hate cleaning, hence a previous thread, i would definitely hire a housekeeper!

    ok this got my attention, I feakin HATE cleaning roast pans, but alas am a Sunday roast freak so it must be done!

    what exactly is a dryer sheet for ?????

    how long is it left in the roasting pan with the warm water???

    edited to add, I just usually spray a little oven cleaner on the rough spots, but would rather not mess with the chemicals..

  11. The extension letter is not one of the things listed on the ID44 from the NY DMV.

    no, but a valid green card is, the question is ,does the extension not make my GC valid?

    Why did you not apply for a permit BEFORE your green-card expired?

    umm he drives a tank which I wouldn't go near.... no money for a second car ...or lessons at the time (despite the fact I've been driving 24 years, I have to have them anyway) as one salary and my temp job didn't leave room for anything else back then.. times have changed..

    You had at least 2 years to get it.

    actually I had 1.5 years as I needed 6 months validity on the GC to use it! I would ahve liked to go 6 months before now, but couldn't . The why doesn't really matter..I'm just trying to ascertain if the extension letter I have is valid when they tell me I need a biometrics letter...thats all. If they must have a biometrics letter I'll go back in a couple of weeks or whenever... no biggie. Or as you say, get a passport stamp and use my passport instead of the GC as DOB proof.

  12. The RFE didn't ask for anything specific but had a attached letter that said send everything i just listed even though i sent most of it already! Has anybody heard of anyone being denied after submitting the RFE? Sorry i'm just worrying!

    Aha, just what I was expecting!

    I've read this before, the couple sent everything, then basically sent it all again. ( and were approved;)I think it's probably a case of losing your file, or bits of it along the way. They lost my medical along the way during AOS, so doesn't surprise me.

    - 6 month Apartment joint rental agreement

    - 2 Affidavits from 2 neighbours stating we both have lived in our home for the past 2 years

    - Joint power bill covering 1 year

    - Joint home insurance

    - Copies of Drivers lisence showing same address

    - 20 pictures of us

    That's about as much as i could come up with!

    I'm curious to know, what was missing the first time around??? how much of your list is additional??

    Are you renewing a NY DL?

    If NY you need 6 points of identity'

    NYS Photo Driver License /Learner Permit/Non-Driver ID Card. Must be current or not expired for more than 2 years. (6 POINTS)

    I was actually going to get a learners permit.

    I have plenty of stuff for the 6 points, but it states that the Greencard ( for use as proof of DOB as I can't use a foreign BC )must have 6 months validity on it, which is why I thought the extension letter should suffice?? A years extension is longer than 6 months? They weren't concerned with a stamp in my passport, ( didn't even ask for it)just said that only the biometrics notice served as an extension letter, not the original NOA - they called it a 'receipt' despite it saying on the first line that it is an extension of one year!

  15. I had a similar problem in Manhattan. The belligerent DMV employee who initially checked my documents was adamant that the extension letter was unacceptable, and as my 2 yr Green Card was "out of date" I could not be granted a NY lcense. He referred me to a supervisor, with the proviso "be prepared to be told exactly the same thing!"

    The supervisor told me it WAS acceptable. My problem, however, was that the New Jersey DMV, in granting my previous license based on my 2 yr Green Card, had printed "temp imm. status" on my license, which prevented the NY DMV from granting me a NY license.

    I therefore have to go back to NJ, get that removed from my license, go back to NY, and get a NY license. :ranting:

    A bit of customer service training at the DMV would not go amiss.

    oh boy, were you at Herald Square??? :) and did you have your first extension letter or the one for biometrics??

    The reason I went was that I had 3 days left on my cond Greencard and what I thought was the extension letter in hand. I hadn't been able to go before as my GC did not have 6 months left on it.....what a fustercluck!

  16. They are wrong. Keep in mind DMV people, for the most part, are drones, stupid as stupid goes. Ask to see a supervisor, better yet the director of that DMV, and tell him or her that you have been mistreated by an ignorant employee and would like that to be resolved right away.

    Bring a written statement and have him or her sign that you requested action in your case. Make sure you know what you're talking about but be polite and look the part.

    The girl was polite, she took it to her supervisor to check, and came back with" this is only a receipt...you need the one saying you have an appointment for finger prints etc..." Supervisor was locked away in a cave somewhere!

    Think I'll just go to another one. I work in Manhattan so it's not difficult. I just wanted to know who was correct so I could push it further next time.
