  1. This has been a nightmare for us. I filed our taxes to ITIN Operations in Austin on FEB 27th. We STILL don't have a refund 5 months later. You can read the horror story in our profile if you want the gory details.

    In hindsight, we would have been MUCH better off filing a 6 month extension, waiting on the SS, and filing electronically.

    Finally went to the local IRS office to get status of the ammended 2013 tax return submitted with the W7. Submitted the w7 back in May. IRS cutting the paper check this coming Friday. Now if she can get cc and visa will have the money for her ticket. :)

  2. The entry date in the U.S. is the date the individual entered the U.S. for the purpose for which you are requesting an ITIN. If he entered and you got married in the U.S., then you would use the initial date he entered the U.S. at that time. If he has only had short visits like you said and your marriage took place outside the U.S., then you would put N/A as this would not be applicable in this situation.

    N/A will get the form denied. I would put the date his first visit after your marriage, then explain the purpose of his visits on an addendum page.

  3. Will be doing much the same once my wife gets over her - just file an amended tax return once she arrives and receives her ssn then include her income for 2014. Then we are golden. ;)

    We went the long way with the ITIN. Started the paperwork in May and will finally be getting the refund for the 2013 ammended return this week. Already got the 2014 refund and used that transcript for the AOS.

  4. I'll be facing this issue here in a few months....

    I was going to give them her alien number as I know people who have had success with doing that and getting a permanent ID. It might not work, but the worst they can do is tell me no until I get her social.

    I have been down this road..... Filed the w7 with ammended tax return for the year we got married.

    As far as the DOD id card. First, I am retired and had my spouse entered into DEERS at the local NOSC office. Im in the US and she is in Philippines.

    They, NOSC, said they will not accept the A number or ITIN only a SSN. So they assigned her a generated id number for ID purposes. 2 years after I put her in DEERS I got her appointment at Manila embassy for her ID. They issued her DOD Dependent ID card valid for 4 yrs. The PO at NOSC said when she arrives in US and gets her SSN then we need to bring that in and update her files.

    The issue with DEERS TriCare insurance is they want a SSN so they can send the required papers to IRS next year saying she meets the health insurance requirements. I still need to contact DFAS and DEERS regarding this issue. DFAS says they need SSN but we are filing taxes with her ITIN.

    Take my PLDT as another example. It's been 3 days and no internet and they have replaced 3 modems in year :)

    I had to go out and buy a pocket wifi which hardly works :)

    However, I don't remember anything related to LBC? May be when I go to NSO they'd ask for another "Advanced Endorsement" fee where LBC would come to the picture??

    I think the Family Planning thing might be required if the Filipina was below some age? Mine is over 30 so they didn't ask for it.

    Now, another question to whoever can answer it ...

    I intend on doing a DCF because we live in the PI and her current passport (with the old name) expires in 2019.

    To do the name change in her passport (before the interview at the USEM), one would have to go the DFA which will require a CFO certification. Doesn't that mean going twice to the CFO? Once before the passport name change and one after the interview?

    I see alot of people only do the CFO, for the sticker, once as the last step though?

    Where did I go wrong?

    The MRS went to CFO to get the certificate to enable her to use her married name. When she gets her visa she will go back to CFO with the original CFO certificate to have it and CFO sticker put in her passport.

    Not sure if that was to me but here is my 2 cents.

    Yes I called after status changed to case being sent to NVC, every other day. And yes, there are some helpful folks that answer the phone at NVC not all but some. So yes I learned when it was received, when it was scanned, and got the case number a week after it was scanned. And yes a lot of those phone calls I got the "call back in 30 days" and if we waited everytime they said call back we would still be waiting on our DS-261 instead of waiting for CC. So better to be proactive, read the guides, ask the operators questions while you got them on the phone, and pray who ever touches your case is having a good day.

  7. Brass - I think you nailed this one on the head. Give her all the time and space. Be sure to assure her "how she is going" to stay in contact with family. SKYPE, Facebook, FB Messaging or whatever it is that you have set up for her.

    I tell you, if the family has internet at their place get them on magic jack and let her call for free and talk as long as she wants. After about 6 months she will be busy and it's less important to keep in touch every day for her.

    Your job is not complete. Assure the family she is in good hands, and ride into the sunset. The next 5 plus hours is going to be tough on her. She is going to need a lot of hugs and reassurance from you. I know you got this one.

    I would say the communication lines should already be addressed long before her departure.

  8. It has been two weeks since we got the noa2! W have been calling for two days non stop , finnaly before 5 minutes from closing and after an hour on hold someone answered and they said we should wait for 42 days for just getting the case number!!! Is that normal? Should i wait?

    Ours took 9 days from NOA2 before it was even sent to NVC. 3 days later NVC receive it. Then 9 more days before they issue case number and IIN.

  9. Really? Not even sure what to ask if I decide to call, lol! Cause there's basically nothing that they can tell me. Or is there? :/ I suppose i'll start worrying if it passes the 30 day timeline, which they mentioned in the email received today.

    My peace of mind is why I call.

    I ask them the status, what happens next, about the process. Never the same operator and I have been LUCKY to get the ones that will talk and look up our case and see the status and tell me to give it a few weeks and call back. Mostly they tell me what I have already read in the guides here.

    Many people here say that you don't need the sworn Affidavit (for proof of marriage) notarized or confirmed by a third party but by definition that's what an Affidavit is.

    Does anyone have an answer to this and where you can have the Affidavit made "official", if necessary?

    Thought about submitting affidavits from friends and family but they were all in the wedding photos. So we decided against sending. Used only the wedding and reception photos plus some other docs. If we had submitted any it would have been her godmother or godfather (both public officials, notaries, and witnesses to the wedding) who would have notarized them.

    So to answer your question any notary can do it.

    My interview is in 2 weeks and I just wanted to make sure on a couple of things :)

    1. My NBI clearance was released April 08, so with the 6 month timeline, it will expired on October 08. Will this be ok or do I need to renew this?

    2. My birth certificate is in the NSO paper before they changed their name to PSA. Will this be ok too?

    Any help is appreciated :)

    With reference to your #2. I just had my interview last week, and i just submitted my old NSO BC when i was asked by the screener. Godbless on your interview.

    2nd Thanks for the info. The USEM website still refers to it as NSO.

    I did read on the PSA/NSO website that even there is no expiration date on the docs that most embassies still want docs less than 6 months from date of receipt.

    But it's good to know they're still accepting NSO docs.

  12. Embassy letter now says we need docs from PSA.

    Does anyone know if NSO docs issued recently are still valid or do we have to go back and get docs from the new name, PSA? Seems obviously that embassy should accept NSO docs but thought I'd check if anyone has confirmed this?

    Wasn't aware that they had started using PSA name already. But NSO documents have no expiration date printed on them and should still be valid. But had the wife check the copies of marriage and birth cers she just got last month and their both PSA but the older copies I have are NSO.

  13. This is part of our problem. The terrible internet connection in Metro Manila's poorer sections of town. And, since I'm an OTR trucker, I get into areas of the US with either terrible or non-existent cell coverage (how I get online thru verizon). Couple that with my 24/7 type job, and I don't know one day to the next what time I'll be driving.

    We've gotten to the point with her new residence and my new trucking company, that I'll ring her when I stop driving, unless it's the wrong time for her. Then either I will hang up or she will decline the call. Next, she walks to a place where she gets good enough coverage to use the fb messenger app and we can text each other. Sometimes, but rarely now, she'll vid call me from skype, but that disconnects on us too quickly. And sometimes she'll ask me to call her, but our hour-long conversations ring up expenses pretty quickly. Which is difficult since I'm sending her money every week and paying for her sister's Philippine college (they're one of the poorer families, I believe, but have cell phones that sometimes even get loads).

    We have pretty good success with "we chat" app. Text, voice, video calls.

Another question for those of you who are in the process or have already sent in your AOS and IV packages - along with the required documentation that is outlined in the instructions, did you send any other supporting documentation? For example, the documentation that proves relationship that you sent to USCIS (like the calling records, emails, letters, air ticket itineraries, stubs, etc.), or is that not required for these packages?

    We only sent one additional document that was not available when we submitted the I-130. Not a requirement but important enough to us to include in the IV papers.

  15. For your documents

    AOS packet. the petitioner will need an I-864 form fill out if you can use the I-864ez form it is the shorter form but there are 3 requirement to be met to use the form. You will need last three years of tax transcripts as one of the question on the I-864 ask you for the income on tax returns for last three year. Some countries only require the latest tax return to be sent in I will recommend sending in all three.

    you will need proof of curent income . A employment letter vertify income and or copies of paychecks stubs

    when sending in tax info if you send in tax transcripts you do not need copies of w-2 If you send in copies of tax returns then you will need copies of w-2 and anything else that was sent in with the tax return to the IRS

    This should take care of the AOS Packet i will post another post for the IV packet

    If you filed jointly then w2 are required with transcript.
