I'm confused by the title. So you came on K-1? Did you AOS before the divorce? You are now looking into ROC with divorce waiver?

yes I came with K1 visa and I got married 2015 then on 2016 of November my divorce was final and 2017 June my lawyer applied for my ROC and July 17 I got my appointment for Biometric ,. im asking after this process what do I have to expect to receive?

  3. hello guys after all those worries that I always wonder for my removal of condition ,

I came here 2015 and got married June on that year , after married we didn't expect of what are the outcome of the relationship, sometimes if work and some of us suffer from called relationship unstable and lead us into separation and divorce. 2016 I've got divorce and I was scared about immigration, I don't have anything to show or to prove to the immigration that the marriage is legit, only thing that I showed are the flights of our travel and 1 picture of our simple marriage and the joint bank and credit card account , and I feel insecure because I don't have anything on his any liabilities . and also I have a letter from him to ask to remove my condition.

last February I look for a immigration lawyer and I got one , im glad that I already work and save money , and the lawyer help me and for short they sent my case first week of JUNE 2017 and I got notify last week of June that they receive my case and I have to wait for a NOA for biometric and today July 17, I did done my biometric and my question is after biometric what else do I expect? anybody can tell me?

Look, I understand what you are saying- and while it is completely accurate--- I do find it somewhat borderline on being considered "fraudulent or illegal activity" so I am going to report this post and have the mods review it.

My line of thinking is- yes, you are suggesting a legitimate immigration path. However you are suggesting it as an alternative to someone who can not meet the burden of proof for the path they are currently on. This is in effect circumventing immigration laws. Its almost like saying to someone well, if you cant meet the proof for a tourist visa then get married to be able to enter the US. Again- legal but very questionable. I do not believe on VJ it is allowed to suggest things in an effort to CIRCUMVENT current laws or situations one may find themselves in, but rather to provide suggestions and options for the current situation. I hope this makes sense... I mean its a tricky area and how the words are said make a difference. I am not really comfortable with this circumventing suggestion being thrown around on this and other threads- But I will respect the mods decision on the issue.

will some of the suggestion of the people like what you read is not helpful..

do you any idea about what im facing at the moment> ?

    ?

can you send me a message privately ?

You can't send what you don't have. His letter in support of your application may help. Did you file taxes together during the marriage? That's a good piece of evidence.

What about joint lease from the time you lived together?

while were living together i dont have source of income before , because im a student and doesnt have job.

when i move here with him. and we dont file taxes together , because i moved out january 2016 when we agree of divorce.

i got job later arround of july and we only file individual i will apply by my self only this coming filling of taxes.

what i have is only i stated above.

  6. Hello Everybody

I need a support from you all guys, I'm K-1 visa and I was married last year.

After a short period of time living together, we found that our interests and expectations were not compatible.   After prolonged and ongoing disagreements and verbal arguments we mutually chose to divorce due to irreconcilable differences.   Although our marriage was short-lived, our initial long-term intentions were 100% sincere. We depart with no ill feelings towards each other nor any future expectations from each other. our marriage are in good faith.

so now were separated and our divorce was already final,

what I am asking is, what are the proof though I need to collect?

from out marriage we have only joint Bank account and Credit Card, And also I am on his Phone Plan and he don't want to cut it off , even we are Divorce already our Joint bank account still active and he don't want to cut it off it also,

aside from that , we separated one year already and i  move to other state and find a work and i got a job at the Bank, and i have my bank account and everything. even i am on my own after our divorce still our communication still there.

so now He already wrote a affidavit of statement about our short living together.

my green card will expires this December 2017.

i don't have a lot of proof to send to immigration,,

I am still able to file for my ROC by my self, and continue to live here and to work?

guys help what i need to do.

thank you and Happy New Year,

  7. Based on this,

not quite sure what you want to do? It seems like you have a 10-yr green card unless you copied someone else's timeline.

If you are due for ROC next year as you say the reality is that you should file for it as soon as you have a divorce decree in your hands (which can be prior to your ROC date).

Jobs these days are found online so pull up a google map of the area where you want to work and then enlarge it to see what businesses they have there and go to their websites and apply. There are also temporary work placement agencies that will find jobs for you - you'd first interview with them and take their computer skills test (typing, word, powerpoint) and then they'd place you with a company for x amount of time.

okay yes the requirement listed was send by someone on here, so i pasted that because i don't have those things to proof if i file for a ROC i have two years green card.

and next is the removal of conditional but before that i am separated with my ex now and we filing a divorce,

two proof is not enough to provide and proof to them, a friend of mine trying to help me but i don't know if i will be granted for my ROC process,

im in downfall now feeling hopeless..

  8. me and my ex -partners have discussed about our relationship before filing a divorce , after our marriage few weeks later our relationship didn't work along and before that , I'll bring you all back form the beginning , I came here because of my Ex-Partner not the country to live because of its awesomeness and beauty, i came here because i want to be happy with someone i can love and be loved, before i came here , my partner keep promising me about if I'm moving with him he help me to pursue my higher education in which i started in my home country, but before that i have a doubt before of coming here and live with him, so i decided to be with him and i surrender my scholarship in my home country and fly here and to be with him , then first months his so sweet and loving and we love each other, but after marriage he change and i don't know how to say this , he use his strong voice to control me and i must to follow to what he say, following his hand my neck, and forcing me for sex even we had just finished sex of course its still pain, and i am become emotional, he force me to get a job even I'm trying to look for a job everyday , and he didn't help if i ask a question of how i can get work and i applied but i have no luck for hiring , so i still keep looking and when I'm home and he home from work when he ask i said i went to many different restaurant mall fast food to give my resume but i didn't receive any calls , and he started to force me that i should have a job. and yes I'm pursue my self to get a job. so i become more emotional and he didn't included me in any bill , health insurance and anything only i have included is in bank account and phone bill . so i ask him that where is the promise he said to me that he going to send me to a school to continue my higher education and he told me get a job and pay your education, so i was feel hurt, because he don't want to help me , so i keep looking for a job and finally i get into this Central casting and become a background actor , but i have to keep wait for the schedule of mine, and aside from that i have keep looking for a job and i really want to go back to school, i become more self pity and emotional because i want to pursue my education, and then he didn't enjoy with me the 4th of july ,hollyween , christmas and new year , he leave me in the house and he went for a trip in all of those occasion alone and i only my self alone in the house , and january we came to a big argument because i am not happy at all, he kick me in the house and packed my things , and i walk to nowhere at night , and i called 911 and i don't want to live in home shelter , and i call my law year friend and he get me a ticket and i move with him , but after all of this i have already a green card , so now i am into a time of divorce process and it will be granted by october or november and next year is my green card expiration ,

so now i don't know what to do about the ROC process.

I have only a few evidence before we divorce :

    - Joint Bank Acct

    - Phone Bill

I Don't have a lot of Evidence like this listed below :

-tax returns for 2009,2010 and 2011 both filled married but separate.
-4 credit cards ex wife as an authorized user and we were using them.
-joint lease for 2009 and 2010
-2 joint checking accounts used to deposit money in them to pay the credit cards n other bills.
    -joint electric and cable bills
    -joint health insurance
    -joint renters insurance
-affidavit from ex wife, n her mom
    -affidavit from my parents
--joint car insurance and joint car registration
    -driver licence showing same address
I used a lawyer but i could have done it by myself but i didnt wana take a chance.
I got my 2 yr green card in June 2010.Divorce was granted in May 2012. Sent roc in June 15 2012. First NOA on June 16. Biometrics July 23 2013. Approval letter for 10 year greencard on May 11 2013.

id any body can help me what I'm going to do?

  9. They say the first and for some reason the 7th year as married is the hardest. Have the two of you considered marriage counseling before giving up on each other?

yes we did a counseling but both of us agree that its not going to work as we try and try hard to but there is not working on,

so we decided to get divorce in a good way we talk about it and for both of us to be happy, and we filed .

    thank you .

  10. If you are a Philippine national any divorce you file for in another country would not be given recognition by the Philippines. However, if the non (Filipino) citizen, in this case your American husband (USC) filed, then it would be recognized as valid in the Philippines.

At least one of you would have to meet your state's residency requirement in order to file.

If you are currently living in USA you can file (initiate) for divorce in USA as long as you meet your state's residency requirements. You can be divorced with your husband in USA where you initiated the divorce but not in Philippines. Once you move back to the Philippines, you will be bounded by Philippine law. You will still be married in the eyes of the Filipino law unless you will seek annulment. Annulment is too time consuming not to mention expensive and not a 100% guarantee that it will be granted.

To make your future path smoother be sure to have him file the divorce papers against you.

    Thanks For the Info.

I am a Filipino Citizen and what I've said is i am a green card holder, and I'm married a US citizen so thats mean I'm still recognize in the Philippines as Divorce? i am still living in State and surely coming to Philippines to visit .

what is status requirement are they can you message me privately and can you help me? how to remove the ROC and filing?

  11. Thanks for the info, Merrytooth. They posted in the K-1 forum, so I thought they were in the middle of AOS and hadn't received the green card yet.

OP> The EAD was no longer needed or valid once you received the green card, so ignore what I said above and do not bother to file for a renewal. If you already put in a change of address, then just file for your ROC using that new, current address that you already informed the USCIS about. Also, you seem to have a lot of confusion about the immigration process, so you may want to consult a lawyer to help you.

~ Moved from AOS from Family Based Visas to Removing Conditions - OP at the ROC stage, not AOS ~

    Thank you very much guys!

This is helping me so much about my confusions .

  12. Woah, please don't shout at me (using all capital letters is shouting). I was only trying to help.

As you only got your green card in December of 2015 you can't apply for citizenship until late 2018. Once you are divorced you need to apply for removal of conditions on the green card.

Does this guy who is offering to pay for your removal of conditions and citizenship expect anything in return? Please be careful and not get into dangerous situation.

hehe thank you i didn't meant to shout on you.. hahah

I'm sorry but thank you ,

okay so i will apply for ROC for my when my divorce is final? and that will be happen by next year before my GC expire?

no there is no in exchange of helping for the fee of my processing, his a good friend of mine that i know for very long time,. but thank you for you concern ,

again i dint meant to use the capital letter for shouting ,, I'm sorry for that,

    thanks for the help.

  13. Your timeline says you got married from a fiancée visa in July of 2015, how can you be applying for citizenship if you only came over last year?

What visa did you come to the us on?

    When did you marry?

When did you get your green card?

    Did you remove conditions?

This 'helping' person, are you in a genuine relationship?

yes i got married with a fiancee Visa, and married last year, June 2015

, I GOT MY GREEN CARD 2015 TOO,

I CAME HERE WITH A FIANCEE VISA,

    I MARRIED JUNE 2015

I GOT MY GREEN CARD 2015 DECEMBER

I DONT KNOW WHEN I WILL GOING TO APPLY FOR ROC, IF I GOT MY GC DECEMBER OF 2015 AND IT EXPIRE 2017 DECEMBER , WHEN SHOULD I APPLY FOR IT.

NO I WAS SEPARATED COUPLE OF MONTHS AGO, OUR RELATIONSHIP DIDNT GO WELL, .

SO I LIVE BY MY SELF AND I MOVE IN A FRINED PLACE,

HOW CAN I RESOLVE THIS PROBLEM , ANY IDEA?

    THANK YOU.

Looks like you've been misinformed by that person who you are planning to move with.

    YES I HAVE.

  14. You have to change the address with USCIS after you move, so yes change of place is not a big deal during the citizenship. You have to be residing in the same district for minimum of 3 months before you can apply for citizenship provided you are eligible from other aspects.

By the way, how can your new partner help you for continuing residence in the US and gain citizenship by next year?

    thank you ,

his not my new partner yet,

his just helping me to pay for the fee for the processing,

    but thank you..

  15. Yo should have put in a change of address as soon as you moved. There is a form online for it. It is even more important for you to do so since you have a pending case with the USCIS.

i change my address after i separated with my partner and i move to different state and using my friend address and i updated it online so now i know someone and want me to move in another state. so i have a lot of things to do..

im afraid if i will be having problem in immigration ,

    thank you ,,

  16. File for a renewal now. It tells you in the instructions what it is needed. The fee is still waived, just include a copy of your I-485 filing receipt notice.

~ Moved from K-1 Process to AOS from Family Based Visas - topic is AOS, not K-1 ~

i change my address now and I'm living in a different state ,

do i need to change my address in USCIS before i process the renewal of my EAD?

  17. help!

    I'm separated with my partner,

im a GC holder, my previous partner, our relationship after marriage didn't work out, we are separated now, and i move to a different state and i change my address using my friend home address in the USCIS, i did it online , and now i meet someone who can help me for my continuing living here in US, He /She decided me to move on his/her place and help me to process my Citizenship by next year. and we are sort of called ( dating )

my question is that, it is okay to change address in USCIS multiple times?

i want to move to the person who want me to move on the place where he/she lives .

it is questionable in during my interview for citizenship ?

    thanks guys.
