SO I have been a green card holder for 3 yrs, married with my US citizen man for 4 yrs and is now ready to file for n400.
My big question is, can I petition a relative (my mom, using I-130) who is ALREADY here in the US, same time I file for n400? She got to the US years ago thru work visa but she overstayed. Will I have problems with this? I am her only hope.
Anyone who had the same situation? Did you get approved? Will that 'endanger' my US citizenship filing?

Did your mom enter the country legally? Does she still have her I-94?
You can not petiton her unitl you have your Certificate of naturalazation.
Yes she entered here using a work visa then she overstayed.
I swear I have read somewhere here in VJ that I can, at the same time, file i-130 same time as n400???!!

i filed my aos after a year my 1-94 expired. i had no problems whatsoever. I dint even have an interview. nothin to worry about. you are good to go. important thing is to read guidelines and submit everything that is required (evidences/support papers). goodluck!

I just wanna tell u that i applied for my AOS a year after my I94 got expired and I did not have any problems whatsoever. Check my timeline below. I dint even have any RFEs or interview. I also know some friends who applied late after and had no troubles as well.

its optional. but who the hell knows about the waiting time. some took years before they got their green card approved, some got lucky and only had months, just like me . If I just knew that I was gonna get my EAD approved almost the same time as my AOS, I would have not applied for it... cuz its a freaking $180

mine took about 3 weeks from mailing to actual biometrics appointment. ya i gree w/ above replies call USCIS right away! goodluck!

I cannot believe this! I must be blessed! Why??? Because
- I applied for AOS MORE THAN ONE year AFTER my I-94 of expiration (I was on K1 visa)
- My medical exam got expired and took another one
- I did not have any RFE's
- I did not have any interview!
and best of all
- IT TOOK ONLY 3 MONTHS - FAST PROCESSING!!!!

im my case i had to re-take my med. exam cuz i applied on later date. that means mine got expired. so anyway it cost me about $200+ for the whole med exam

im sorry to hear this. i had no problems w/ my ead. it got touched only one time then after 3 months they approved it. sorry i know its not making u feel better but anyway, just hold on tight. it will go through anyways.

i got mine transferred BEFORE my biometrics appt.

they notify u by snail mail and if you've registered on their website (online case status) and checked to receive notifications from them, then yes they will notify u thru d email you provided them.

It says on the Social Security website that in order for non-citizens/immigrants to apply for a SSN, is that i need to show my current Immigration Status - I-94 card (+ some other requirements).
Well... my I94 card is expired already. I know i should have applied for it sooner but i just got preoccupied (dont shoot me!).
But I already have my EAD card.. Will they approve me of a SSN????

so i got my EAD approved after 2 months of applying and yes im freaking excited
Question is i filed AOS and EAD the same time... but i checked d case stat online and they havent touched my AOS since September. It has been on CSC since then... i thought this is gonna be faster processing..
Are they missing it? Or this is normal that EADs get approved first?

SOOOooooooooooo if it has been transferred to CSC already .... MEANING NO INTRERVIEW ANYMORE???

We got an RFE too, just after the applications were sent to MSC. I believe...and if I'm wrong somebody correct me...they are sent to MSC first (after sent to the lockbox in Chicago) before any of them are transferred...if they are transferred.I was told that even if you get an RFE and your app isn't transferred, it still CAN be transferred, once the RFE is sent back, with the requested information. I hope so, 'cause if it's transferred to CSC (our case I mean) then that means my husband will get his GC without an interview.
