Im finalizing my AOS packet and I need to organize the payments for the process.
I have noted that it is $360 for the 131 Advance Parole filing fee, $465 for the 765 EAD work permit filing fee, and $1070 for the I485 Adjustment of Status.
Do I need 3 separate money orders for each filing fee? Do I need to pay all three or are any included in the filing fee for the I485?
As well- I had my medical done a week before my interview, do I still need to complete form I693 and visit a doctor locally or can I include a copy of the vaccine records and sign off I was given at my K1 interview?
-
Do I need to include a supplemental sheet explaining why I qualify for an issuance or where I am including it with my AOS is that redundant?
-
I am in the USA on a K1 visa, we got married at the end of January and I'm finishing up the paperwork for my adjustment of status now. What is Advanced Parole (Form 131)? Do I need this? I do not have any immediate plans for travel, however I don't want to be limited in the future to be able to travel to Canada to visit my family. The information I am finding online is heavy with legal jargon and I am having a hard time following it.Anyone have any info/insight?

oh my god, thats so heartbreaking! to make it that far and be told you need to do more, I'm so glad they gave you that option! good luck! I am hoping that his mom makes enough to satisfy the requirements I'm so nervous
Reposting this for you here:
It'll be up to the CO. Did your fiance work last year and have a tax return? I didn't have a tax return or anything because I didn't work last year either. We used my mother as the cosponsor, she made 24000 last year, 27000 this year, the line for 125% is 19912$.
Either way, at the end of the day it's up to the CO and all you can do is pray and hope. A lot of people I've talked to here on VJ believe that myself and the two other people who were all refused for financial reasons just hit a really bad week to do the interview. We don't know if they just went really hard on the proof or what happened, but for some reason THAT one week in September they focused harder than normal on financials.
Now you don't get denied 100% because of this, if for some reason the CO does decide that it's not good enough for what ever reason, then they ask you to find another cosponsor. In our case our 221(g) states we have a year from recieving the 221(g) to find submit the required docs they asked for (I-134 and supporting documents).
We went in thinking we weren't going to be denied and the interview went GREAT up until he pulled out the financials. VJ has a really bad habit of repeating "Oh just get a cosponsor, you'll be fine" without mentioning that at all times the consulate officer can use their own discretion and ask for ANOTHER cosponsor. It isn't until you're kicked back that people come out of the woodwork and say that it happened to them too. I used to repeat the same thing too, until it happened to us.
I wish you the best of luck and think positive!
As a quick over view: I am unemployed, we had a cosponsor (my mother) who provided Tax return, W2, employer letter, paystubs, and the I-134. She made 27000 a year, she only needed to make 19,912$ a year to fufill the Poverty line 125% requirements. We were refused the visa, told that the CO didn't feel comfortable, and to just send in another I-134 from another person to be the cosponsor, along with supporting docs and the visa should be issues.
Luckily today, we are being sent the paperwork from our new cosponsor, hopefully have this sorted out and my fiance here in December! -
If she meets the appropriate limits, you shouldn't be denied...its a matter of numbers. Plenty of people have a co-sponsor. Perhaps someone else can speak specifically to a situation where the petitioner is entirely unemployed?
thank you so much for your reply! Also I would definitely benefit, at least for piece of mind, if I had heard of someone in a similar situation. His mom makes well over the limit thankfully!

I am FREAKING out right now- I have my interview at the Montreal consulate soon and unfortunately my fiance, the petitioner, has been unemployed for a few months, 2 of those months were spent here visiting me so he was unable to work. So we have a cosponsor, his mother. What are my chances that I will be denied based on this?

Yes, it's true. I bet if the other poster Shucks wants to confirm their Nov 16th appointment, I bet she/he made their appointment between 12:27PM EST and 12:34PM EST.
Anyway, I'd prefer a December appointment, so I'm going to keep my script checking. I'll post here when dates open up, after I've selected my date.
I did, it was closer to the end of that time and the beginning of the 17-25 opening timeframe.
its like you legitimately need to refresh that page every two minutes in hopes of getting something

I got an appointment today!!!! November 16!! I hope I'm not the only one. Hang in there!!!
-
I've been refreshing and checking for a few days now as I got packet 4 on friday and completed payment and Loomis pickup. Hopefully spots open up soon
we were hoping to be together for christmas

Hi there! I'm trying to figure out if I need police checks and unfortunately the consulate has not been overly helpful. Some information I am getting online says I need a police certificate from any country I have lived in for longer than 6 months but this email I got from the consulate leads me to believe its one year:
"Each visa applicant aged 16 years or older must submit a police certificate from each country in which the applicant has resided for one year or longer. The certificate(s) must be issued within one year of the date of the visa appointment. NOTE: An applicant must present a police certificate from his/her country of current residence and country of nationality, if residence in such country exceeds 6 months."
I studied in ireland for less than one year (was there 3 months, home for 7 weeks, back to ireland for 3.5-4 months)
Do I need an Irish police certificate or just one from my current country which is my country of citizenship/where I was born?
Thank you!

Hi all!
My fiance and I had our I129F petition approved on Setpember 3, so now we are thinking of the next steps. My fiance (the petitioner) is American and I (the beneficiary) am Canadian. Currently we are trying to sort out what to do about the affidavit of support. I am getting conflicting answers online, some sites are saying I will need it for the interview, some say I only need it for the adjustment of status.
So this is our situation- my fiance is currently unemployed and looking for work which is adding to our stress over the affidavit. As well, we are unsure if the income requirement is for household and what to do if there are other earners in the household? He lives in his mother's condo with his brother, she lives with her boyfriend but the condo is owned by her. So would they count under the household? Does anyone else need to include their income? The form only asks for my fiance's information but do his brother, and/or his mother count toward the household or would it be just the two of us as it would just be us he would need to support during that time period?
Thank you, and I appreciate any information anyone can give me, or even a lead on who I could call and ask these questions!

After submitting your RFE info will the USCIS "check my case status" thing update when they've made a decision or will it only come in the mail?
-
Good luck! What did they ask for?
Thank you! I can't believe I forgot to include what it was for! They pointed out that he had written the dates on our photos in the wrong format which was mildly annoying but everything must be by the book! As well, they asked for confirmation that we have met in person in the past 2 years. He wrote a letter as per their suggestion, attached hotel receipts and bank statements, as well as our passport identification pages with stamps from our trips, and our itineraries (they said the name wasn't clearly visible in the original submission).
-
our RFE response was received September 1! heres hoping everything is kosher!
-
Thank you so much for your reply! unfortunately i cannot for the life of me find our boarding passes! and I'm not sure if we have anything that has both of our names on it. Do you think a written and signed statement from his mother stating that she met me and I was in their home would count? I'm just concerned because we included banking statements in the original packet that showed we spent money in the same place at around the same time. I have itineraries and (now) the pictures of my passport/stamps, he will include his passport stamps as well, I have a picture I downloaded from snapchat of the two of us together with a geostamp on it saying "san francisco" and I'm hoping that helps prove we were there together.
pictures are not a good source of "primary" evidence. they're good to include as secondary evidence but you need more substantial evidence. the passport stamp is good. include a copy of the visa, airline tickets, boarding passes, bank statements showing money being sent there...Anything (besides pictures) that can show you both in the sama place at the same time. ex: i had bus tickets for me and my fiance that actually had our names printed on them with the dates, times and our id numbers...so uscis had NO doubt that we were actually together in the same place.
i would say submitting some evidence from after the submission is fine, but also include more from before the submission. good luck! -
FINALLY got our RFE!!!! Apparently my fiance's brother got the mail 2 weeks ago and forgot to let him know there was a letter there for him!! So, it says we need to include evidence of meeting, fiance thinks that he didn't date the photos correctly (shortening 2014 to '14, that sort of thing) so I just emailed him all the photos I have of us including (full) dates and locations, as well as my passport info page and the page with the stamp I got at customs when crossing the border. He is going to write another coverletter and in that will detail our meeting, how when where it happened and how often.
Are we allowed to include evidence dated after we submitted the initial I129F form? he sent the I129F the day before he came here to visit me and I have SO many pictures from that trip!
-
our RFE was sent out on August 11 apparently, and we still haven't gotten it. We also haven't received a hard copy of our NOA1 in the mail. I am a little freaked out now
-
that is AWESOME news!!! thank you so much!!!

so basically, the USA/CAN government looks on co-sponsorship favourably? My fiance (the petitioner, USA) has been unemployed for a little while (largely due to our visits, hes been living off of savings) we are worried he wont have enough for us to be approved so we wanted to explore the option of him having a co-sponsor for our application. I'm the beneficiary and I'm Canadian
-
I have tried searching this topic, and the general consensus is that it is consulate specific. I was wondering if anyone had any insight on financial co-sponsor when the petitioner is American and the beneficiary is Canadian? I believe our case would be going to the montreal consulate as it is closest to my province.
Thanks!

Our tracking thing on the uscis website was updated today that they are sending us an RFE. I have my suspicions that its because my fiance didnt include ALL pages from his passport so I suggested he get a long form birth cert AND photo copy all pages and have that waiting.
How long do RFE's usually take to arrive?(I just saw the answer to this a page back!) We haven't received our hard copy of our NOA1 yet so I'm not sure at all how long it will take to get to his place.Also- do they get sound out from your processing center or from texas? our processing center is in California which is the same state he is in so I am inclined to be a little more optimistic about length of wait if its coming from within the state. Thanks for any info!!
