There is no confusion it's 3 year statutory period for you as your filling as spouse of US Citizen.

However consult and hire immigration attorney in your case strongly recommended. And hope you have all court documentation and final courts transcript before expungement as would be needing that on your interview. Good Luck.

Received my Oath date finally I will be taking Oath on June 21st 2016.

All cases go through a supervisor. An interviewer can give you one of three outcomes:

Recommend approval

Decision cannot be made

Denied

If approval is recommended, sometimes an applicant is asked to wait while a supervisor reviews the file and the applicant is then given an oath letter for a same day oath or for a later oath ceremony.

If there are questions about the application or if the interviewer has not had a chance to go through the file prior to the interview then the applicant is told that a decision cannot be made.

There is another interesting option which I received after my interview. " We will mail you the decision".

After that officer said everything looks great and this file has to go through my supervisor if we need anything we will let you know. Then at the door he said congratulations.

Two weeks since then waiting game continues.

You guys are lucky. People are waiting and begging for a Interview and you guys are Scheduled for two

That's what I will do. I will call 1-800 number and insist to talk to Tier 2 officer. They can see in their system your Interview dates if they tell you to go to first interview I will go on First date preferably and after the interview tell the interviewing officer to cancel the second interview as there is no requirement for it and it should cancel automatically.

Thanks Kovacs ! Done with my interview. Everything went well ! Officer gave us document saying "you have passed English and civics test and we will mail you decision". Officer said everything looks good but I need to send this file to my supervisor for review, if we need anything we will let you know otherwise we will schedule the Oath. In the end while seeing me and my attorney off he said congratulations to me. Lets see how long more it takes to schedule the Oath.

When you waste their time and resources and not show up on the interview they will call you. It's US Government you are dealing with.

So what is your online status now ? It must have been charged when interview was scheduled and also before that when you were in line for interview. In some cases it does not change for finger prints scheduled and stay on application received. And yes you demand to talk to tier 2 immigration officer tell customer service guy I allready missed the interview and you don't have access to system where the schedule new interview.

Your case is very strange from day one. How come you did not sign up for online case information you get texts and emails in real time in case progress. And when you call who do you speak to customer service or Tier 2 immigration officer ? Customer service does not have all the access to information.

Before you go on info pass you should call tomorrow USCIS and demand to talk to tier 2 immigration officer and tell him the whole story. I would not be surprised if they deny your application as you are missing interviews which people are begging for who are stuck waiting for interviews, some are considering suing them in the court to get interview and you are no show on interviews. In that case you can appeal stating you story or file a new one. Tier two immigration officer can also fax your interview later.

She did mention that i takes around 1 and half month to get oath letter.

Santa Ana does NOT . Once a month oath ceremonies.

Today was my interview and my Application was recommended for Approval.

What I didn't understand is why do they say that Your application is recommended for Approval, isn't the person who interviews us takes the decision?? Because in some cases i see they take the Oath on the same day itself.

She approved it and now moving the file forward for to her boss to have a look at at it just another set of eyes if anything is missing. Does your local office allow same day oath ? If so, only then you can take oath same day.

Yes and I am one of them , I filed in January though had my FP on Feb 3 and still says "Received your application' thingy online. I guess waiting is the only option here.

Did you mean you filed in January 2015 ? People who filled in March / April 2015 and was stuck in background are slowly seeing interview letters.

all of you guys who are stuck with Background check would suggest contacting your state senator - I contacted the senator here in Washington and in about 2 weeks surprisingly the background check was all clear or maybe its a coincidence.

Just a coincidence ! Cases are stuck due to background checks and that is not in the hands of USCIS . Having said that it's good idea to contact your representative to let them know the performance of USCIS and get another formal answer from USCIS.

I got an update - as of today my case is inline for Interview - Thank God the Background check is done its a horrible waiting Game.

If your case is pending Background check then i am afraid no 1 can help you - u will have to wait it out it can be from 6 months to 3 years in some cases

Have you seen any case which is stuck for 3 years in background checks? It used to 3 to 5 years not anymore. The maximum what I noticed is year and a half 18 months. I know one case which is stuck for 2 years also from Pakistan on other forum but he already have had interview and should have filed WOM long time back. Anyone who is stuck for more then 18 months should immediately sue them in Federal court in my opinion else they will be stuck for ever.

So frustrated. My wife and I did our applications on the same day back in June.

We had biometrics back in September, maybe even August.

She had her interview back in October, and her ceremony in December and is a USC.

Mine? Nothing. I've had my biometrics etc back in September and then have heard nothing. Attorney says my wife's was processed 'unusually fast', yes others in the filers for June group have been completed already (most but not all).

They are now putting in a third information request as its out of normal processing times.

Should I call anyway? I just KNOW they have lost me somewhere in the system, but don't have a route to get an answer.

Your case is stuck in FBI name check and background checks like mine and several others. Ladies usually fly through this step generally. They consider out of normal processing time 90 days past processing date Santa Ana is still showing June 26 but the new processing dates will be updated around 15th of each month. You can call speak to level two immigration officer and try to open a service request through him/her or inquire through you Senator or Congressman But background checks needs to take its time as USCIS can't put you inline for interview unless they are done. I guess we all have to be patient.

You can achieve the same objective by disclosing your traffic tickets on the time of interview without confusing the heck out of your application and multiple officers who are reviewing it. If you are applying the logic that traffic tickets are offence by answering 23 with yes then you should apply the same logic for 24 and 25. Where you are charged with offence YES (clearly). And if there is any fine or probation for traffic tickets order by court of judge will result in convection for immigration. So 25 would be yes too lets confuse them even more now with yes answer for convection.

I guess this is a Grey area but logically they are interested in looking at bigger things then your traffic citations which they say you do not need to provide evidence off. And you can always disclose them on the interview if they ask and provide paper work end of story.
