    Hello everyone,

I was wondering if AAO send you directly a notification letter in case they sustained your appeal as they would in case they denied it?

I have received my case update that say as follow:

Application Type: I290B, NOTICE OF APPEAL TO THE COMMISSIONER

    "Your Case Status: Initial Review

On July 31, 2015, the Administrative Appeals Office (AAO) transferred your Form I290B, NOTICE OF APPEAL TO THE COMMISSIONER, Receipt Number MSC xxxxxx ,to the USCIS office that made the original decision on your case. That office will mail you our decision or send you a request if it needs something from you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address."

My next question is that after reading this update, can one tell if my case was remanded to USCIS so they can give another look to my case and render a new decision or the case has been approved by AAO?

    I Will appreciate any help.

Any news from your case now...If yes how has it gone and how long did it take..

  3. Since the children are biologically yours then it paints the picture of you being a womanizer. Those letters from USCIS are officially worded but you have to read between the lines. They don't think the marriage is genuine and that you are a risk to the USC.

You will have to explain why you had two other women pregnant right before your wife.

But the most important question is does your wife know about these children? The biological version, not the "adoption" version?

If not, best to put the case on hold and have that talk.

My Wife is aware of the kids and she filled for me and wrote their name on the forms as my biological children. She is 100 percent aware of the kids

  4. I'm sorry but I suspect the kids are yours and you had them with two different women close in time. Everyone is telling you the problems you will run into if you claim they are yours when they aren't yet you keep thinking otherwise. Be truthful in this journey because the embassy and USCIS see everything. They've been doing this job for decades. Your story doesn't add up to me(another Ghanaian). Good luck.[/

OK TH KIDS ARE MY OWN BIOLOGICAL CHILDREN BUT WAS GIVING NOT IN RELATIONSHIP...JUST A ONE NIGHT FUN AND THE WHOLE NIGHTMARE CAME...WHAT ARE MY CHANCES BUT THE DATE IS 12 AND 2913. THE 2014 STUFF IS AN OVERSIGHT AND WE CAN PROVE THAT QND WE CAN GO IN FOR A DNA..ITS OK WITH ME. ...WHAT ARE MY CHANCES IN THIS

  5. You have to stop portraying adoption for immigration purposes as this easy. If anyone could adopt a relative and bring them to the US we would have all done that. First, a child adopted from a non-Convention country must qualify as an orphan under U.S. immigration law and the adopting parent(s) generally must follow the orphan process. Are the children orphans? After this, granted he has become a permanent resident, he has to live with them in Ghana for two years and have custody over them (officially) for two years before any petition can be filed.

What about if they are my biological children what can I say and do differently with reference they are making. Their birth age are 2012 and 2013 not 2014 as they said.

    ****Overseas Investigation

As part of the processing of your case, USCIS (or, in some cases, the Department of State) will conduct an investigation overseas to verify that the child is an orphan. The purpose of the investigation is to:

    • Confirm that the child is an orphan as defined in the U.S. immigration law
    • Verify that you have obtained a valid adoption or grant of custody
    • The child does not have an illness or disability that is not described in the orphan petition
    • Determine whether the child has any special needs that were not fully addressed in your home study
    • Determine whether there are any facts showing that the child does not qualify for immigration as your adopted child

This doesnt sound like Just adopt and good to go thing. Especially that he has giving the impression of getting them to come to USA by listing their names on the petitions, there is going to be an extremely crucial scrutiny.

  6. I have no idea what you are talking about in this comment. Please clarify in a more detailed post.

I was saying in case I don't tell them their are not my biological children but tell them there was an oversight on the issue of the date of birth and used the USCIS original documents we filled at first which correctly gives their correct date of birth.

And there with reference with the NVC on the date issue we didn't send them an email, we called them.

  7. I think this is a common practice in Ghana which conflicts with how western cultures do their stuff.

Locally, you can call your siblings' children as your own because it shows that you love them like your own and you treat them as such.

Since this is a norm, we erroneously make such claims when it comes to dealing with US immigration.

People have called gf/bf as wife/husband.. Wives call their husband's brothers "husband". example junior husband or senior husband but sisters of husbands are called rightly as sisters-in-law.

    That's just a little education.

So, even though it might seem like a big lie with regards to calling those kids as your own, it isn't , from our cultural point of view.

You will have to adopt them legally to be able to bring them to the US. So when you go to see a lawyer about responding to the NOIR, try and explain this cultural aspect so that he/she can effectively help you respond to that part.

    Good luck to you!

How long did it take for you to get the NOIR since the interview?

Thanks bro. It took USCIS 12 month to send us the NOIR.

  8. I need help, I have received my NOIR and the embassy is lying with some of the issues and I need help.

THIS IS WHAT THEY ARE SAYING

    1. The beneficiary could not describe in detail the petitions life in U.S. He could not state what she does for work and could not name her supervisor

    2. The beneficiary also could not name any of the petitioner' close friends or describe or what she does in her leisure time.

3.The beneficiary states that he has two children. Both of his children were born in Ghana. The children were born to two different women seven months apart in September of 2013 and April of 2014. Subsequent to the beneficiary's marriage to the petition.

These are the 3 question uscis is asking.

With regards to the interview I gave only one place she goes for shopping because I could hardly remember over there, and with regards to her best friend, I mentioned 1 name. On her job I gave her 5 types of work she does.

The children dates are 2012 and 2013 restive not 2014. These children are my relatives kids I have adopted them not through any legal documentation or means and I told them their my own kids but we did not file for them only mentioned their names on the documents as my kids. and I have added my names to theirs.

We called NVC that we have made mistake on the date of birth of the kids and the asked us to correct it at the embassy but they did not allowed it. After the interview the woman is angry already.

How should we answer this NOIR and they need some more prove of our relationship. Friends help

  9. Hey guys any news from USCIS with the NOIR/NOID because I'm waiting for it now. It's been a year and month now since I was refused visa at Ghana embassy and the case was returned on November 19 2015. They gave us 6 month to go through but they are now saying one year. We have written to the ombudsman yesterday for assistance since senators and congressman are not able to do anything. The are saying they will let us know withing 45 days if they can helps us. May God help us all.

  10. My wife has heen asked to wait to be called before her next interview after last week interview. This is the second time of filling for her. I want to know if she can opt for twi on her next visit when she's called since she'll feel comfortable speaking twi.

    Waiting for your help? Thanks

She should not try it at all since she has already spoken English over there, a person did the same and they did not interviewed him and ask Him to leave because she has already spoken English there before
  11. Hello my name is mamai YAA . Please I have a few questions and i would appricate any respond I can get.

I and my husband got married in Ghana last year October 2015 . And he has his intrview june 6th at the Ghana embassy . However his father just passed away and the family is planing on a funeral first week of August. So he has to stay back and finish all arrangements with the family before coming . Please my question is how long can one stay in Ghana after receiving the visa. Because I read online that after the CR1 visa we would have to change it into the R1 visa before our 2 year anniversary . So please what if he comes ending of September or a few weeks to our 2 year anniversary. Will it jeopardize the time frame that we have into getting the R1.

You don't have to do any thing, if your husband pass through the process successfully He will be given 6 months visa, before it expires...just prepare for the interview well that is what import. No about things which raise red flag, and stay away from them. Thanks. Googl and read about things which raise red flag

  12. Hi VJ family my reaffirmed case visa interview is coming up in some few days and since my case is a reaffirmed case so I want to make sure I have everything put together correctly so that the CO have no chance to return my case again..I have over 3000pages of our chat records of Facebook, whatsapp and skype, skype chat logs is Just a Four of the beginning of our relationship before marriage and whatsapp chat is just a three months after we got married but most of our chats logs are Facebook cos that's our main source of communication and a few call logs plus about 50pics of us and with my family and friends for her two trips to Ghana including wedding pics and also have with me a notarized letters from our both family and friends and Greetings cards..

So my question are Is this my evidence enough to satisfy the CO or is there something I should add to my evidence of bonafied married?

My second question is should I add western union receipt as part of the evidence or not?

Thank you all every advice is welcome..

How long did it take before your case was reaffirmed

  13. Hello everyone, thank you all for your support and prayers. My wife's cr1 visa was approved yesterday at the U.S Embassy in Ghana after 8 months of AP. My wife went for her interview on July 08, 2015 and was given 221g AP. Co said she was reviewing documents she will call after she's done but never called for over 8months. I got my congressman involved, did info pass but still didn't change anything. So I decided to go to Ghana myself. I went to the embassy at 1200 noon, we started going in at 1:00 pm. The security men said we cannot go in with bags anymore so we left them outside. The security men again told me I cannot go inside with my wife, I didn't argue or ask any questions I quietly joined the que behind my wife and went inside with her. Fortunately for us, The CO who was handling our case was at the counter at window three. She called my wife, I followed her to the window. As soon as she saw me she said oo wow so you came with her today and I said yes. She knows I'm in the military ( U.S. Navy ) so she asked where are you stationed? I answered, then she said wow so you are in the Washington DC area, I said yes.She asked my wife to excuse us so she can ask me some questions. The first thing she said is Mr. xxx we have a little problem here at this embassy that's why your case has been delayed. She said almost every DV lottery spouse from Ghana come back divorced and get married again so it makes us sense something fishy. I said wow that can be true but there are genuine cases or divorces. Co asked, when was your previous marriage? I answered. She asked when did I immigrate to the states, I answered. She asked when I join the military, I answered that too. She asked where my previous wife is and I answered. She also asked how are things going with your current wife? I said great. She asked how do you support your wife financially? I answered that too. She asked who arranged the marriage, I told her my parents did. She asked, is there any little xxx on the way? Meaning are we expecting any baby, I said that's what I'm hoping. She said well mr. xxxx we will go ahead and issue your wife's visa today you can call her back to the window. I just need an updated police and medical report because it's been a long time since the first interview. She you can bring it anytime from 1:00 pm going, Monday to Thursday. We brought it the third day, and she was like that was quick I said yes I can't wait to go back with her. She asked me when are you going back? I told her and she said come back the third day for your visa. When we left the place, my wife was like really, I never thought this lady was this nice, she never smiled when I went to the interview by myself. Thanks once again guys. But one thing Your presence counts a lot, I mean you the PETITIONER. GOOD LUCK EVERYONE.

Congrats man I went to the embassy with my wife but they said they are sending the case back and now the case is with the USCIS and we are expecting for the case to come back to Ghana.
