Will he get deported???? im just really confused. someone told me that if you dont file for aos within two years of arriving then you will get deported

I have a question. What if you are here on a K3 visa and you don't file for AOS withing the first 2 years you arrive???? or .....what happens if you file after your K3 visa expiration date????? reason im asking is my husbands AOS package was mailed back to us and we mailed it back and im not sure its going to get to USCIS before his visa expires!!!! Anyone got an answer for this??????

There is no time limit on filing for AOS, you can file at your convenience. Also, the visa expired the moment he entered the country. He will just be out of status until his green card is approved. Take a deep breath and relax, time is not running out.

I'm not sure about your question regarding choosing (A) or not, but you do need to send a copy of your approval notice if you haven't done so.

but his visa expires nov 6th. and now that they have sent back our aos they have no record that we have filed. what if we mail it back again what will they do if its not in the system by nov 6th?? wwill he be deported???

You do need a copy of the I-130 approval notice for K3s to adjust status.

Sounds silly, but have you submitted the I-485 form with the packet. Looks like they didn't get it. Also, you need to provide copies of I-94 stating his current status. If you have digital copies of your I-485 check if you filled it out correctly. You might have filled out that he is an asylum seeker.

its me again with yet another question. i know i saw this somwhere but cant find it again. Is it true that if you file for your ead along with your aos then the fees will be $1010.00???? he already has an EAD which is going to expire in 2 weeks. so when we are filing do we apply for a new ead or renew his old one. AND will there be a price difference in doing that??????

"A" based on the approved I-130 that you filed in order to file for a K-3, and attach a copy of I-130 NOA2 letter.

Im here on a k-3 visa and it is up in Nov. I'm getting ready to mail off my AOS but i just found out that i need a new medical(other one is over 2 years old). I've read and read and forgive my ignorance but I'm confused as to where i get my physical and how do i go about it. Do i have to have it when i mail off my AOS or is it like going through k-3 and they set me up with a medical. I really need someone's wisdom on this matter as I'm on a tight time crunch. Im getting ready to apply for AOS. Meanwhile my EAD is going to expire in 90 days. Do i have to go through all of the paperwork again and get a brand new EAD or can i get an extension on it somehow and if so, does anyone know what the fee is?

We need someones advice and wisdom on this subject. My husband has a K3 visa and filed for his EAD in early June. Biometrics in Aug and have heard nothing since. We got senatorial assistance and got a letter back saying that it is still within the timelines infact, it said we still have upto 30 to 60 days left. Is this right? We are going nuts waiting...can someone enlighten us on how long this usually takes?

Did you also file for AOS? Sounds like you are confusing AOS notice with EAD notice, compare case numbers.

AOS tends to get transfered to CSC for approval without notice, or it gets transfered to your local office for interview.

Your timeline lacks any details, so I cannot answer your question with any exactness.

OK. I have a question. My hubby just recieved his receipt notice last week for his application for an EAD. This Monday he received a biometric appointment letter stating his appointment for AUG 8TH. Today he just recieved another letter saying his case was transferred to California for faster processing and he would be notified of a decision made on his application. What in the world does this mean???? Can someone help me out on this one?...Thanks, Susan

Well at least they did not get the other format codes correct or it would have been an annoying light blue and in bold print looked like:

And yes you can file for EAD before AOS, it is recommended for K-3's to do it this way because K-3's will get an EAD that expires the same time as the I-94 card, If you file for EAD with or after AOS, then the EAD is a 1 year one.

You can apply for a EAD on a K-3 visa without applying for AOS. The EAD will expire when the K-3 does. EADs normally take about 90 days to process, so give it some time. USCIS are also busy right now, so it will probably take some weeks for them to send you a receipt.

IT WAS SIGNED FOR SO WE KNOW THAT IT HAS BEEN RECIEVED BUT, THE CHECK HAS NOT BEEN CASHED. THE ONLY THING THAT I CAN THINKOF IS THAT YOU MIGHT HAVE TO FILE FOR AOS AT THE SAME TIME OR FIRST. WE HAVENT FILED FOR AOS BECAUSE OF TRAVELING ISSUES BUT ARE GOING TO APPLY NEXT MONTH. CAN ANYONE HELP ME OUT WITH THIS ONE???????????................THANKS, SUSAN

Hi everybody!!!!!! My hubby is from LIVERPOOL,ENGLAND but will be coming back to TENNESSEE!!!!!

Has anyone who sent packet 3 back in October had an interview date yet? I sent my back Oct 12 and looking at Time Line histories it seems to take between 6 -8 weeks from sending it off it the interview date.

My dilemma is that I would like to fly to the USA 2nd Jan. I am going to rent my house out and I need a month I think to sort the house to look it's best for renters, pack my stuff to have it shipped, catch up with people, plan my wedding and also Xmas falls in the middle.

Therefore I need to finish work on 2nd December and I have to give a months notice, which means I need to resign this Friday.

I'm just paranoid that I resign and then my interview doesn't come through until January, which means can't leave 2nd January so I could have worked longer and saved some more money.

What does everyone think. If I take the risk and resign do you all think my interview will be before January?

Opinions greatly appreciated.

Also my Wedding is planned for Vegas 17 Jan 2007. Deposit has been put down but the date can be moved if needed. A lot of my family and friends have surprised me by saying that they would like to attend. I've told everyone not to book anything until I know when my interview date is. Do you think once I know when it is, it would be safe for them to book their flights?

I know it all depends on me passing the interview, but I really can't see any reason why I won't. Had my Medical yesterday which was fine - At the new Medical place on Bentinck Street. First day they opened. Also just to let everyone going through London know. The blood it tested for HIV and Syphilis only. Nothing else at all is tested for.

Drugs, other diseases etc they just rely on you being honest on the questionnaire as they can't ask for your Doctors records either. Very chatty Doctor I had. I'm not sure he should have told me all of that but might make some of you feel better about the Medical.
