  1. Hi ! I just want to ask .. its about signature .. iam married now to my fiance .. doing my AOS papers then i notice im still using my SIGNATURE when i was single.. and i remember my husband put me in his bank that is now joint account i also use my signature when i was single .. i also use it to sign my SSN card .. Anyone knows if its ok if i change my SIGNATURE now to married one when filing AOS and if it wont be a problem if i do so ??? 

     

    our bank account i know it can be change to my new signature if ever by just signing a new signature card right ????

  3. My fiancee lacks self-confidence and wants to bring a friend or her ate with her to St Lukes. It is my understanding that a fiance cannot go with the woman to St Lukes. I don't know if that is correct, but that's my understanding. The question is, can a friend or relative go with her for support?

    YES !! me and my daughter go there for iur medical last year and my sister is with us.. its allowed to enter as long as accompanied by beneficiary.

    Re file and answer truthfully every question.

    Though it has been over 2 years ago I would still include a multiple filing waiver request which is just a simple statement, as some IO's

    RFE for not having a waiver request.

    If you had an I-129F petition approved less than 2 years ago AND this is your 2nd I-129F petition; OR this is your 3rd (or more) I-129F petition, you are required to submit a request for a waiver of the multiple filing limitations.

    Explain what happened with your previous petition, and include evidence to support it. You say the first visa was denied, then include as evidence the denial notice which states the reason you were denied.

    With all that you shouldn't need an attorney. Get your petitioner registered here to make sure he will have a complete package

    the next time. Even an attorney can delay you. Every petitioner as well as their beneficiary should do research on this 'do it yourself' site.

    Refile and be sure to correctly answer all questions on all forms. If it asks anywhere if you ever filed a petition for anyone, then you answer yes and fill in that info. It should have been done that way the first time around.

    If the old petition never led to a visa being issued, then have the USC go ahead and send a withdrawal letter to the USCIS asking that the old petition be withdrawn. He can include a copy of that letter with his new I-129F submission too.

  5. I am getting confused with who is the petitioner and who is the beneficiary because you posted " his old petition to her ex fiance".

    Who had the previous case ? The USC petitioner petitioning someone else 8 years ago or the beneficiary who had another USC petition him/her before ?

    What stage did the previous case reach ? Was it approved at USCIS and then forwarded to the embassy ? Was it withdrawn ?

    Need more details.

    Oh yeah my mistake. I mean his old petition to his ex fiance. He got prior petition to his ex fiance from germany .. he didnt withdraw it because he thought its too old its been 8 yrs since he files that .. his friend told him that the petition to be withdraw is only 2 yrs old

  6. How do you know that the reason for denial was a failure to mention a previous petition filed 8 years ago? Usually the term is within the past two years they're concerned with. This is just a standard K-1 denial letter that is mailed to everyone denied a K-1 visa. Did the CO specifically tell you the reason for denial at the interview?

    Yeah the CO says he cant issue me a visa because of the previous petition ..

  7. Hi Guys i need some advise .. we filed K1 visa last May 2015 ang get interviewed last October 2015 but denied because my fiance failed to disclose his old petition to her ex fiance 8 yrs ago .. USCIS send us termination letter and they say we can refile. now we want to refile and my fiance want to get a lawyer .. the lawyer cost alot and i think we cant afford it .. he is doing his best to get me and my daughter even though i know its hard because we already spend alot of money when we first filed K1 visa .. i want to tell him not to get a lawyer so we can save money .. is it really complicated result so we need to get a lawyer ??? i hope anyone can advise me and i want to understand and to know what to do :( all i want is to be with him i already miss him a lot .. i attached the termination letter we get from USCIS ...

    now my question is do we really need to get a lawyer ??? or we can do it by ourselves ???

  8. School ends this march .. why not he cant come with ur fiance ??? And if he not coming with ur fiance why u need to process a visa for him ??? The child of a beneficiary is allowed only within 1 year after approval of ur fiance ..

    This is what my fiance and I decision .. just want to share . I will have a K1 visa too and i will bring my daughter with me once were approved .. we decide to bring her with us then she have time to adjust in america .. we will get her a tutor to adjust in her study before she start there .. i want her to learn more english too so its not going to be hard for her when she start school and communicate to other people ..

    I have to fill out one form for me (the petitioner) and another for my fiance (beneficiary).

    On my form do I write his Alien number? or leave it blank?

    I must say YES .. i ask question too about A Number .. i asked them if i need to put the A number they give me when we process K1 Visa but got denied .. so now we need to refile .. and they say YES bcos its like ID number of a person ..

My fiancee filed K1 visa petition and we get denied because he failed to withdraw his prior petition to his ex fiancee .. so i attached the termination letter we get from USCIS and they tell us that we may choose to refile. So my fiancee will refile and we will withdraw his old petition to his ex fiancee .. so my question is .. does he need to withdraw also the denied K1 visa petition for me ?

  11. You do not need to, as in it isn't a must do or die type of situation. If they gave you an A# already in the past, then you can list it. If you leave it blank, you should also be fine. Your choice, though not sure why you wouldn't just list it if you have one.

    Oh im sorry .. its just make me think if i should put it or not because i didnt know if they will give me new A Number bcos we get terminated in the previous one ..

  12. Hi i just want to ask about A number but first heres the situation ..

    My fiance filed k1 visa but get terminated .. our papers was returned to USCIS bcos my fiance didnt withdraw his old petition for his ex 8 yrs ago. . We wait for the responce to it .. and we received the letter last week .. uscis say the petitioner may choose to file new 129f petition .. so my question is do i need to put the A number they give me in the terminated petition in the new 129f we will file????

  13. The Embassy definitely denied the visa. They are going to send the petition back to the USCIS. The USCIS may let the petition expire, or they may send your fiancé a NOIR.

  14. He can include as much information as he has available, such as her name and address, or at least the town she lived in. Include dates if possible. He can say that he doesn't know her A number. That should be sufficient because the USCIS should have a record of it...if they bother to look.

    Oh yes i read that too .. we will just edit it .. my fiance got question .. how can he get the details of his previous petition for hks ex girlfriend ??? He already forget the details because its a long time ago .. like a-number and when he filed ..

  16. Yes, your reason for withdrawal is very simple and straightforward.

  17. I wish the USCIS had noticed the issue when they were adjudicating the petition, but they did not. Now, the petition will be returned to the USCIS. At that point, we really don't know what the USCIS will do.

    The USCIS may sit on the petition and allow it to expire. Then you would have to start over. You would need to send a new I-129F packet including the withdrawals and a waiver letter.

    On the other hand, they may issue the petitioner a NOIR. If they issue a NOIR, I don't know how long it will take for them to process everything. It could take a long time, with no assurance of a successful outcome.

    Will the USCIS simply email the petitioner and request a withdrawal? I doubt it. Even if they did, that process may take a long time.

    I still think the quickest path is to start over right now.

    if we file again and he withdraw the 2 petition do u think they wont questioned it anymore ??? 1 of his petition that he withdraw is my name too .. if we file and they see he withdraw it and we just file again it wont be a cobflict anymore ???

Hi I just want to share our experience.. before our petition went to the NVC, the USCIS made a background check and they found out that my husband sponsored a fiancé visa in 2010 so they emailed him and ask for a letter (just a simple letter) stating that he already stopped the petition with a the name of his ex. You are not denied just give them such letter for formality that your fiancé stopped the sponsorship in 2007.

    Hi thank u for sharing :) Ours was transfered to nvc then to embassy .. on the day of our interview the CO tells me that they cant issue a visa bcoa of this issue .. and it will be return to uscis for reconsideration and disposition ..
