Hello,
My wife and I are currently awaiting our adjustment of status from our K1Visa / Immigration. My wife is from Canada and immigrated to the United states to live with me. We recently received a document for a Request for evidence.
The request for evidence states:
"The Petitioner (underlined in red)/sponsor on form I-864, Avffidavit of Support, Must submit a complete federal income tax return (underlined in red) submitted to the internal revenue service (IRS) for the most recent tax year. (the year "2014" is written in red.)
If you were not required to file a Federal income tax return under U.S. tax law, attach a written explanation of why you are not required to file. (underlined in red)
I am a little mixed up on the wording here. Are they asking for her tax information since she is petitioning for adjustment of status, or do they mean me when they say petitioner since I am the one submitting the affidavit of support?
I submitted my tax returns for 2012-2015. Are they asking for my wife's tax returns? In this case she was a Canadian citizen in 2014. She filed taxes in Canada, but not in the US. Do I just need to write up a document saying one is not needed, do we need to get her translated french canadian tax returns for 2014 sent over, or do I just need to send them a document explaining she did not submit taxes to the USA.
Thanks in advance for any advice. Sometimes I get tripped up on the wording on this stuff.

We had our K-1 Visa Interview on and were approved October 2nd. Our status on CEAC changed from ready to issued on October 6th. We got an email from Loomis a couple of hours ago giving us a waybill number, then about an hour later another email saying the visa is ready for pick up (October 8th). So in total 5 business days not counting the weekend.

Our CEAC status just changed to issued as well as of the 6th. I've read it can take three days to get to loomis once being issued, so we are hoping we will recieve our waybill from Loomis by tomorrow.
For anyone wondering about processing times;

hey, I had a interview at 29,Sep too. My status was AP after interview then it has been changed as Issued yesterday. I just got email from Loomis that I can pick up my visa after couple of days. Don't worry too much. your status will change soon:)

Please how many days did it take you to get interview letter after your case was completed? My case was completed on 21 September, but no interview letter yet. I am on F2B.

Did you get a confirmation email after scheduling your interview?
When preparing for the interview we did see a reference to an interview letter, but never received one either. Instead we brought a printed out copy of our confirmation page with us to the interview and a copy of our DS160. The DS160 was needed when we lined up outside the consulate building before we got in, and the copy of our appointment confirmation was only asked for to prove we payed for the interview already.

You may have been going through the process TOO carefully. Montreal stinks at sending things via paper, most things are done via email now. You're actually a couple of months behind where you should be at the moment. I'm curious as to what requirements showed up that bounced ya'll back a couple of months. All the requirements are fairly simple and across most of the board for all consulates. The only thing that Montreal is stricter on is proving US domicille for the petitioner.

You're suppose to send packet 3 via email, according to your time line you should have been able to send Packet 3 in late June/Early July as that's when they should have had your case up in montreal.
Packet 3 looks like this. http://photos.state.gov/libraries/canada/303578/montreal/Packet3-K1-MTL.pdfYou e-mail them at the address provided with the DS-160, Passport page, and checklist.
After packet 3 is emailed to them, THEY will email you back with an email. -THAT- e-mail is packet 4. The email back should take anywhere from 4 hours to 48 hours. The packet 4 pdf does NOT get mailed to you, it's simply there for info purposes. The email that you are suppose to get after emailing them packet 3 is what you take to both your medical AND your interview.
Yes you schedule your medical AFTER you schedule your interview because when you schedule your medical they will confirm your interview date. They will not schedule medical without having an interview date.
There aren't currently any interview appointments in MTL for September. You'll have to wait until Oct/Nov opens up. Since it will be past your time for your NOA2's expiration date, the canadian fiance will have to send a letter petitioning for an extension on the case. I'm not sure how to do it as we were able to schedule ours before our date, but I'm sure you can find a sample letter through searching VJ.
Just as a note, Montreal is NOTORIOUS for not sending anything via paper. We were lucky enough to get a paper packet 3 and it only took a week and a half from when Montreal recieved our case to get it. We had actually already completed and emailed our packet 3, and finished the packet 4 process before we got our paper snail mail.
As for the medicine, I believe the prescription from your doctors is enough.
Good luck on your journey! And remember, if it feels like it's taking too long, inquire inquire inquire! Post-NOA2 phase is the fastest in terms of getting things scheduled. All it is is paperwork, scheduling, and sitting back and waiting.

Our timeline still needs to be updated. We already have recieved the email you are referencing but were confused, since we knew from researching there is an actual Packet 4 PDF for montreal out there, and it states not to scheduel anything before recieving it. (http://photos.state.gov/libraries/canada/303578/montreal/Packet4-MTL.pdf). We filed our forms as quickly as we could and followed the instructions. We did not recieve Packet 3 until Late July, and we needed time to gather documents (for the affadavidt) and to ship them to her before sending the email for packet 3.
We just went to: https://ais.usvisa-info.com/en-caTo scheduel our interview. We payed the Fee using my credit card. There are no dates available according to the callendar to select from. You stated that there aren't any apointments available for september so this isn't a surprise to me. How is it you knew there were no appointments for september? It appears the rest of the callendar is greyed out as well...
That's a huge dissapointment that our form is going to expire. We will get on sending this letter from the VJ example forms ASAP. Has any had any expierences with an expired form and requesting an extensions? I'm really worried this will prevent us from being approved after all this time.

My Fiance and have just filled our paperwork from the DS-160. Our interview will be held in the US Embassy in Montreal Canada. The automated response and links (some broken links) left us more confused than we were and I was hoping someone could help with a couple of general questions we have at this stage in the process:
- The Interview, and medical Exam - My understanding from reading the Medical exam PDF is we need to scheduel the Medical Exam - AFTER- schedueling the visa interview. Is this correct?
- We are seeing conflicting information bout when we are able to begin schedueling our exam/interview. When we check our case infromation on https://ceac.state.gov, it states we are able to scheduel our interview now, but the dates on this status preceeds us even recieving packet 3. Should we start schedueling now, or do we wait for a packet 4 via snailmail with confirmation before proceeding? We got an auto reply after sending the DS160 out, but it doesnt state it's packet 4 despite containing some of the information from packet 4.
- We have been going through the process as quickly and careful as possible, but keep disocvering more and more requirements and it's slowing us down a bit. My I-797, Notice of actions tates that the ntoice is only valid from 5/27/15 to 9/26/15. This is approaching quickly, and we feel like we are racing agaisnt the clock. Do i need to go about extending the validity of this document? How do we go about doing this if so?
- Has anyone had to provide information about medications to the medical exam before? What level of details is needed. Is perscription from your Dr.'s office enough?

I agree. Personal social media is not a soapbox or open forum IMO.
They also want to make videos... Videos have your faces in them, USCIS have pictures of you and can easily find out who you are if they want to. Even if I were at the TSC there's no way I would put my face in a video speaking against USCIS when the fate of my relationship is basically in their hands right now.

I love this site. Someone poses an idea and then gets pounced on. I really thought the point of this site was to be supportive to each other as we go through this road together. But, again I guess I was wrong. For example, when I first registered on this site after I sent off my i129f, I had a simple question which was related to wait times for nOA2 if both my fiance and I had no children, criminal records, etc. I had no clue about the process at that point, and immediately i received responses like, "it will have no effect", or "just get in line with rest of us", or "prepare for 11 months and be happy with 6." I was not trying to cut in front of anyone, just asking what to expect. That's why I rarely post anything because I may get flamed like the OP is. Geez.
You should have a clue about the process BEFORE you send in forms, then you can avoid asking questions with obvious answers. Immigration is a big life-changing deal, anyone looking to immigrate needs to do their research, there's no real excuse not to do it when this site exists. People not doing their research before they send in incomplete forms make the whole process slower for everyone else, that can be frustrating to a lot of people.
Blowing up Twitter sounds like a good way to make USCIS hate you. I don't think it's worth the risk.

I never had a father. He was violent and left before I was old enough to remember him and my mother and I are very close and the best of friends. We talk every day and never fight, she's been with me through everything since I was a child. She raised me by herself and supported me through anything, she has always put my needs before hers and has always given me everything she had and tried her very best as a single parent. I've never felt like I've missed out on having a father but my relationship with her makes it so difficult to leave, especially now that she's getting older and has a lot of health issues. I would have wanted to be the one to help her as she has helped me, give back all the time she gave me. She doesn't really have anyone else who can take care of her and I feel like I'm straight up betraying her and abandoning her after everything she's done for me.
Of course my choice is already made, the papers are sent and the fees are paid, our papers are at the California Service Center so I know things will most likely go fast from here. I've been with my fiancé for over 5 years now and we're both so happy that after all this time we finally have a chance to close the distance.
I wouldn't go back on my decision but I also don't know how to handle it at all. I feel like there's nothing my fiancé or anyone can say that would make me feel better about leaving, I've been seeing a psychologist but all she says is "you can just call her and visit once in a while".
Have you guys had to leave people you love? How did you manage to be happy about moving with all the sacrifices? How do you just kick yourself in the butt and move on?

Question on Request for Evidence
in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas

We didn't submit an I-130 we submitted an I-485 Adjustment of status. For this particular form she was the one submitting.
I am the one who filed the affidavit of support which is the document in question, and in that document itself it refers to me as the sponsor.
This is why I'm confused in the wording. In the context of the AOS I think I may actually be the sponsor, but her sending her tax information doesn't make much sense to me.
