    I searched Google and the VJ forum but everything recent is about the 3 year rule for N-400 “Additional evidence you may want to provide” section. My wife and I have been married for 7 years in two weeks and she is now applying for her citizenship. We are doing it under the 5 year rule as it seems less is required and it was suggested to do so on a recent post in a different thread.

     

    The question is: what, if any, evidence should be put in this section with the 5 year rule in mind?

     

    Our two kids birth certificates are already uploaded, marriage certificate is uploaded, all other required documents. Is there anything else that may assist her with good standing or expedition or anything? Example: I served in the army for the last 10 years. Does my honorable discharge paperwork look good for her application? Proof of her working and going to school to show she is a productive member of society? Or am I overthinking this and there is nothing else really needed since it is not the 3 year rule?

  2. I just received an RFE today for not providing my latest tax return & the applicant's foreign birth certificate. I already sent those to them in the packet I submit; obviously if they say they did not I just send another. However, the foreign birth certificate was the original one from Guyana, with the stamp/seal, so we do not have another original. We have a few other ones that are also stamped, but they are recent ones so will that matter?

    Next issue: I received various forms of confirmation from here and officials that my "Non-Earned Income" is able to be factored into my income for the AOS. It is the same income that was handily approved for the K1 in the first place. All of the official documentation was provided, again, in the packet that proves my "Non-Earned Income" (Disability from injuries overseas) but the RFE says I do not meet the income requirements. My taxable income does not meet the standard (full time student in the National Guard) however, I have substantially more than enough in assets to meet the line just from that, that was also provided. I added a letter explaining all of this in addition to everything else. How do I prove my assets? They are not bonds, ect; I have a collection of antique and new rifles, pistols, suppressors, ect; I also have a camaro that I have put a substantial amount of money into, in addition to my jeep making the camaro an asset because I have the jeep as a primary mode of transportation.

    I provided all of my pay stubs (LES) from the military for the entire year, as well as my W2 and 3 years worth of tax returns.

    Are they simply not counting anything but my taxable income? Does income work different for the AOS than it does for the initial K1?

    I am very worried about my wife's ability to stay here if they are only counting my taxable income because it is not enough.

  3. Just to clarify: even if you applied for & received her SSN before the 90 days were up, she would not have been allowed to work anyway. (Until she receives her EAD, that is.)

    Oh ok so that doesn't sound all that bad anyway! I did not realize that, so that brings up my spirits a bit.

    You never know with this system, I just got AOS approved after 6 weeks, no interview, I thought it would take 6-12 months :dancing:

    Wow that would be awesome! I am hoping it does not take too long as there is a job already lined up for her waiting for her EAD

  4. You will have to wait until she gets her EAD. She can't work until she gets her EAD anyway, so it's no time lost. You did apply for it, yes?

    Yes we applied for that with the AOS paperwork; but to my understanding of the social security website, K1's are under the "Visa Classifications That Allow You To Work In The United States"

  5. My fiance and I were married on Feb 14th 2016; we immediately sent in the paperwork for the AOS; her K1 Visa in the passport says that it expires Feb 22nd 2016. I remember reading somewhere, a while ago, that we should wait to have her get her social security card/number for the system to recognize her as Mrs. X instead of Ms. Y.

    We waited until last week to attempt to get her the SSC, brought all of her documentation and the marriage certificate and the letters from INS saying the AOS is in the works, and after the hour+ wait we were called up and the gentleman told us she cannot get a SSC because the K1 date (Feb 22) has passed. He said now we have to wait until she gets her Green Card.

    Is this correct? If not, what can we do to resolve this so she can begin working? I told the gentleman that even their own site says she can get one and he said no not until she gets the GC.

  6. My mom is a Justice of the Peace in Connecticut, and I have gotten married in CT. You need to obtain a marriage license. This is NOT done at the county courthouses in Connecticut. The issuance of the license is done by the town clerk of each town or city, and you MUST obtain it in the town in which you plan to be married. Are you in Southington? Here's the place for more info: http://www.southington.org/content/17216/17534/17706.aspx When I received my license, I had it the same day I applied. There is no waiting period in Connecticut -- you can get married the same day.

    Justice of the Peace information is available from the town clerk for the town you wish to be married in. If you want to be married religiously, that's something to sort out with your church. Your pastor should help you out with filing the paperwork after the ceremony.

    I stress again: the county courthouses have nothing to do with marriage licenses or certificates in Connecticut. I know people are trying to be helpful but like a lot of New England things, we deal with stuff a little differently. :)

    I second this. I got married on K1 in CT in February of this year. Went to the town I was getting married in, filled out the paper work, paid $20 (varies depending on town) and got the license. I had a larger more traditional wedding however, but you can do it same day if you have someone to marry you. As soon as the justice turns it it, it can be copied and given to you for keeps. Theoretically, could be an hour total (if the stars aligned)

    I have my fiance here on a K1 visa, and we would like to get some of her family members here for the wedding from Guyana. not permanently of course, but just for the wedding. I am fairly certain I need the B-2 Visa (correct me if I am wrong). But my worry comes with the timing. We have 90 days to get married which ends at the very end of February, to which we are having our wedding mid-Feb. Will we be able to get the interview at the embassy for them in time? Possibility of expediting it? I fear the timeline of the process because ours took so long. Any help in this matter would be appreciated!

  8. Ok thank you for replying again, I know that I've asked before and you've answered. I just got a little more worried since it's so close. So only counting my GI Bill stipend (BAH) and disability and military pay, I come in above the 125% line. I should be fine then with that, plus all the extras to add in, but at least there is the guaranteed amount. I do appreciate the help!

  9. We finally have our interview for November 18th at the Georgetown, Guyana embassy. I am still worrying about my I-134 form. Most of my income is non-taxable so my tax return reflects that I only make about $7,XXX/year when I actually make $32-33,XXX/year. My income is from using my Post 9/11 GI Bill, disability from injuries over seas, and state benefits (tuition waiver and financial aid that comes directly to me) for the military. I wrote a one page explanation for the CO that reads it, and I will also be at the interview with my fiance. I have all the proof and documentation from the school and the VA to show this is all legit income.

    I also have over $18,XXX in my account and $85,5XX in assets, and $650,XXX in life insurance.

    With all of this, should I still be worrying about how the CO will see my ability to support my fiance?

  10. Where my fiance lives in Guyana, the only food around is sold at a bazar style street where once a week everything is laid out on rugs. I have been trying to explain to her places like Stop&Shop and Walmart but she can't grasp the idea that these places can exist. So that will be one stop. Already been said but take her shooting. She has never felt temps below about 60 degrees so that will be interesting (Connecticut) and take her to the mall to show her the giant clothing stores (JCP, Macy's). And last but not least, the bank. She has to wait hours upon hours to get any money from the bank since everyone in town gets paid on the same day. She honestly might be most excited about not having to wait in line, and being able to just use a card here ;) besides seeing me of course.

    I will have the pleasure of flying back with her which will be her first time on a plane.

  11. Texas takes the longest, but I would call again and find out what the deal is. I went through Texas and sent my 129f in mid Feb. They received Feb 19 and sent the NOA1 Feb 24. was 6 more months for NOA2, but you should've gotten your NOA1 a while ago. To my knowledge, they wouldn't have any reason to deny this early in the process because the NOA1 is just to notify you that they received your packet. When you call, ask for the receipt number. That way you can track it online

I have a similar situation (along with another on here I've been in contact with going to the Guyana embassy as well) where I have my confirmation number and I check twice daily the status via [ https://ceac.state.gov/ceacstattracker/status.aspx ] and it still says "In Transit." My packet/info/ect was mailed from NVC to the Guyana embassy on 10SEP2015. It's been 12 business days and I emailed the embassy on the issue. Their reply (today) was "We are not yet in receipt of the case file. Notification will be sent to the beneficiary as soon as it is received." The was the entire message.

    I know this doesn't answer your question(s), but I shared to let you know that you're not alone in wondering why many here have 5/6 days for mail transfer, while we have been waiting weeks and weeks.

    I just got off the phone with NVC and they said that my K1 Visa application was sent to the Georgetown, Guyana embassy yesterday (10SEP2015). The gentleman on the phone tried to be helpful, but did not have all the answers to my questions. I know there is something that needs to be applied to online and paid for online as well...? I do not remember exactly what it was as I was looking up all of this so long ago.

    Also, all of the papers that I have filled out (I-134, DS-156,156k,157,230, ect), where do I send them? I have already sent a copy of everything requested by the Guyana embassy to my fiance, and I have the originals, but I do not know where to send them.

    Maybe I am over anticipating things but I just want to have everything 100% set so I can finally see my fiance again after this long process. Will all of this be in the packet that is supposed to be sent to me/her? And when do I receive this packet (typically)?

  14. When I declare my income for the I-134 form for the K1 Visa, I believe I will run into problems. I know I need to include W2's/Tax Returns/ect for the past 3 years; but the problem is that 2012-13 I was deployed so all the money I made was nontaxable income (making it appear as if I had made almost nothing for the whole year). Now I am National Guard and that W2 alone doesn't cover the 125% poverty, and I am, and have been since I came home, a full time student, leaving me with no "Job Letter."

    My GI Bill, school grants, BHA, National Guard checks and Disability (from deployment injuries) make up my income to which I have an ample amount to live off of. None of these except the NG checks can be taxed making the others unable to be claimed as income; and so because of all of this I appear to not be able to even support myself let alone my fiance.

    Is this going to essentially require me to have a Joint Sponsor?

    Also, if it matters much, I have quite a bit in savings (I don't know if there is an amount that clears me of this trouble of lack of income), a substantial amount more in assets, and even more in life insurance (I only add that here because of the slot it has on the form).
