If I just walked in is it possible to get my wife here any faster?
Nope, the embassy won't even know what you are talking about as your case hasn't even made it to State Department yet. Even after your paperwork makes it to the National Visa Center until the embassy has the paperwork entered into it's local database which requires them to have the paperwork onsite they still can't do anything.
The National Visa Center sent my paperwork to Kiev on Sept 8 according to them and as of today the file still isn't in their database, I will be following up with the NVC today to ensure the paperwork was sent etc.
Be patient, I doubt your case will take the 1 year 3 months that mine has so far. (and who knows how much longer after that.)
-
As other's have stated there isn't an expedite for your type of visa like other I-129s. Keep hangin in there I waited over 365 days for NOA-2 and I was pre-IMBRA with no RFEs once they actually looked at the paperwork it was less than 30 days for a decision.
-
Remember that touches don't mean very much and a lack of them mean even less. After all you get a touch when you change your own password. The important thing is if you are within parameters from the last USCIS response you recieved (ie they told you it would take 60 days to process your RFE)
I know you're all impatient but look at it this way, you didn't spend 13 months waiting for an approval.
-
Most government agencies will have a knee jerk reaction at this that will not help your cases. Removing the ability to get information from the service center directly was a reaction to complaints about not being informed. Moving 129Fs from Texas and Nebraska to California was a reaction and if we keep going down this path the lucky few in Vermont will also end up in California where staffing levels won't change and the increased workload will make it rotten for everyone.
I waited over a year for NOA-2 due to USCIS incompetence but I don't think this way of impacting change will have a positive effect.
-
If they say they responded that means a response letter is on it's way to you. Now it could simply be a letter saying they don't respond to letters (I recieved that from CSC once.)
They give the USPS 30 days to deliver the response letter to you before they want to have you call them back.
-
This time last year it took CSC 5 months to even look at new applications and that was without the IMBRA stuff. Touches mean very little, after all changing your password will generate a touch.
-
Anytime you call the National Customer Service Center you get this type of response. Don't worry about your mail, it usually takes 1-2 weeks before they actually mail the response anyway.

Ok to get everyone's attention I waited for 13 months for an NOA-2 so I probably have more room to vent than anyone else here.
Here are some realities:
1. A large part of the problem is that USCIS is understaffed. You can't have expect anyone to meet a deadline when you don't have the resources to meet it. Anyone here want to pay more taxes or much higher fees (which is why there is a business priority.
2. How do you designate a "priority" K- over a non-priority one? About the only reason I can think of is if there is a pregnancy involved.
3. If they had to continually update status for everyone being processed then things will slow down as resources will spend more time filing reports than processing. The limited resource issue is why they stopped responding to emails, instead you get 1 more person out there processing files rather than answering our questions.
4. The 5 monthers need to understand that the USCIS can take 120 months before they even look at your petition. This time last year without IMBRA the USCIS fell to over 5 months before looking at petitions, so you 5 monthers wouldn't even have a "touch".
5. Quit thinking touches mean anything. If you want to see a "touch" all you need to do is change your password as it generates a touch.
As to accountability, understand that you are dealing with humans who interept things differently. So you will get different answers from different people even if they are "official" answers to congresscritters.
I do feel that if your visa is outside the normal timeframe that you should have priority access to information and resources to resolve your case. For me had this been available it probably wouldn't have taken the amount of time.
-
The USCIS won't expedite cases just becase they make a mistake. I'd really like them to create a group that does this for mistakes or applications that are well overdue (like 6 months or more).
-
Thanks for the congrats everyone, we spent some time on the phone yesterday talking some. It was a long frustrating road, primarily for the reasons we all know and love. Hoefully things get speedy through the NVC and on to the embassy.
Since someone asked, she's from Chernovtsy in the sw part of Ukraine near Romania.

CSC NOA-2er, however if you look at my timeline it was a bit unusual, after finally speaking to someone in my congressman's office (coincidentally the day of the approval).
-
Well this is going to make my next visit to her in September that much better. After 404 days (that's not a typo) we are finally approved.
My application was sent by CSC to VSC by mistake once and finally we are moving on.
I still think it's close to a record though.
-
Hey, CSC is truely random and crazy. After forwarding my paperwork to Vermont for some reason I was put back in queue with those of an NOA-1 over 6 months after mine.
I'm at 13 months with no RFE for anything. Last I heard they're finally processing.

Sorry my SO is from Ukraine. We applied for a 129F in July 2005. While waiting for the visa to be processed we've gone to several countries that are convient to Ukrainians (ie visa is $15 at the airport)
Now we're looking to try to travel to Spain where the visa requirements are more strict. She/I are curious as to the effects of a denial hurting our 129F.
Denial of a visa to a country that is not the US will not have any effect on your US based petition.
thanks

Giving the fact that it looks like we're going to have a few more lovely months before getting the visa, I decided to plan a trip for us to Spain. Of course she'll need a visa and we are worried about the effects of a visa denial from Spain effect our K-1 from the US.
I don't think it matters but I thought I'd check here first.
thx

Bill, it's not uncommon for people submitting to the CSC to go the first 4 months without anything being done. Especially those filing in the middle of summer/ early fall because there is a large volume during that time.
As to email, generally sending an email does not change anything or ensure your file is looked at. In some cases you will get some useful information since the person who responds has access to the real computer system, not the one used by the slugheads at the national customer diservice center.
Finally, from my and other's experience the last service center with email appeared to stop reading them and respond with a generic letter requesting to call the national customer diservice center as of the first of August so I'm afraid you're out of luck anyway.
-
Welcome to the USCIS, the agency of nothing. Check my timeline. They forwarded my application to a different service center, then sent it back and did the 60 day wait before I could contact them again.
Multiple congresscritters doesn't do much except confuse the USCIS. The same will be true of refiling plus you'll have to wait until the sort out most of the RFEs before they start processing new applications.

When did you send the email?
I sent an email on Sunday and recieved that response. As I have been using the email address in the past I think they changed their procedure for responding to emails as of Monday (the first of the month so it's logical) since someone else here posted they recieved a response to their email they sent on Friday.
The email you got about responding to your request for information is because you're subscribed to the online alert process, the email about the CSC not responding would normall have been a real response.
-
That is the email address I used and have been using for the last 5 months. In the past the responses while limited were light years better than that I would get from the 800 number.
In june I recieved a response stating that my application was being processed and to wait 30 days. Which is better than the last one which stated the application was being requested for processing. Which of course was better than the 800 number who had no information.
This time I sent an email on Sunday with the reciept number, NOA-1 and a simple statement saying it had been 30 days since my last email.
The response I got was copied and pasted into my first thread. I also checked my online status today and it shows that I recieved a response as of today.
So it's possible that they changed the procedure effective Monday (first day of August so it makes sense).
hehe opps here is the USCIS Number you will be run through a computer warning you.... 1800-375-5283
help you out here for english press 1 then next option fiance visa will be number 2 then 6 then 1 for you have recepit number and then 1 again really easy just remember 1 2 6 1 1
If that does not help there is live assistance available but takes a while to get...also the www.uscis.gov you can go there and look at your case online... By clicking on online case and typing your USCIS Recipt number
then you can also do an email thing where they tell you what is going on good luck in everything I hope this information will help you out
Caagirl you might note that number was actually included in the email I reply I recieved from them. I have used this number in the past which is why I refer to it as the national diservice center. In the 10 times I've called them they never have any useful information available they file a request which meant I would recieve a reply in about 2 weeks on average. That reply contained less information that I would normally recieve in an email exchange from CSC. I dread making those phone calls as it's often hard to remember to be nice considering the lunacy in place with this system.
iceyspots ss we are not MOC we qualify as general public even though we are customers.

Steven and Jinky, the answers I've been getting is that until they start processing the form they won't send an RFE. For those who were approved and had to come back they've been processed.
Keep up with the processing dates on the website but I wouldn't expect any real news for up to 120 days or so.
-
Did you recieve an NOA-1? If not they probably lost your application.
They did away with the service centers answering the phones with the creation of the national diservice center.
-
It wouldn't surprise me, once the RFE is sent you are essentially taken out of the queue until they recieve the RFE and then you get inserted back in. Count yourself lucky you've recieved an RFE at this point, I'm now over a year out and have nothing from them yet.

We went through JFK because it was the cheapest route. We did not ask for or recieve an EAD. After clearing customs and immigration we had about 30 minute before our flight out of the 1hr 30 min scheduled layover. Part of this was because Delta was late.
She didn't plan on working so having an EAD wasn't important. We later got her SSN without a problem.
