  1. I apologize for reviving the dead (this post) but I have a very similar situation. Son (he’s 10) and I came here on a k-1 visa in 2015. Went through the entire process to citizenship with my husband and I just had my oath two weeks ago! We went today to get passports and they made me fill out a DS-5525 for my son. The birth father lives in the Philippines, but I haven’t been in contact with him since 2012 and don’t know his exact whereabouts. I have no contact with him. We were never married but he’s on my son’s BC. Thoughts? 

  2. Hello, I am a US citizen by birth. My wife and step son recently received their green cards. I would like to legally adopt my step son (he’s a minor). Can I adopt him as a perm resident or does he have to first be a citizen? Also to what extent do we need consent from the birth father?  He lives overseas (Philippines) and my wife/son have no contact with him.

    I wanted to share the recent happenings with my case, my daughter and I both applied for ROC and our case was received on March 29, 2018. On May 25, 2018, I received a letter stating that they were going to use the old biometrics so no biometrics appointed needed. I assumed that it meant both my daughter and me, but to my surprise, we received a biometrics appointment letter for my daughter yesterday. The appointment was scheduled for March 8th, but we are traveling out of the country a couple of days before the interview date, so I took a leap of faith and showed up to the USCIS office this morning and explained my situation, they asked me to come back after 2 pm. Long story short it worked out! My kid got her appointment a little over a week earlier. 

    Now, I can't help but wonder why it took so long for them to ask her for a biometrics appointment. (my crazy theory is that someone has looked at our case) my kid was very young when she got her first green card... all they did today was update her picture. I wonder if it is because they don't want to use the old picture for a 10-year green card because she was too young?

    Anyone has seen or heard of anything like this?? 

    Exact same (well, super similar) thing just happened to me (well, my spouse and step son).  Applied for ROC in March, May or so got the “we will use your old biometrics” mailing. Today we got a letter dated 2/15/19 stating the same thing that my son needs to get his finger prints on March 5th!

Hello, my wife and I are trying to plan a trip to her home country, but we are concerned in that on our return to the U.S. she will only have 4 months left on her passport.  We are currently awaiting removal of conditions on her (and her son’s) green card.  I am wondering if the Custom’s agents will even be concerned with her Philippines passport or if they will simply be interested in her green card and extension letter. Please advise; I hope this is the correct venue for this question.

I recently petitioned for myself and my son (he's 7) for removal of conditions on our green cards.  On my son's I-797, it says "This is to verify that you are included as a dependent in the request for removal of conditions filed by the above-named principal alien on the date indicated."  However, all 3 names on the I-797 are my son's name (the "address name is my son's, the petitioner, and beneficiary).  Is this correct or should my name be somewhere on his form?  If it means anything my receipt is WACXXXXXXX315 and his is WACXXXXXXX316; when I go to add my son's case it says that the case already exists, but only shows my case on the website.

  6. Officially it is 30 days. Has your check been cashed? Did you include G1145?

    I'd probably give it this week and then call - and be prepared to keep calling.

    My case was received the same day as yours (USPS Tracking). I received my Text/email NOA-1 on the 23rd, check cashed the 25th. No additional Info since then, i.e. No actual NOA-1 letters.

    The waiting is the worst. I am also trying to stay patient...will start calling next week if nothing happens.

    The check has not been cashed yet, no. Edit: yes, I did include the G-1145. The only thing I could think of is perhaps because I am adjusting both my wife's K-1 and her son's K-2 at the same time (plus EAD and AP for both), perhaps it is taking a bit longer. Either way, I will call them if I don't hear anything by Friday. Thanks.

  7. Thanks for the replies. Yes, I plan to get coverage for my future step-son. The issue we are having is based on open season and having a qualifying event. You only have 1 month after marraige in order to add someone to your health insurance plan. Assuming that we marry in November, we would then have to do the AOS which could take much longer than 1 month. We were hoping perhaps to find an insurance plan that would take him without having a social security number but when we called BCBS they said no.

  8. I hope you don't mind me piggybacking on your thread but I have a similar question. I'm going to get married on the 27th, fiancee is here on k-1; her son, 5 years old, is here on k-2. We applied and received her social security number. He currently does not have a social (we plan to wait until we do the AOS). I plan to add my fiancee to my health insurance plan from work as soon as we get married. Will the penalty apply for 2015 with respect to her son if we don't get him health insurance after we get married?

  9. What do these guys expect though really? That these women are marrying them for their looks and charm? Give me a break. I'm sure very few of them find their partner sexually attractive if not downright repulsive. It's an unfortunate reality. I was extremely picky when finding my mate. I spoke to dozens of women and found a girl with the same values and age range (31 and 30) as myself and couldn't be happier.
