  1. 1. The U.S. Embassy Manila accepts cosponsors on a case-to-case basis. I personally know two cases where this is true. There have been many other K-1 cases here on VJ where cosponsors were accepted at the U.S. Embassy Manila.

    2. Even though the USCIS tells you that your petition is only valid for three months, the U.S. Embassy Manila routinely revalidates the petitions for up to one year.

    3. The post above is the only K-1 case I have heard about lately where the U.S. Embassy Manila has requested an I-134. I wonder if there are more cases out there that are in the same boat.

    hi Mr. Tahoma. thank you so much for your thoughts about my dilemma.

    our interview at the USEM will commence soon enough, it is scheduled on the 12th of May.

    My mom (who's very willing to be our cosponsor though her income is not that much) already sent me her docs which includes her 2015 ITR, 2015 1099, letter of her employment and her signed i-134. now sir, the problem is that my mom's income for year 2015 is only $23,000. so basically and technically it didn't reach the poverty guidelines for a household size of 4; which my Fiance is included on that household size. my mom also has a small deposit on her bank which is only amount to $1,400 (i know it is still not enough) but she did not send me her bank statements, because she said that it will take her a week or two before the bank releases the statement. so yeah point here sir is her income is not enough.

    so i was thinking sir, if i could attach the paycheck i had before when i worked for a short period of time with my form i-134 (i worked for about 3weeks when i was in the US for 6mos last year sir, but it did not last long because my client went back to her home state which is in texas.) i have the copy of the check which amount to $2,675.00. i am planning to attach it sir, just to show them i am capable of working and earning. i also have a bank account in the US, however before i traveled back here in the Philippines i withdrew most of what i have deposited and only left $25 just to keep the account alive and open until i get back in the US. I am also planning to show them the certificate that i have open and account with wells fargo. would that be okay? (at least even if it is not a good idea and even if it does not address my problem of being low in the poverty guidelines)

    i am so anxious and scared most especially that our interview is fast approaching. and i am really terrified if they'll deny us for this apparent reason sir. please do advise me of what to do more about my case.. thank you so much and i am looking forward to read your thoughts about this post of mine. thank you and God bless.

    I just want to clarify things.

    When is really the expiration date of the k-1 petition? Is it a year from the date of filing or 4 months from the date of approval?

    Please do enlighten me up.

    Because our petition got approved lasy july142015 and valid until november132015. But we were not able to pay the visa fee before nov132015. And next week we are going to pay the visa fee. But before we pay the visa fee, could we still proceed with our petition?? Thank you!

  3. Lately, the U.S. Embassy Manila has not been asking K-1ers for their I-134, income tax return, and W-2. Therefore, I would proceed with the interview.

    You may want to take with you to the interview a statement of why you were not required to file a tax return. Also, take your I-134, your mother's I-864 (even though her income doesn't qualify), and your mother's income tax return and W-2. If they ask you to submit those documents, you may be ok because they usually cut Pinoy petitioner's a lot of slack.

    One more thing is our packet was sent out at the lockbox last june2015 it got approve july2015. And it says on the noa 2 that it is valid up to nov13,2015. But we have not yet paid our visa fee. Could we still proceed with it sir?

  4. Hi there everyone. I know i have been asking this before. But here i am not trying to find some breath of fresh air.

    We had our packet sent last june 2015 we got approved almost a month after. By september that same year, i went back to the Philippines to basically process my school papers for the Nclex in the US. I was suppose to go back in the US 2 months after but decided to stay more longer here in the Philippines. So by then I and my fiancè decided to just set aside the k1 petition and would start a new chapter and was planning to get married here in the Philippines before i head back to the US. But then lately we realized that we are just putting ourselves in misery once again if we will let the k1 petition slip away from our hands. So then we decided to proceed with it.

    MAIN PROBLEM is I DO NOT have an ITR eversince. Because i have been staying here in the Philippines for many years already, I just returned back to the US last March 2015, and only stayed there for 6mos and went back here in the Philippines as I have said earlier. By that being all said, I also do not have an income, and bank accounts and assets.

    SECOND PROBLEM is we do have a willing co sponsor. Which is my mom. However her income DOES NOT meet the poverty guidelines for a household of 4. Because I and my daughter is still under my mom's ITR. So if she'd include my fiancè and co sponsor him it would make a household of 4.

    THIRD PROBLEM is our packet got approved last July 14 2015 valid until Nov 13, 2015. So i am worried if we could still proceed with it even after the validity date have past.

    So yeah. My problems are Major major major. And a perfect recipe for a chaotic disaster. But we are really eager to proceed with the interview that will commence soon right after we pay the visa fee. We do not have anyone to be our co sponsor. I know everyone who'll read this will say that our petition/visa will be denied because of lacking documents and financial instability. But does anyone know someone who got approved despite of not having an income and an eligible co sponsor. Please do let me know. Thank you so much.   5. hi everyone! i am honestly a bit anxious of asking this. because i am scared if i would get judged in a way of saying "why would file a k-1 visa if you are not financially stable" or "just go back to the Philippines and get married and file a CR-1 instead." but i hope that i wont be getting those comments now. so anyway, I am the petitioner. and my beneficiary is from the Philippines. I do not have any records of ITR W2 or whatsoever because I have been out in the US for a long time. and by that time I was still as student and a minor. so i was not been able and qualified to file an income tax returns while abroad. I am already 4 months here in the US since i have arrived (March 19, 2015). And since, i have not been able to work because i have a 3 year old kid. So my mom applied me for the government assistance programs, such as medi-cal, cal fresh, cal works/gains, which includes foodstamps and cash aid. I have been issued a medi-cal way back 2006, because my mom is a single mom. but it has been discontinued since i went back to the Philippines and was activated again by April this year. i have been qualified for these programs, because i have a kid and i am a single mom and has no income. but these all are just temporary. i am planning to work by this month but then there were these instances that probids to me to do so. My GAINS social worker have referred me to counseling and therapy for "depression". And i was told that i am not suppose to work until i am re evaluated again this AUGUST. So anyway, our petition just got approved last week. and since i do not have an income yet i have decided to go to having a co sponsor (which is my beneficiary's aunt, who is living in the US as well). Now, my concern is that would i get in trouble or our petition if trouble since i am under the government assistance programs? and what should i do? do i need to submit a letter during my Fiancé's interview stating that i am under government assitance programs? please do advise me what to do thank you!

    packet sent out: June 5, 2015

    packet received: June 9, 2015 (according to our noa1 hard copy and the e-mail from USCIS)

    noticed date: June 11, 2015

    Noa1 Hard Copy received : June 15, 2015

    Case Approved: July 14, 2015

    that's it guys! i am praying for everyone's fast approval.

  7. Like Shelly said you won't know until they either send you the NOA2 or the RFE. Count your blessing that you are at the CSC, processing times right now are about 42 days and possibly going up from there. I received an RFE, I don't know for what yet since I was very thorough but when I find out I will post it here. Also I didn't receive a text for my RFE, though I did get an email and of course and a USCIS case status update. An RFE is not the worst thing in the world, since it means that atleast your file is tucked away nicely on the officers desk for an easy approval once you get the information they requested back. Godspeed!!

    thank you so much for your output... i would just probably wait for the RFE. and just wait for the mail. i would probably wait for about 2 months or so to maybe more. but i will just keep my hopes up. thank you again. and please do keep me or us posted why you have an RFE once it arrive in the mail. thank you again!

    i just received the noa1 via text and e-mail. but i have this strong feeling that i would get an RFE. just because i have mistakenly put some sort of dumb answer on the "place of issuance" of the certificate of citizenship. i put USA, which is really obvious to everyone that the certification of citizenship is issued inside the territories of the US. so i knew in the first place that i must put the city of the place of issuance but i was so dumb still to write USA. so now i have this big feeling that i would get an RFE anytime soon. i am just preparing for the worst.

    so my question is, how many weeks would they send out the RFE right after the noa1?

    would they send it via e-mail or in the mail (snail mail)?

    I`m almost sure I`ll be getting an RFE as well, I`m getting that fixed right now because I`ll have to send it to my fiance in the States. I mistakingly put "none" for "Last address outside of the USA for nore than one year" which was a dumb mistake since I`m the benificiary and have lived in the same country (Belgium) my entire life. I did put my address correct in the question before that one so there`s Iguess a 50/50 chance I`ll get an RFE.

    Knocking on wood I`m getting someone nice to check our package :D

    oh!! we are just almost the same.. that is why i am already preparing for the worst to happen. as what i have heard that they are so keen in reviewing the application, which infact just a very small glitch they will send out RFE right there and then.. but i am hoping to have a personnel who is nice enough to let it pass through (though it is kinda impossible) hahaha. but RFE is not the end of everything though. so yeah, i am just praying that it will arrive soon (RFE) so i could send out what they need, and doesnt cause much delays. :)

  10. hi everyone! anyone who have filed or sent their k-1 application/packet on june5th and have arrived on june8th in texas, did you receive your NOA1 already? thank you!

    okay, right after i have done posting this, i received a text and an e-mail as well, that they have received my petition and was routed to CSC. yey!! hehehe now i am waiting for the RFE. i have a big feeling that i would have an RFE, just because of the place of issuance. i was so dumb to put just the country which is pretty obvious to everyone that it is issued inside the territories of the USA. but yeah instea of writing the place or the city itself i wrote instead USA. so i am pretty sure i would be getting RFE for that. so anyone has any idea of when the RFE letter/e-mail arrives? would they let you know that you got an RFE on the E-mail or on the snail mail. please do advise. thank you and GOOD LUCK and GOD BLESS to all of us.

    Hi. Ours too was sent out on the 5th via the priority mail of USPS and i addressed it st the dallas po box. How about u? I got a trxt from USPS it says that its available for pick up then it says that it delivered at dallas facility with the zip code of 75266. Does that mean they have received it alreqdy? Is that what you have in your status at usps website? Thank you!:)

  12. Hmm i do not have a US birth cert because i was not born here in america. I was born in the Philippines. I entered here as an LPR and later became a USC because my mom applied for a USCitizenship and since i was a minor that time i also became a USC thru naturalization.

    Thank you for your responses though.

    I was just maybe a bit excited and got carried away when i was completing up the form. Twas a dumb move for me because i knew that i must put a city which is LA, but in some instances i thought that putting USA is the safest answer. which obviously not. Hahaha so i am just preparing myself for the worst. I am getting an RFE.for sure haha.

    Some bad advice been posted here, what is acceptable in Manila is not same as other embassies, or how it works with other types of visas is not the same as with K-1. As for using a co-sponsor with the K-1, K-1 visa it is very difficult to get a co-sponsor accepted at USEM, and when they do accept them they want the co-sponsor to a close relative of the PETITIONER (not beneficiary). Better to be married and file a spousal visa as any qualified co-sponsor will be accepted. Only a 50/50 chance of a qualified co-sponsor being accepted with the K-1 at USEM.

  14. what docs shall be the documents to be presented in using a co sponsor, besides the ITR, W2, bank account and such which is related to it? shall the co sponsor provide a personal letter? stating that she is related with my fiancé (beneficary) and that she knows our relationship since we have started it, and have known me, though not personally yet because we have not seen eachother yet (my fiancé's aunt) and that she is willing to help my fiancé or us if ever we need help. please do help me to get through with this. because most of the people said that it would be really a red flag to use a co sponsor if the beneficiary is from the philippines. thank you!
