Did you guys all get the EAD. I have been waiting since Nov 17 and nothing yet. I have tried everything and still waiting to get a response from USCIS

I am waiting too, I filled on 17th November. I sent three service requests and got three different vague answers.

Still waiting for EAD approval. Got infopass tomorrow and went to congressman to file help today.. Getting real desperate.

I feel the same. i hope we get some news soon.

Our NOA is November 25 and i called and submitted a service request last monday (Day 76) and I got an email the next day saying they're reviewing it and they will notify shortly...We still haven't got anything and the online case status tracker still shows "ON November 25, they received our application for I-765...)

The processing time on the vj says they're up to November 28 and it feels like it's taking forever to be able to work!!!

I'm Nov 17th and still waiting even after the second service request. Vj timelines are not that accurate.

Hi I inquired USCIS as it has passed visa journey dead line , USCIS Lee's summit replied they're anticipating delays due to workload. Anyone who is facing the same situation I filled my case on 11/13/2015. It's really frustrating now I am checking my emails And online status every hour what do you guys think it can take more than 90 days ? Or they issue in time frame ?

I filled a service request on 01/31/2016 and I got the response today. It says " Your case is currently under review. You should receive a decision or notice of other action shortly".

Then to be safe I would send both just in case since you didn't keep copies.

I have the copy of cover letter and i sent what is on the cover letter. I think I am going to send a new form I-864 for the Sponsor and joint-sponsor.

That means I will fulfill their RFE requirements

Well if you had a joint sponsor you may want to make sure both forms are correctly completed (the petitioners and the joint sponsors). You only get one change at an RFE. From what it looks like they are not asking for anything else, but if you didn't send tax info the first time you should send it in with the RFE.

Well, I send all the tax info at first time so i dont think there would be a problem with that. It seems that they are asking for sponsor and not joint sponsor. However I might send both of them just to make sure.

Did you keep copies of everything you sent to USCIS (you really should)? Check the copies so you can make sure.

I dont have copies though. I should have done that but its too late now

It sounds like its the petitioner's I-864.

What household size did your wife put? It should be 1 (herself) + 1 (you) + # (any other dependents).

She can't have a household size of 0 or 1 because she needs to include both herself and you. At a minimum, the household size needs to be 2.

I think its for the petitioner and not for the joint sponsor but I just want to make sure that they are not asking for the joint's sponsor household size.

I think that's what i did but i dont know what happened. i will refill and send it back

I got today the RFE and this is what it sates

"The 'Sponsor's Household Size' on the petitioner/sponsor's Form I-864, Affidavit of Support (revision date 07/02/2015, was calculated incorrectly or not completed. A household size of 0 or 1 is not acceptable.

The petitioner/sponsor must correct and/or complete and return the enclosed page(s) of form I-864?

I used a joint sponsor , now i am not sure if they are asking for my wife's i-864 or joint sponsor's i-864?

Do I have to send other docs like tax returns or anything else since they are not asking for that?

The best CO-sponsor would be Mom or Dad who can co-sponsor. Could you ask your fiancee if she can do that. If so, please tell your fiancee that she needs to reach her Senator's office and ask to communicate with Consulate immediately to keep your documents in the Embassy on the ground that you could provide co-sponsor information there affidavit of support could be accomplished. Otherwise, your 129f will be leaving Embassy soon if you don't act. Time is money. Again before changing your minds to IR1-CR1 act and see if you could somehow save the precious effort for 129f.

Thank you for your response. They consular told me that when I get new evidence that I wont be a " public charge " I should call the embassy and request a new interview date. Moreover the letter that they gave me it says that we have one year time before our petition will be finally terminated. This time her dad or her sister will be our joint sponsor and my fiance will explain that her income was low becuase she did not work all the time in 2014.

Does your fiance have any immediate family members that would be able to joint sponsor? It might be best to first check to see if there is anyone that can and if not, your fiance will either have to get a job where they earn enough to sponsor you or you have to go the marriage route.

The i 134 is a Consulate discretion thingy, this one explained what they will and will not take.

Do you think there is something we can do to overturn their decision. My fiance is at the college and she cant make more than she is making. Any advice would be worth it.

Hi everyone

Today I had my interview for k-1 at the embassy. I had all the documents needed but my visa was still refused because they did not accept my joint sponsor.

The document was filled out without a mistake but they refused to accept the i-134. I said to the consular " A month ago I wrote to the embassy and I asked if you accept joint sponsors your replay was like below"

Thank you for your email. You will have enough time to complete the paperwork once you receive your appointment notice and instructions packet. We do accept joint sponsors but the petitioner must first fill out an affidavit of support and present the income. We will send you an appointment letter by mail as soon as we receive your file. Your appointment will be scheduled in 4-6 weeks from the date of the file receipt."

Today the consular said to me that there is no such thing for i-129f . Moreover, my friend had her interview last Wednesday her fiance did not reach 125% of poverty line.The U.S. petitioner decided to use his mom as joint sponsor and my friends visa was accepted without a problem. I said to the consular why wont you accept our joint sponsor He replied by saying that. If we see that they live in the same family then we accept them but we cant accept yours because your fiance does not live with your joint sponsor.

I was given the 221(g) with this explanation:

This office requests the following documents in order to continue processing your case.

Evidence of financial support -4- public charges

What are my options please help. I am so sorry if i coulnt explain it perfectly but i am in a really bad mood.

You should be OK in filling it out now; has to be 6 months or less for the age, I believe.

Notarization is not needed.

My case was received by the embassy yesterday and I was wondering if its okay to fill up the affidavit of support right away or should I wait for the packet 3.

Moreover I would like to ask a few more questions to make sure I don't make a mistake.

How old can the affidavit of support be. With old I mean would it be valid after a month.

Do you have to notarize the affidavit of support?

I have been calling them for 2 days now and can't get through, all it says, due to high call volume please call back, UGHHHHHH

You have to keep calling and when it says that message disconnect right away and call again right away. It took me probably 40 redials to through.

The same thing happened to me. I don't think it delays anything. Also I never got the NOA1 even though I made two inquiries. They sent me a response that USCIS does not send notices for your personal use, and you can look on the case status to see the status of your case. I think the message from uscis response was something like that. Dont worry about it

Your not alone, there are a lot of December fillers left.

We just got approved too :-) Our Noa1 is dec 29. Hang in there guys, it will happen when you least expect it!

I would like to say I'm overjoyed. Approved last night.

You can expect to see December approvals everyday in July. That's my guess.

300+ for Oct and 500+ for Nov I would think.
