Hi there
Thanks to advice from others on this site I was planning on filing a 2555 form with our first married tax return, but looking through it (and talking to the IRS on the phone) I've found I was out of my home country (the UK) for too long (I was there less than 330 days) because of all the time I spent visiting the US.
Has anyone else had this problem? The IRS have just said my wife (USC) should file as married filing seperately...

Here's a stupid question (but one I'm not sure of) am I a resident alien yet? I've filed the I-485 and have my SSN but does that term apply to me?

Well as it turned out I got told my EAD had been approved earlier this year but couldn't be issued because I hadn't had the biometrics (because of course they hadn't sent me a letter). So I have to go back tomorrow for that, after which they will issue it within a week or so. Apparently.
Though why my EAD doesn't show up as approved on the USCIS online facility I've no idea...

I can vouch for JFK- I had thought that was the only airport still doing it. I got a stamp on the I-94 in September 2005. If that's not your final destination give yourself plenty of time to make your connection.

What do you mean by "the second-nearest local office"? Most likely there is only one "local office" that has jurisdiction over your case.
I wanted to go to another "local office" -- San Francisco -- and I was only able to get an appointment by entering another (not mine) Zip code. Obviously, it was all in vain because SF office told me to go back to San Jose.
It may work differently where you live, but not likely. Just be prepared.
Well when I entered my zipcode on the Infopass website it brought up all the offices in Florida, having preselected the one nearest me (Orlando) which didn't have any appointments- and hasn't for about a week (I've been checking every day)... so I went back to the list and selected a different office. There wasn't anything to indicate I couldn't choose whichever one I wanted (dependent only on how far I wanted to have to drive).
If anyone knows any different then let me know!

My EAD application shows as having been recieved on Dec 12th and is untouched since then (which will be 90 days by now or over the weekend).
Anyway I've made an appointment to get a temporary EAD at my second-nearest local office (since the local one had no appointments free).
Has anyone else done this? And is anyone else still waiting this long for their EAD?

No doubt this is a really stupid question but if anyone has the time to read it and reply I would be very grateful- my advance parole documents have arrived (before the EAD or anything else) and it occurs to me I have no idea how to use them. I have two separate (and identical) I-512L 'Authorization for Parole' forms- can each one only be used once? How do I get more? Does anyone know?
Sorry for all the questions- but if anyone's used one before I'd love to hear from you!

The IRS told me I wouldn't pass the Bona Fide test either. Very frustrating- but my (USC) wife will file as married filing seperately and I just won't file, I guess.
