  1. yes - great.  So attach these as well.  I recall that you have many solid documentation showing joint finances.  Download tax transcript from IRS website.  You will see a dropdown where you choose 'immigration' which will direct you to download tax transcript.  Please note if you had sent tax transcripts in the first time then don't send it again. I had sent printouts and they specifically said it is not proof that taxes were filed.

     

    If you have taken trips together, boarding passes, some photos etc will help on the social side of marriage.  Affidavits from friends and I had attached photos with those friends from their family events as well.

    Hello there -- 

    Yes - it is quite stressful.  But you have to wait for the letter to know what the RFE is about.  It takes about a week to get the letter on hand.  You will have 90 days to respond.  There is no change in status for you.  In fact, my wife and I were in India when we got RFE and no questions were asked at the port of entry.  So keep your cool.

    Once you know what the RFE is about,  let us know and we can help you.

    I kind of feel like I am shooting in the dark with response to RFE.  But it feels like showing strong financial ties ranks on the top.  So anything that demonstrates this will be good.  Life insurance, estate, joint property, active bank account will work - looks like you already have them.

    Congrats -- That is wonderful and the turnaround from RFE received seems reasonable.  Gives hope to a few of us.

    Is that all they asked?  I got RFE to show more evidence of good faith marriage - specifically saying that tax returns that I enclosed were not indicative of filing  - so I downloaded transcripts from IRS.  Then I added a lot of documents/photos/ etc.  We don't have joint accounts.

    You are absolutely right that it feels like a luck of draw.  No matter what I provide, it could be challenged.  One of the main note in the RFE was that the tax returns that I provided were not indicative of filing with IRS.  So I logged into IRS site and there were number of documents that I can download.  There was a drop down that said for what purpose - I picked immigration and downloaded the tax transcripts.  Then within a week IRS sent me a notification that an online service was accessed - so I added that as well.  Then I searched in the bank account for IRS and printed those returns that matched the tax documents.

     

    WE don't have kids so nothing to show there.  We don't have common accounts or utility other than mobile common plan.  I have been in US for 20 years so most of financial holdings, payments etc are deeply rooted and I didn't deliberately make any changes.  Also we didn't need to create new assets and focused on getting her rooted here.  I sent some documents where she is my beneficiary (401k etc).

    I enclosed admission letter from Boston University for my wife and receipt that I paid tuition.

     

    I added both our drivers license showing same address.  I added a few state tax documents (1099-G) that were addressed in both our names and a note from Federal loan addressed to my wife.   ( it is funny - I felt like attaching copies of all USCIS communication that came in my wife's name for address  🙂 )

     

    My earlier affidavits were from neighbors who I knew recently.   The RFE didn't mention about affidavits under existing documents.  So I sent two affidavits from friends I knew for 20 years with photos of me and wife when we attended their family events.  One of them is a prison psychiatrist for Department of Justice.  So enclosed her card as well.

     

    Then another package with last year travel - boarding passes, itinerary, photos (location/date noted behind).   I still feel that a picky officer could still come back for more.  I don't know what else.  It would take a few years to build life/assets together and see tighter integration.  

     

    Once I started 'whining' around, quite a few of my friends and colleagues said of instances where someone they knew got RFE in similar situations.  

     

    I hope this will result in a positive outcome.  Part of me says prepare for an interview situation - just in case.

    All these are nothing new, but I hope this helps folks who are in similar situation.

    I just sent my RFE (to demonstrate good faith marriage) over the weekend.    I have thrown the kitchen sink and - I don't have any more documentation left after this RFE.  But also feel that it just depends on the officer who is assessing.  

    At least the file has been touched - less painful than waiting the dark.

  8. I got the RFE mail and it is same - they need more evidence of marriage.  

    The letter mentioned that the tax returns I sent were not an evidence that it has been filed with IRS 😲.  I used a tax software and printed after the taxes were filed.  

    Do you all have similar query regarding tax returns?  

    Any thoughts on what to send for tax returns that indicate it has been filed with IRS?  I can get tax transcript (from IRS site), email acknowledgement and bank statement where tax returns were credited.

    Thanks a bunch.  Are you re-sending the documents in addition to new ones you already sent while filing?

    At this point, I am assuming mine is similar RFE.  I had sent all these tax returns, insurance, affidavits.  If marriage evidence is my RFE  - I was planning to re-send whatever I sent and add more like photos, trips, social events etc.  We don't have shared bank account and we didn't buy any asset together.  That seems to be a big hole in my case.

     

  10. I filed noa1 march 28. 

    Then we got biometrics notice for May 2018 - my wife wasn't in town so had to move it and got that done in June 2018.

    August  2018 received 18 month extension

    March 2019 got transfer to texas

    June 2019 received RFE (waiting for letter)

    Both of us were out of country when the website changed status to RFE.  There were no questions asked at port of entry. I have global entry so I walked out and my wife went through the regular line.

    By the way -- same thing happened during K1 processing.  Our file went to Texas and was heavily backlogged.  Saw CSC getting approved in 60 days.  Then they took new East Coast applicants to CSC.  My colleague who applied for K1 in April (4 months after my application) got approved in June and I was still waiting.  But once i got approval all the pain vanished and moved to next step.  Hope to see some TSC approvals too.

    If you file I-751, you are a permanent resident.  You first file FAFSA online and that validates the status automatically with Department of Homeland Security (though the same system DMV uses when you apply for a driver’s license).  I was not even asked for a copy of my green card.  My social security and green card numbers were verified that I am an LPR.

    Yes- Boston University - school of medicine. 

     

    Thank you so much for explaining the process. This is great. I felt the financial aid staff was kind of the gatekeeper.  I am going to contact her again.
