    I am sorry I go from one thought to another,

    sometimes it's hard to (stay within the norm).

    I know i'm not alone in saying somehow, someway,

    in my case no not on a date site, I found my better

    half 8,000 miles away...Nothing more than pretty

    much nothing.More or less one of a few billion normal

    people never even knew anything but the state we

    live in..One day for whatever reason we find ourself

    leaving to experence a world we only knew from a

    tv..When you set your feet in this new world, what

    did you see?...What was going through your mind?

    When your wife or husband said (I have a surprise

    for you), what did you think?..I am a man yes but

    all I knew was my sweet Amy, thats all I knew..

    So without saying this yep (big woman) is my guide.

    All my trust is placed in her, what more can you do?

    My wife I guess is not what many call an average woman.

    She built a very good life of her own, she has not needed

    me for $, She is real in the dollar sense, and I envy her.

    How proud of her, the life she made for herself in China

    Somehow, some way find that one person you might

    the cultrural revaltion how ever its spelled, he has

    spent most of his life not able to do much of anything

    for his self for many many years..Once he even knew

    My wifes dad is in his 80's now, mom and dad have seen

    and lived more than most of us will ever know.

    What in gods name gives you and Mr. Pampers any

  3. I hope to soon mail in my I-130 for my Dominican spouse, and would appreciate some help with a particular issue: Documents needed to prove a family relationship (in this case, marriage). My concern relates to the "additional evidence" of the bona fides of the marital relationship, some examples being documentation of joint ownership of property, joint tenancy of a residence, or co-mingling of financial resources. We have none of these things, although some are in the works. I obtained two notarized affidavits (example I. of this question on the I-130) from people with knowledge of the marital relationship during my most recent trip to the Dominican, but I am concerned that this is not enough. Example J. on the form includes "any other relevant documentation" establishing the union; what are some examples of this?

    Are the affidavits, in addition to the required evidence (marriage certificate, photos, etc.) sufficient? What are some other things I might be able to include? Thank you!

    Other things could be like if she was on your life insurance or in a will, or basically any official thing a married couple might have together. But you should be fine with the two affidavits. There quite a lot of people who have ignored that section of the instructions and not had any problems at all. Also, they realise when the couple doesn't live in the same country or have children, there isn't much to show yet. So, don't sweat it! :)

    So true..Don't sweat it...1st get into all this .gov lingo it does look complicated..

    Add to don't sweat it, don't be a bundle of nerves..Take time to realy read the

    instructions..Something don't make sense ask it here..So many caring people

    on this site I have seen..Many of us has found that interview day is the day

    all you have would be best to bring, pictures, letters, emails, im's..etc...........

    Even then can't be sure what the person will ask to see..Maybe just simple

    things like how did you meet?..What does he do for a living?..How old

    is he/she..Other than that might not even take hard look at other things..

    I just sent in the certifided copy of our marriage licence and that was it there were no questions

    True..What they realy want is legal proof of marriage.

    If one of you has been married before make sure to

    include the divorce cert..Other than the basics thats all for now.

    As far as the proof part thats all ya need for now

  7. Our case was a lot more complicated than yours (I won't go into detail). We did it all by ourselves, and were approved one month ago.

    If you're more or less educated, and can read and pay attention to detail, there is no reason for you not to be able to file successfully without outside help. Information is available to everybody - the same information that is available to lawyers. There is no reason why you couldn't take advantage of it as efficiently, if not more so, to help your case than someone who has less personal interest vested in its successful outcome

    I have decided to go with hiring a lawyer, although it is so costly and i feel quite suspicious everytime i speak to one. However, i feel my case is complicated as my fiance is illegal in the country i met him in (UK) - illegal from beginning to end (got smuggled in the back of a lorry type of illegal, fake documents - the whole shebang). My initial consultations with attorneys seemed to me that his status in another country doesn't really matter, especially if he will be doing the interview in his native country, but i still think that gathering the necessary information might be tricky because of his status in the UK. Our relationship has been going on and strong for three years, so there is no problem proving it. The problem is that it occured in a country he was staying illegally. And we plan on being completely honest with all of this information during the process, so i would prefer to have the backing of someone who at least knows better than me.

    Anybody have any comments? Lawyer or no lawyer? any good ones to recommend? I might be going with John F Roth http://www.arctec.com/. $1800 (expensive!) but he refunds your money if you dont get the visa (provided you were up front and legitimate with all the information) which i believe is a good sign and deal, especially since he is about 2x as expensive as anybody else.

    Some of you may know about our case, im about to fill in my timeline once I gather all my info. Here is my older post. To some it up, I'm from Ireland visiting Canada so I can be with my wife, she is visiting me in Canada. We hired a bad laywer in December 06 (didn't know he was bad at the time) to apply for CR1 visa for us. He said we can have our interview in Canada, but I have since learned that it has to be in my home country. The lawyer already made mistakes on documents sent to the NVC, during the summer, delaying us about 2 months. We took over the lawyers work in September and got the NVC to transfer our case to Ireland. The lawyer has done nothing since September, we have been the ones calling the NVC and the embassy in Ireland (at 5am in the morning) for weeks to get this all sorted out. All the lawyer was doing was calling Montreal, who never had our case, to try to get them to move it to Ireland. Plus as far as I know you cannot call Montreal.

    After alot of international phone calls, very late nights and emails we have finally got the interview scheduled in Ireland for November. I have paid the lawyer loads of money for this CR1 visa application (which they have made a mess of) , also paid him twice to get my Canadian visa extented.

    I informed the lawyer that our interview is scheduled and they replied "Oh good, so Montreal got my voicemails and faxes" ??? . Since I informed them of the interview, last week, I have got a new bill from them for $500. This is for stationary stuff, photocopies, certified copies of certificates (birth, marriage etc), and faxes. I have got more communication from the in the past week (asking me to come seem them to settle the bill) than I have for the whole year.

    I am outraged and p*ssed off. I will be reporting them to every company and association I can think off so people can stay away from them.

    I need help now, I'm gathering all my information together and need proof and documents etc. Where can I find some information (preferably on a US government website) that states 3rd country nationals, such as myself, cannot have their cases pending in another country? In other words, something official that states cases and interviews for US spousal visas can only be processed in the beneficiaries home country.

    All help is greatly appreciated. Thank you.

    The world is too complex to stereotype humanity through media or perceived media or politics.

    Everyone marches to the beat of a different drum, even when put under the umbrella of prejudice by people who like to stereotype and fit countries in their own little box.

  10. Yes what you said makes sense. I think. I think you are saying that you once had a certain vision of China based on media, etc., until you met your SO. Now you can see there's so much more to the people of the country beyond the government.

    I agree, but I suppose I've always viewed things that way. I'm a card-carrying member of Amnesty International and have been since the Nelson Mandela, apartheid days. I lived in Spain for 5 or 6 years, and all over the United States, as well as visiting South America, Europe, UK/Ireland, Canada. I've also taught students from all over the world. So I've seen firsthand that people are not their governments and they are not stereotypical in many cases (though, sadly, some people do live up to their unflattering stereotypes).

    I think most people here are open-minded about other cultures or we wouldn't be here.

    It's sad most people in this country as well as other countries form thier thoughts

    around the tv news or what thier .gov said..Realy don't understand whats

    and talk all they want..Only cost 25 bucks a month.

    Need a broadband connection but ya get a dedicated

    chinese phone number wifey could wake ya up at 3am

    when she misses you and won't cost her a dime.

  13. The grounds you've cited for annulment don't apply. You were an adult, and unless you were coerced or non compos mentis then you did so of free will.

    If you are outside the US at this time, how do you figure the out-of-status time will play out?

    My parents went to the USCIS office and they told her I had to fill out an I-824 and my I-130 status is still approved.

    What country are you in right now? My understanding is that with the approved I-130, you would still be subject to the availability of a visa. Have you checked to see if the visa priority date is current?

    I'm in Mexico. How do I check to see i the visa priority date is current? The way I know that it was approved is by the case status online at USCIS.com. It only states when it was approved in 1998 and it was updated in 2002 (based on my online filing account at USCIS) so I'm not sure what the expiration date it might have, does an I-130 have an expiration date? My mother went to the USCIS office in the states and they had her file for an I-824 to request copies of the approved I-130.

    You say you are intent on following through with your family-based petition by way of your father's petition, rather than a marriage-based one, and that is due to the fact that your marriage, by your own admission is not viable and you are headed towards divorce. I think, unless my information is not accurate, if your father petitioned for you as an LPR (even if he subsequently upgraded the petition once he became a US citizen) you're considered Third Preference category, since you have married and are over 21 years of age. So, according to the bulletion issued by the Department of State, you've got quite a wait. The current priority date is 08JUN92 for Mexico. Of course, you should confer with an immigration specialist, since we don't know all of the details that might be pertinent. I'm inclined to believe that it would be wise to confer with an immigration attorney to ask if any time spent in the USA over 180 days could possible cause a bar to admissibility.

    Other parts not sure of.

    One thing you can count on is yes a divorce is

    your path..You must do it in the state you married in.

    If you don't and try to file with dhs in the future your

    marriage (divorce) will be known.........................

    One thing am not sure about is does dhs check records

    in all states, the 1st address you gave them yes they do

    check local records, county records and state.

    Lawyers are really a waste of time unless you need one. They file the same paperwork using the same process as everyone else who files without using a lawyer does. Additionally, cases with lawyers don't get any special or preferential treatment by USCIS. So basically, unless you have a special legal need (i.e. overstayed visa, criminal record, deportation) then the paperwork and instructions are all pretty self explanatory

    Yup..Not sure whats worst that root canal or 1-800-if-ur-hurt :devil:

    Either way it be a pain in the butt.

    I am a UK citizen married my US wife in UK in July 2004. I have recently entered US on K3 spousal visa and been issued with I94.

    We were led to believe that I could work as soon as I entered the US. My wife is a singer / actress.

    I need to be working immediately..... I have now been told that I have to file my AOS and EAD and it will take upto 90 days for this to go through.

    Can anyone advise if there is a way that I can get EAD very quickly?

    How long does this process REALLY take....???

    If I cannot sort something out very soon my wife and I will have to seperate and I will have to return to the UK to work. With a K3 being a "one entry only" visa I do not know if our marriage will survive the time it will take to re apply....

    Please, PLEASE, if someone can help me out here we are in urgent need of help

    We just filed for EAD without an approved P2 for I-130

    Even went through Biometrics just to be denied..........

    Reason given was no approved I-130 for K3.......

    K-3 is a pain in the ASH on many levels. What is the hold up on the I-130?

  18. I filed the I-130 for my wife back in June and then the I-129F in late June. The I-130 has not been touched since June 19th and the I-129F has not been touched since August 1st. I'm concerned because I am supposed to go home on R&R in January. I want to travel to Colombia and fly back home with her, because she has not yet met my family. Does anyone think that she could realistically get her visa by the end of January?

    Has anyone else filing in June received an NOA2 or had their paperwork touched recently? I thought she would have it no later than November or December. Now I am getting nervous. I have not seen my wife since May, and I want to spend what little time I have with in January having fun, relaxing, and introducing her to my family.

    Also has anyone called the Military line at USCIS and received any helpful information or even talked to an actual person there? Can the process be sped up in any way?

    I know I have a lot of questions, but like I said I'm getting a little nervous and crunched for time. :wacko:

    we just find our own way to try and deal with it..One thing we know is unless ur

    GW Bush theres not much can do but find ur way to deal with the time it takes.

    The best way for me to deal with this s#$%^t is to see it as a very small amount

    of time considering how long it took to find this treasure, gods gift if u will..

    Someone many humans never find..In this we do whatever it takes, no matter

    what the cost or the time it takes..We didn't find our soul mate next door so since

    our individual wants and needs don't matter to whatever .gov we have to answer

    to our life in this is ruled by them, not much other choice we can do but find our

    own way to deal with this.........Not that it matters but with my wife 8,000 miles

    away told me one night on yahoo..I am scared man, sometimes I dream and

    even awake think I will grow old and die alone without you..........................

    its called there..In this state thats what its called..What you need

    for a picture id you can find it there, each state is different in this

    so get the phone book or find ur states web page

    Sorry but unless each state has thier own law about getting an SSN,

    You will be told at ur local SSN office an EAD has to be appiled for

    1st..Just make a phone call or go in person to them, thats always

    the best way

  21. Okay...so here's a bit of a weird situation that my good friend is in and I told her that I would throw the scenario out to all my fellow VJ'ers because you guys are amazing with knowing all the in's and out's of this immigration process.

    She married a guy in Central America and lived with him for awhile down there. Things turned out bad and she decided to come back home in the U.S. He ended up coming over the the U.S. without ever talking to her about it and just sort of showed up. He snuck in so he came across illegally. My friend does not want to be with him but he just won't go away. He's desperately trying to get her back and fix the relationship but she is just over it. So now, she doesn't know what to do. The local authorities don't do anything about illegal immigrants in our area and she doesn't know who else to turn to. Can you just call somebody up? I mean, people won't just come over and pay for someone to go back where they came from...right?

    Anyways...if you have any questions, please ask and I'll try to get them answered if I don't know the answer already. I know a lot about their past but not everything. He's from Guatemala and she lives nearby me in South Texas. I'd love to pass along some better and more informed advice to her, so if you can help out...I know it would be appreciated.

  22. Banks in two different states have helped me set up joint checking accounts with my wife, even though she isn't here yet. Both have issued ATM cards that she uses that have her name (not mine) on them. If your bank won't cooperate with you to set up joint accounts, then find a cooperative bank -- perhaps near a University near you, and move your banking there.

    Both banks required the picture page of my wife's passport for identification. My SSN was good enough for tax purposes, especially since those checking accts didn't earn interest anyway! My current bank was even savvy to help us fill out the required IRS forms so that she can be joint on interest-bearing accounts even though she doesn't have a SSN or ITN yet. Banks are there to provide service in exchange for your lending money to them -- that is what checking and savings accounts are, after all. Find one that serves you.

    Thanks - I've had a checking account with Citibank for the last 7 years, hopefully they will work something out with me, will go and ask. They even have a branch with limited service in Kathmandu, near the old US Embassy - something I found out when an ATM machine ate my card last summer. :angry:

    how small it may seem, it can and will come back to haunt you..........................

    As far as evidence goes say what ya will legal paper work (95%of the time)+/-.

    On interview day is the major concern (from your country as well as his)..

    Maybe I'm wrong in this but from all I've seen and gone through evidence

    is of course a factor so bring it all..Legal Documents and simple things like

    questions at the interview appear to matter the most..Yes it seem questions

    that are asked at interviews even though they have a guideline can depend

    on what side of the bed that COF woke up on that day..No one can say that

    is not a factor, it is..Be yourself,make sure he knows to be as none nervous

    as he can..Make sure he knows things about you that ya would never think

    of, ie....whats her favorite food?..Whats her favorite hobby?..Where does she work?..

    Do you own or rent?...What about her parents?..How did you two meet?........

    Well, you get the picture right? :thumbs:

    Make sure when ur hubby walks in that room he is his self, not a bundle of nerves.

    David, Make sure you two leave real early if interview is AM.

    Gz traffic is a mess depending on how far away you guys

    are from consulate, theres a very nice park across the road

    can hang out in, also an IKEA can eye shop and get food also.

    Wife filed for EAD, AOS not yet filed for, I-130

    still in the works..Online case status says..

    (we mailed you a decsion)..................

    Be a couple days before it gets here and

    right now shes in tears thinking its denied..

    I know don't know for sure yet but has anyone
