    It sounds like you may want to research "Derivation of Citizenship" for your children. A quick google landed me here: https://cliniclegal.org/sites/default/files/231718_clinic_08.pdf which may be of help.

  2. My wife and I just got back from St. Lucia traveling with an expired Green Card and Extension Letter (I-797 Receipt). We had no issues with CBP when re-entering the country and all officers were fully aware of the situation (expired GC + extension letter). If you're planning on traveling, here are some tips from us:

    • When you arrive back into the country, ignore the kiosks and grab a US Customs form (U.S. spouse should use the kiosk) - We spent too much time trying to figure out how to get the kiosk to accept an expired GC.
    • Enter the line to speak to an immigration officer (spouse with U.S. Citizenship can go with GC holder)
    • You'll need to take a photo/give finger prints (standard stuff)

    That's it. All we had to say to officers who approached us with questions was that we had an extension letter. They were quick to direct us to the right area. Everyone was super friendly, as well. This was Atlanta.

     

    Hope this helps for anyone considering traveling.

    A quick update. I just finished going to USCIS today for my biometrics. It just took me around 10-15 minutes.They just asked for my biometrics letter and green card then I just filled out a form asking for basic info such as name, previous name before marriage,phone #, ht, wt, nationality, citizenship, A#, application nos, color of eyes and hair and after filling up the form, they gave me a number then called me after and that's it. I also went there an hour before my appointment schedule and since they were not toxic that time, they let me in. 

     

    Now, the waiiiitiiiing game begins.... Good luck to all of us!

    I followed the I-751 instructions, which states under "How to fill out Form I-751" Question 3 :

    Answer all questions fully and accurately. If a question does not apply to you (for example, if you have never been married and the question asks “Provide the name of your current spouse”), type or print “N/A,” unless otherwise directed. If your answer to a question which requires a numeric response is zero or none (for example, “How many children do you have” or “How many times have you departed the United States”), type or print “None,” unless otherwise directed.

    I've read from others that leaving a section blank could be mistaken as you not answering (or missing) the question (rather than the question not applying to you). I decided to just go crazy and add N/A to everything that didn't apply, just so the application was extra clear to the USCIS officer handling the case.

     

    In fairness, it did seem silly adding "N/A" to Childs 2, 3, 4, and 5 after writing "N/A" for Child 1...

    I had to file with CSC. Personally, my check was cashed before I received my notice (exactly one day before). However, other commenters have said they received their NOA first and then had their checks cashed later. So, it seems to vary based on workload and service center.

     

    Based on other VSC filers, it appears you should be receiving your notice soon! :)

    Checked our mail today and was happy to see an envelope from the USCIS with our NOA1!

     

    For those curious, our NOA1 was dated 4/6/2017, the same day they received our package.

     

    Your NOA1 is probably coming any day now! :)
     

  7. Yep, as others stated, I submitted photos that were eventually returned (we sent a book, which I guess doesn't file well, oops!)

     

    During our in person interview, the officer interviewing us asked us some basic questions (how we met, how long we've been married, etc.) and was going through our submitted application. At the very end of our interview, we asked the officer if he would like to see photos, so he took our book, looked at a page or two asking questions about the photos, and then concluded the interview (never even got to the wedding photos!)

     

    Regarding your proof, it looks nearly identical to the proof we submitted :)

    Mailed our package 4/5 with USPS Express Delivery (Delivered 4/6 at CSC) - No NOA yet, BUT I JUST saw in my online checking account a debit for $680 bucks! (WOOHOO! ... Probably one of the few times where I'm excited to have LESS money in my account, LOL!)

     

    Nerves are a bit more calm now :)

  9. As long as your friend's case is strong, then he does not need to worry. Once the I-485 and other forms are filed, your friend will be in a stay authorized by the Attorney General.

    Even if a foreign national is, for a period of time, not holding a lawful nonimmigrant status, the individual may be in a "period of stay authorized by the Attorney General" (i.e. period of authorized stay). One of the most common situations in which this occurs is when a properly filed application or petition to extend or change nonimmigrant status is filed with the USCIS on behalf of a foreign national.

    The primary reason to stay in status would be any unforeseen issue with the application (or a weak case where the officer suspects fraud). In that case, your friend could fallback to their F1 status. Good luck!
