Hi,
I am the US Citizen Petitioner for my wife and she has her interview at New Delhi. Can someone please tell me if the US Citizen is allowed to come inside with his spouse in the same section where interview is? I am hearing mixed things, as to different entrances, etc...

Granted our interview was a while ago, I was able to accompany my husband to the interview and be with him throughout. Good luck.

Leaving on the expiry date of a visa is perfectly fine--leaving after can get you some real migraines.
How would it affect the OP since she would leave on the 20th here, but technically will arrive on the 21st there?

If I knew then what i know now, we would have definitely gone the CR1 route or at least rescheduled our AOS interview which was literally three days away from our two year anniversary which caused us to have the conditional greencard. But as they say, hindsight is 20/20.

I for one can see the merit in the suggestions being made and it wouldn't surprise me one bit if we saw some of these suggestions implemented in the coming years.
On the flip side, however, I can also see the benefits involved in the K-1 visa. The question will be which holds greater weight the suggestions in the article or the benefits of the K-1.

I agree with the other posters. Right now is difficult for you both but this hump in the road won't last forever. Have your wife begin to make the necessary phone calls and emails to get the proper information as to the status of your case. Take one day at a time. Being apart is not easy under any circumstances but especially when there's job loss and a 221g involved. Good luck and keep us posted.

Thanks for the quick response. The crazy part about all of this is that we were only four days away from our 2nd year anniversary. Hubby says the 2 year green card really isn't much different from his K-3 visa since it expired in 2009 too. He said it's like having two tv's for the same room. We filed for AOS when we did to avoid the fee increase but as hubby pointed out a few moments ago, it's like we're paying it anyway between the AOS fees and the 565 we'll have to pay to lift conditions. Oh well... water under a bridge now. I'm just thankful that he's got it and we can breathe for 1 year 9 months. Thanks again.
Congrats on a successful interview and green card! Yes, a 2 yr green card is normal if you and your spouse have been married less than 2 years at the time of the interview. To lift conditions you will need to complete I-751, there is a VJ guide for the process. Its pretty straight forward compared to the other parts of the immigration process and you will need to provide the same type of evidence that you did during your AOS interview. -
Oh one more thing... they also asked for the I693A which we got from Dr. L.E. Arnold in TX..so it's definitely important to have this on hand. The other thing I noticed about our file as she was flipping through is that they save everything, including the envelopes you mail things in. For some reason I thought everything would be in an electronic file but it wasn't. She even saved the envelope the I693-A came in and stapled it to the back of the form.
Hi,Hubby had his AOS interview on March 12. This interview was a bit more intense than the consulate interview in Delhi but we were prepared. Got to the USCIS office 15 minutes before the interview and the line was out the door. Fortunately security moved pretty quickly. We only waited about 25 minutes before being called back for the interview.
We were sworn in and the officer asked the following questions (aside from the regular have you ever commited a crime questions)
1) Did you fill out a financial form? Before I could answer she found the one on file and I provided her an updated employment letter reflecting a promotion and payraise. Also showed hubbies check stubs.
2) To Hubby: What do you do (for employment)
3) To Hubby: Do you plan on practicing polygamy?
4) To Me: Have you ever met his parents ( To which I replied yes and we showed pics of me and his family together)
5) What is his Father's name ( I explained I couldn't pronounce it but attempted to spell it also explained FIL is deceased)
6) What is his Mother's name?
7) When did you get married
8) Where did you get married
9) to Hubby: What is the phone number
10) What is the address?
11) Do you have proof
12) Do you have proof of relationship? (we then produced insurance cards, bank accounts, joint credit card account etc.)
She then looked through our pictures and said everything looks to be in order prending final checks. When I asked about the checks, she said they should be completed by the end of the day and that we'll receive the card in two to three weeks. Since our anniversary was only four days away this was a great 2nd anniversary gift for us!
Hubby received his welcome to America letter and notification of card production on this past Wednesday only one week after the interview. This was a two year conditional permanent residency card. Can anyone tell me the process for lifting conditions and if a two year is normal? Thanks VJ for being such a great resource!

Manoj didn't have a birth certificate and we've used copies of his tenth certificate throughout the process along with an affadavit of birth and we had no problems. The Embassy recognizes the 10th certificate as a form of proof of birth. Good luck.
Hi Everyone!We just got Ritesh's Birth Certificate from his parents, and I wanted to ask the group if this is what you used/if it is appropriate?
It is a certificate from the Nursing Home where he was born stating both of his parents names, their address, the date and time of birth with 'male' listed. In addition, we have his 10th Standard Certificate which lists his birthdate and father's name...
I am worried as the certificate is not from a 'Legal Authority/court, etc.' and does not list his name...
Please help!

Sorry to hear you had such an unpleasant experience in Bham with your biometrics. We had to go there twice and didn't have any problems. The first time they let me stay inside with hubby. The second time, however, they did not but they were quite kind about it. I guess it depends on who is working the front desk.
A note about A numbers, the other posters are correct that you can find it on the receipt and other correspondence from USCIS but hubby's was also put on the back of his I-94 card to at the POE. Hope this helps.

I've been there. What information would you like? It's a pretty streamlined process for being processed in. The customer service seems to be better at this new location than it was at their old one on Forsyth.

Hubby went through Newark. Our review is posted somewhere on here. He had no problems. THe flight arrived at 4 in the morning if I recall correctly and his contact with the IO was fast and easy..Good luck.

I use the prepaid service through ppoutlet.com. 6 cents a minute. Great service too. PM me and I'll send you the specific link because they have two prepaids and many kinds of calling cards but we found that the plan we used was the best even for calling to a mobile.

Unless things have changed dramatically in the last few months, The U.S. citizen is allowed in the embassy. I accompanied my husband to his interview and had no problems getting in.

Did you apply for the EAD through the California service center too? If so you may want to check the timelines as someone else suggested because they seem to be backlogged. Hubby had his biometrics in August and we just got his EAD two weeks ago. We ended up having to go to an Infopass appointment and get our Congressman involved. I hope your process is much smoother. Good luck.

Take it from me and my recent experience.. don't waste your time going to the local office. Like the previous poster said they can only put in a request for you. We got the same advice from USCIS customer service and wound up driving 3.5 hours to the immigration office for nothing. Good luck.

I guess getting the Congressmen involved must have helped. Yesterday we received my husband's card in the mail. There was never any updates online on the case and even last week when my Congressman's office followed up with their initial contact, they received the message that they should follow-up in 30 more days as the case was still processing. Then yesterday voila the card was there. Finally...good luck on everyone else who are going through this madness.

I'm wondering if there is anyone else who has ever had to wait for their EAD as long as my husband has. We sent in the I765 in July and received our receipt on July 17. Hubby had his biometrics on August 14. Since then NOTHING. USCIS has acknowledged it's outside of the normal processing time and erroneously sent us to the Atlanta Immigration office to get a temporary EAD which they no longer do.
The day we returned from Atlanta I contacted both my Congressmen who are attempting to intervene on our behalf. Today Artur Davis' (one of my congressmen) liason called and said they finally got word back from the California Service Center to please allow them 30 more days-that the case was with an adjudicator but that we should hear something within 30 days. The Congressional Liason said she told the USCIS that 30 more days was unacceptable but that the response was to please contact them again after 30 days if they haven't heard anything.
For almost 6 months my husband has been living here virtually as a ghost. He can't get a SSN without the EAD which means he can't get a bank account much less a job. He's so sick of cooling his heals doing nothing. He's taken every Red Cross course there is to take and is volunteering here and there but to him, it is nothing like having his own job.
This is absolutely ridiculous. Other than going to an infopass appointment (which we have and they claim they have put in an expediting request) and contacting our Congressman (which we've also done...both the Senator and the Representative) is there anything else to do other than wait endlessly until they decide to give my husband his EAD?
Any suggestions would be nice.

Now I'm seeing the posts about no interim EADs that I didn't see before. Does anyone know why the local offices stopped issuing them?
Like several other people on the board, my husband has been waiting for his EAD since June. We finally called the non information line (USCIS customer service line) who acknowledged that yes we are outside of the normal processing time and she transferred us to an Immigration Officer by the name of Gonazlez who said she was putting in an expediting request and that we should make an infopass appointment to get an interim EAD.Long story short, a wasted workday, travel and hotel expenses later we are still no closer to getting the EAD. As soon as we were called up to the counter and we told the Immigration officer what we needed her reaction was to roll her eyes and say "we've told them to stop telling people to come here for that. We no longer issue temporary EAD's and they know that." She went on to say they haven't done it for more than a year and that they don't even have the machines to do it. To add even more insult to injury she tells us that she does not see where a request to expedite was even filed by Officer Gonzalez. This Immigration Officer even went so far as to say that these people are contractors so they won't do what they in the field offices ask them to.
We were so frustrated because as you know, without the EAD, he cannot get a social security number, a bank account, nor a job. I've contacted both my Congressman's office and my representative's office. But I'm ticked because this is the SECOND time I've driven to Atlanta for an Infopass appointment on the advice of the USCIS rep and it turned out what they sent me there for something they no longer do. It's almost as though they will say anything to get you off the line.
Okay enough of my vent post. Is anyone else going through this with a) no ead B) mis information and c) have you ever heard of no more interim ead's or is this just the Atlanta office?

We haven't received the biometrics appointment for the AOS yet. Only the NOA1 notice which was dated August 31. The biometrics he had last month was for his EAD which we filed seperately.
Congrats everyone who's had movement on their case! Yay!
Yesterday I received a notice in the mail telling me that our application has been transferred! I don't know whether this is a good thing or a bad thing LOL.
MrsAyilliath Could I please have some more information so I can update the time line? I would like the notice date on your NOA1 and the date you had your biometrics appointment please. MrsAyilliath, are you sure you'll have to have your biometrics done again as my biometrics was for both EAD (still yet to receive it like you) and my AOS. Look at your biometrics appointment letter to see if there are two case types written on there and two bar codes representing the EAD and the AOS. It is my understanding that you'll only have to go to do the bios once

Hubby received his NOA1 for AOS today. Please update us too. This means we'll have to take another trip to b'hams application service center to have biometrics taken AGAIN when we just did it last month for the EAD which we have yet to receive.

Anyone have experience with your case being transfered to a different embassy/consulate?

We had a similar experience only reversed. My husband's case was assigned to Mumbai because we married in Goa and that state is assigned to Mumbai Embassy. However, my husband resided in Delhi (10 yrs). If both hubby and I recall correctly, I called and spoke with someone at the Mumbai Embassy and followed the phone call up with an email to both the New Delhi and Mumbai Embassies. A few days later my I got a letter letting me know the case had been transferred to the New Delhi Embassy. Now that I look back, it was pretty easy to handle.
