Hi again. Happy new year! Just an update..

We got approved last November 21, 2016 and received the I-767 from mail last November 28, 2016. My husband was calling them since December and today NVC just received our case and he was adviced that they can give us the new case and invoice numbers in two weeks from today. My question, is this normal? I've seen others here doesn't take that much time like this. I don't understand.

It is normal, NVC may not have opened up its Dec caseload because of the holidays etc. It is usually 4 weeks to get anywhere but by jumping on the phone sometimes you get ahead by 2 weeks ..... when you wait months, the delay at the Embassy interview will get you back .... frustrating test of nerves and patience ..... :-)

And still most of us wait .... time to look at sunsets and stroll down to a cafe for coffee that I will miss when I go ......

i don't understand either , my PD is August 2rd , i still haven't heard A thing, but congratulations on your approval

Philippines get expedited in comparison to other countries, their process is different and well documented across visajourney. Not the fault of the person applying, simply a USCIS decision based on hardship and natural disasters which never changed apparently.

Wish them all luck, the process needs some "winners" :-)

Hello. I am Canadian living in Canada with my wife who is US citizen, we are legally married, have kids and everything.. Our kids have dual citizenship - US and Canada.

My I-130 was already approved, now we have to send everything to NVC to get visa, but we don't have time for that, we have to leave Canada soon..

I probably will have to go to US without getting visa from NVC ( Canadians don't need visa to go to US )

    My questions are:

1 Can I apply for "adjustment of status" in US if my I-130 was filed from Canada?

2 Do we need to file a new I-130 from within US?

    Thank you.

I spoke to USCIS on a similar topic, I was advised to say "have submitted form I-130 and currently travelling under ESTA scheme" ... the AOS application would be stand-alone and dependent upon the status and stage of application.

On my side, wife to find apartment, set-up base camp and then I stay for the allotted time ( 90 days max ) leave.  It may make sense for your wife to call USCIS and speak directly ....you may get better answers and she will know what to do etc.

163 days for me. July 11th PD. I called USCIS twice yesterday in the morning and 30 minutes before the agents stop answering the phone. Both repeated the same thing. The agency is processing applications received May 2nd and before. There is a backlog at Nebraska. I am within normal processing time call back next month.

Then the person answering the phone is telling us the status as posted on USCIS website stating June 2nd is a lie ...... we are truly in trouble if the left and the right who work at USCIS cannot tell a straight story!

Nebraska is so backed up, its ridiculous! Anyone know why all of a sudden there is seemingly no progress? I assume they are still working like they always have, but did someone all of a sudden stumble upon a ton of petitions they had missed from past months? No idea why there would suddenly be this huge slowdown.

Let us see, they dropped a load of petitions on Texas who seem to have been processed in the "5 months" yet appear to have done little based on those on visajourney who actually log-in and complete their timelines.

Where could this be going wrong?:

    • An interesting aside is the AOS ( Adjustment Of Status) level which is very high from those who entered the USA on one visa and then "decided" to be an immigrant.... which is supposed to be a big NO NO ...lol
    • Many many people filed believing Hillary would win and have yet to withdraw their application ...... others fear Trump and bet "lose:lose" so get the papers in as a safety measure to prevent other problems.
    • Staffing levels are short, commitments to IT upgrade and training high, on the job disruption reduces productivity and case reviews.
    • Funding is non-existant ( see point above)
    • It is Nebraska, cannot remember anything exciting, fast, ground-breaking to ever come out of the State? So why would you live and work there if you did not have to "clock-in" to USCIS and other "Govt jobs?"

Slow is as slow is ,,,,,,, Nebraska

On December 29th, 2016 I got approved for expeditious processing through the NVC and our case is currently "In transit" to the US Embassy in Paris, France.  I'm aware that it could take a couple weeks for it to fully transfer to the US Embassy in Paris.  My wife is currently a Portuguese citizen, however we are living in Belgium (I'm US military) and I received military orders to Greenland for February 2017, but my spouse cannot attend the tour with me, that's why we got approved for expeditious processing.

I have tried to talk to someone at the embassy but they keep on transferring me to automated responses and how to contact them via email or site.  The email I'm contacting is ParisConIV@state.gov, however every time I send an email to it explaining my situation, it keeps giving me an error that it won't be delivered to the recipient (I assume the email provided is obsolete or if there are only certain hours they receive emails?).

I'll give a little synopsis on what my email stated.  Basically, I received military orders to Greenland in February 2017, but my spouse can't attend the tour with me.  I know there are only approved doctors the US embassy's provide, such as Paris which is only two doctors, but I'm also wondering since we are in Belgium (due to my current military orders) if we can do the medicals with the approved physicians here in Belgium? Since these doctors are only about an hour away and the physicians in Paris are about 4 hours away.  I'm wondering if anyone had a similar situation? If so, should I go ahead and contact these physicians to get her full medical while we wait for our case to be transferred even without an appointment letter? I'm sure the physicians may allow us to do it due to our current situation and how much time we have left.

I'm not worried staying a little longer (past February, I just have to report by end of March) because I'm positive I can work something out with my personnel section with an exception of policy due to the importance of my wife's visa.

Also, how long does it take for the Embassy in Paris to schedule an interview? We have all required documents ready for the interview, it's just the medical and the actual interview date we are worried about. I'm fully aware we have to mail in the Application of readiness (DS-2001) to the embassy, but I don't want to send it in now since our case hasn't fully transferred to the Embassy and if we do send it in now and our case hasn't transferred by the time they receive it, will they still schedule it once the case has been transferred or will they just look at it and we have to resubmit it?

Important thing is that we receive the interview date before we leave because we don't want leave before having the interview and without the visa package.

Thanks in advance, any insight would be greatly appreciated!

It is likely the Embassy is on skeleton staffing for the holiday period. Some departments shut completely.

Try Frankfurt and speak to the military liaison officer who can then patch you back through to Paris with a name and a contact number.

we need to pay the difference ??omg

No, just new fees for new submissions after Dec 23rd ...... short of cash as our payments "fund" their work ..... we pay for our own hassle and pain .... yuk!

Fees quoted on old forms which can be accepted are wrong ..... so you need to check for forms post Dec 23rd:

    Old form - new fee

    New form - new fee

I'm right there with you guys, having got NOA1 from Nebraska on 8/24. I'm guessing NOA2 will be in January.

I imagine you guys are checking for updates daily on the USCIS website, just like we are, lol.

In the case of an RFE, I wonder if such notification comes by mail only or if you see it on the USCIS page too?

What else is there to do but look up our cases, then change the last digits by a few thousand on the reference number hunting down the last I-130 processed, in fact we should invent a bingo card ....selecting the last numbers at random  (selecting numbers from 20,500 to 99,999 such as 55140, 60358)  to make the look-up more interesting and know others are behind us somewhere waiting just like us ... LOL

    Hello,

I received my I-797C which mentions my priority date. But is there a difference between I-797 and I-797C? Is there any action required from my end? The letter mentions that I have to contact USCIS only if any of the particulars have changed or wrongly mentioned.

    Thanks

    AS

    I think no difference.

I had the same and read it as Form 797 .. forms and fees change.

    Please check update: https://www.uscis.gov/news/alerts/previous-editions-forms-accepted-until-feb-21-2017-must-include-new-fees

It would be really **** to be USD$20 short and get a bounce letter asking for money and delaying your case after the "great wait of Nebraska!"

Took the IR-CR1 processing via  http://www.visajourney.com/timeline/ ..then reversed sorted the columns clicking on the little tab icon at the top of the column, ,,,then into Excel to sort multi column and then cut and paste fail twice into visajourney so had to manually list with bullet points to get it to stick.

Taken from visajourney filing status list for Nebraska - NOA2 approval - which is totally reliant on completing timelines but acts as a guide to help you see "old" problem case acceptances together with "clean" date filing and acceptance to NOA2.

  15. I can't make sense of this post. If the wife's current income will continue from the same source, once she immigrates, then that will be the only actual income to show on the I-864. It is entered as the intending immigrant's income. Be sure to document both the income and that it will continue from the same source. I would wait to provide the I-864 until you can provide a pay stub for a full pay period, and the offer letter or contract. Be aware this must be "employee income" not independent contractor (self employed) income.

US Bank Account not necessary if in UK as London has many banks offering USD and other currency accounts - no need to open an account in the USA for the sake of it.

I-864 states income - if choosing to be paid in USD$ the bank statements will show values and other parties also see linked accounts at same banking branch/relationship.

Any UK company with offices in the USA / global entities allow certain staff to be based in other countries... IT projects, global purchasing, to name a few - avoid 100% visa process by using the work visa as the ticket to relocate - so many do this.

    Hope this explains the post.

As for your comments - I agree.

  16. I agree now that if they don’t delay. I am September filer.....yes I know I have long long long wait.

    NOW IF NO DELAY

JULY FILERS will start getting approve in January

Then AUGUST FILERS will get approve in February

Then SEPTEMBER FILERS will get approve March

    .

    NOW IF THEY DELAY

JULY FILERS will start getting approve in January to February.

Then AUGUST FILERS will get approve in March and April

Then SEPTEMBER FILERS will get approve May and June.

Your words re delay are prophetic .... darn you .... using my new American English language trainer .... :clock:

  17. I love how everybody says that "helping with the baby" is considered work.. I guess I need to start asking for money every time I do something nice about my brother/sister etc..

Imagine your family comes over and they are not allowed to freaken touch the baby or change its diaper cause its considered work.. that just sounds crazy to me. It's like going over to your sister for dinner and helping with the dishes.. its not work.. work is doing something for profit..

from what i've seen on lawyer websites etc "volunteering" is allowed on a tourist visa.. I would consider this volunteering and not "work" ..

helping without profit = volunteering = not work on a tourist visa = legal.

SPOT ON ........ I would have loved to have my mother-in-law OUT OF THE HOUSE but she "visited"

Define helping ..... new baby = attention, excuses to travel when they never did before because it was too expensive, stay over for weeks when life strangely back home was not "as important" .......

Lovely lady ,,,,,, 4 weeks and others for 1 day to 3 weeks at the same time ...

Second child ..... cut that by 50% and back to "oooh maybe next year as it is expensive to fly now" ......

Third child ---- ghost town I hope
