    That's a good idea... I will attach the front copy of the card and a cover letter and the police report.  Hopefully I do not get in trouble for going about 6 months without filing for a replacement because TECHNICALLY greencard holders are supposed to carry the greencard on them at all times... which I think is so stupid because obviously it puts us at risk of them getting stolen.  Next card we get, we are keeping it stored in a safe at the house.

    Note: We live in San Diego and it is IMPOSSIBLE to get an infopass appointment.  It's so frustrating but 365 days out of the year when I go online to make an appointment it says there's none available.

    So a few months back my husband had his greencard stolen (along with the entire wallet) and since we could not get an infopass appointment we just went down the the office before it closed and luckily someone of importance took pitty on us and answered our questions.

    We asked if we had to file the I-90 to get a new card or if we could just wait until we applied for his conditions to removed.  He said we didn't have to file for the new card and we chose not to because we didn't want to spend the $500 when we knew we would just be applying for the I-751 a few months down the road.  Well, now it's time to apply to remove those conditions but it says we need to send with our application a copy of the greencard front and back.  We never scanned the greencard's back side.  We only have a copy of the front.  Do you think our application for I-751 is going to get denied if we do not send a copy of the back of the card? And now I am reading all of this info saying if you lose the card you HAVE to file for I-90 for a new card but we never did.  Are we going to get in trouble for not filing for a new greencard when his last one was stolen?  That man told us we didn't have to but I don't even know his name and now I am thinking he had no idea what he was talking about.

    If anyone knows or has been in this situation I would really grateful for any insight!  Thank you!

    What really gets to me is that most people ask for a stamp when they have a lost/stolen card during ROC and its a free service and it should be!! The i-90 WILL be cancelled as you have applied for ROC, very doubtful you will get the physical card. You will have to take your i-90 along with your passport and ROC extension letter to get an i55i stamp in your passport.  The i55i allows you to travel, get a driving licence, work etc. (When shown with the ROC extension letter).

     

    None of us would have to worry about this if the USCIS actually sorted out the issuance of cards quicker than current filing times.  Bad enough after losing your card or in my case getting my whole wallet stolen with credit cards, bank cards, driving licence and my GC without being reminded of the traumatic event time and time and time again!  Roll on citizenship and the end to this long journey!

    To Shell20:  I just found your comment in my search for answers.... sounds like I am in a similar situation and I am wondering how it worked out for you.  My husband's greencard (and entire wallet) was stolen very close to the filing window for I-751 so we are waiting until the window to file, but I am seeing that I am required to submit a copy of the greencard front and back side when I file for ROC.  Since the greencard was stolen, we do not have a copy of the back of the card.  Luckily, we had scanned a copy of the front of the card but unfortunately not the back.  When you filed for your ROC, did you have a copy of your greencard to submit?

     

  4. Hi guys, hopefully this is my last question. My green card interview is tomorrow and I do not have a sealed envelope from my doctor because I gave it to the airport security when I entered the country, and my doctor never gave me a copy of the DS-3025. I shouldn't need to fill out the I-693 because I had my medical appointment within one year of filing for AOS. BUT, I am afraid of showing up empty handed. I do not know if the DS-3025 was in the envelope I handed in because it was sealed. I'm confused because airport security took some of the envelope and then handed me some of my vaccination records... they gave me a CD with my chest x-ray and a copy of what vaccines I have but no DS-3025. Will they have that document at my green card interview? Thanks for you help, it is very much appreciated.

  5. Hello! So I am relieved to say that we are nearing the end of the k-1 process as we have just been assigned our interview for my husband's green card. Thank you visa journey for getting us to this point without needing a lawyer! I am just a bit confused about the checklist that the department of homeland security has provided for us to make sure we bring everything to the interview. I guess I'm just being paranoid and nervous because I am afraid of forgetting something. I would appreciate anyone's help who has already gone through this!

    The parts of the document I am confused about is where it says I need...

    "All documentation establishing your eligibility for lawful permanent resident status"
    What does this mean? Why do they bother to list this if they include a list of all of the papers we need? It makes me feel like there are other documents I might need. Does this mean I have to bring the copies of old stuff like the I-129F?

    "Any immigration-related documentation ever issued to you, including EAD, and advance parole (Form-512)"
    We have his EAD combo card but we don't have the letter that came in the mail with the card. Does this mean just his EAD ID combo card? Because I don't have any forms.

    "All travel documents used to enter the US"
    We don't have anything he used to enter the US except for his passport?? When he entered the US on his k-1 they took a whole package from him and never returned it.

    I know that before, they have asked him to bring a lot of stuff to past interviews and they ended up not looking over any of the stuff . In the green card interview do they pretty much just look at our documents and pictures that show we are a legitimate couple or do they look at way old stuff like the I-129f packet and what not?

    Last question,

    My husband and I plan on doing some international travel this year. If the interview goes well and he receives his greencard after the interview, will we be able to travel without having to reapply for advance parole? The green card permits him to leave and come in to the US without needing to constantly renew his AP, correct?

  6. I am just wondering if because now we file these 3 together, we have to wait to receive the AP and EA until after the interview?
    I see that the processing time for the AP is approximately 80 days but I know the other stuff takes longer and I am just wondering if it is going to take longer to get the AP done because I filed all of these things together or if I will be receiving the AP on its own. If anyone knows, please give me your insight! It is very much appreciated : )

  7. Hello everyone! I have tried finding the answer on here but I've seen responses going either way so I'm wondering if there is anyone that is really informed and is certain that can give me the correct information.

    I know that in order for me or my co-sponsor to not be penalized, my husband (who has applied for his AOS/EAD/AP last month) cannot become a "means tested public benefit" or else myself and my co-sponsor risk getting sued.

    I am wondering, if I am eligible for covered California (Obama care), can I apply while we are waiting for his AOS? Will it slow down any the AOS/EAD or AP? We are in a very big rush with the AP and would like to avoid slowing that down.

    And,
    Can HE apply for Covered California while he is waiting?

  8. My husband and I just got married and we are filing for his AOS but we keep coming across questions about the I-94. He never received an I-94 to our knowledge. One question on the application says "I-94 arrival departure record number"
    Where can I find this number or is it possible he does not have one?

    Also, what do they mean when they ask "current USGIS status?" and how do I find when that status expires?

    Then it asks "Place of Last Entry Into the United States" And what was the status when he entered. Is this referring to this last time he entered on the K-1 or are they referring to the last time he visited and left?

    Thanks guys, I would really appreciate your help. I feel like getting through the k-1 process to get him here was more clear but filing for AOS seems more confusing to us.

    So I can't find the answer to my question anywhere. My fiancee is finally here and we are getting married on Friday. We were going to file for the Adjustment of Status on Monday but it says that to apply, we are required to show the OFFICIAL copy of our marriage license. But from what I have read is that the official copy will not arrive in the mail until 2-4 weeks after the wedding. So we cannot apply for the AOS for possibly another month? We are freaking out because we thought we could apply for the AOS and 1-131 (the permission to travel outside the US while being processed) right after we got married. I heard the I-131 can take up to 3 months so we planned for our honeymoon a little over 3 months after our wedding.
    If we have to wait another month to apply for AOS, there's a good chance the I-131 will not get approved before our honeymoon, which we and our family have already invested thousands of dollars in.
    I thought we were being so smart about waiting to do the honeymoon until 3 months after the wedding.

    My questions are...
    Has anyone applied for an AOS with the technically not official marriage certificate they give you on the day of your wedding?
    Has anyone applied for I-131 and can tell me how long it took to get approved?
    **What does the approved I-131 look like and say? We were wondering if he could LEAVE the country before receiving the approved I-131 and since it should be coming at least shortly after our honeymoon, would it be possible for him to stay in the country we are honeymooning in until someone in the US receives his approved I-131 in the mail and sends it to us on our honeymoon so he can enter the country with it? So essentially he would be exiting the country without the I-131 but entering the country with it.

  10. Well, if anyone ever stumbles across this topic because they are looking for an answer... in our case my fiancee was approved. At the interview, he said it looked like the doctor's note was there and may have said something like "one time experimentation" and the person conducting the interview let it slide. Thank God! We are so happy.

  11. I am SO SCARED. I have been up all night on this website and I am just now learning that admitting to having experimented with a drug even one time can result in denial of visa and a one year (or longer) ban!?!!

    How did I never stumble across this before?

    Wouldn't this encourage people to lie? I mean what percentage of adults in the world have experimented with one drug at one time or another? So if people are getting accepted for "not ever doing drugs" then a lot of people are getting accepted for lying.

    At my fiance's medical exam in Sydney, him doing what he thought was the honest thing to do, told the truth about having tried ecstasy one time 6 years ago.

    Now I am reading all of these posts about people getting banned for telling the truth.

    Has anyone admitted to having experimented with a drug and been approved or denied? Please tell me your stories.

    Especially if you have dealt with embassies in Australia, New Zealand or England. Please!

  12. I am self employed and only make $20,000 per year. I submitted COPIES of a few pages of my taxes for the last two years. I only copied the pages that showed my income. Along with it, I submitted a personal statement saying that I am self employed, I only work part time, and at any instant upon my will I can start working extra days to double my income. I also submitted a statement from my bank saying how long my account has been open and that in the last 12 months I have deposited $34,000, and that my current balance is $10,000. Of course I also included the affidavit form filled out.

    I didn't think that would be enough so I also got a co-sponsor. He makes $130,000 per year. I included the filled out and signed affidavit, a copy of his birth certificate, a letter from his HR department saying he has been employed for 10 years and makes over $100,000 per year. I also included 2 pay stubs. I also sent a personal statement from the co-sponsor saying how he is happy to support my fiancee in any way and he's like family and blah blah blah. I did not include copies of his taxes.

    Do you guys think that this will be oaky?

    I am really worried about this step.

    Also, I am wondering what happens if they need any kind of more information at his interview, regarding anything? Does he have to schedule a new interview or can we just mail it to them? How much does this post pone the process? He has to fly to the embassy so it would really be an inconvenience if he needs to attend another interview later on.

  13. This is completely wrong in every way. "Overstay" is not an impediment against Adjustment of Status, and in this case, from the information she has given, she should not have accruewd "unlawful presence" since F-1 people are admitted on "D/S", and thus leaving should not cause problems for getting an immigrant visa outside the US if she decides to go that route.

    Sorry, I misread. What I got from her post was that she came on a student visa, withdrew from school and stayed even though she was violating the student visa terms by dropping out of school. I didn't realize that he was her legal husband in the US, I thought maybe she was just calling him her husband because they were married in another country or something like that.

  14. Well, good luck if you have overstayed your visa... if you ever leave, you might NEVER be able to come back. You really CANNOT over stay a visa... Watch the movie "Like Crazy" ... very accurate. US customs does not take over staying a visa lightly. Now you will have to get lawyers involved and even then, you will not be guaranteed to be allowed back in. You might want to consider having your husband migrate to your country now.

  15. He does not sound like a man that I would want to marry! He doesn't care about you or your child. Don't listen to him! What a jerk. If my partner ever threatened to leave me over something like that, I would say "GOODBYE THEN! I DONT NEED YOU ANYWAYS!" You should never be with someone who cares so little for your well being. Find someone that adores every ounce of your soul and wants to protect you, not put you in danger.

  16. Hopefully this is my last panicked question I have to post to VisaJourney for a while! My fiancee has his interview a week from today. (Yay!) But I have a cosponsor and their HR department took FOREVER to get the letter together so I kept waiting to send him his copy of everything (i-129 copy, new letters of intent, photographs, plane receipts etc.) because its all in one folder so I was just waiting for the affidavit information to send everything away... Now we are a week away from the interview and it won't be ready until Tuesday. (4 business days from the day he flies to Sydney for his interview). Obviously, I am going to send the documents the most expensive, quickest possible way... but it could still arrive too late. In the mean time, I am going to fax him all the documents so he will at least have copies to bring to his interview if the originals have not yet arrived. His police prints may not be ready yet either. They gave us the interview date literally 2 weeks after he submitted his D-160 and we were just not expecting it to be so quick. We asked to reschedule for a later date and they said no. We just weren't prepared for our interview to come up so quickly. Do you think this will be a problem that he will have no original documents? Thanks in advance!

  17. Hey, it's the Aussie Fiance here.. sorry for slack reply, had quite a busy week so far. We actually got our interview date today! 6th of Oct! Such a relief..and surprisingly soon!

    So at my Medical on Monday, I did have to get 2 vaccinations. The doctor was super nice and helpful, we asked a couple of questions, and he explained if there is vaccinations/ boosters that are required and I didn't have them there, the medical doesn't move forward. He said you could submit a compassionate refusal form or something like that, I can't recall exactly what the name of the form was, but that would put the whole case on a different pile and probably extend your wait until your interview. So yeah, it would seem as far as the medical is concerned (in Brisbane anyway) vaccinations are necessary.

    It's probably worth mentioning that it ended up costing us $505 in total for the medical and the 2 additional vaccines, which was kind of surprising as we were originally told that it would cost $485 for the medical, and those vaccinations aren't exactly cheap, we'll post the receipt in our pictures sometime soon if anyone is interested. I did ask if the vaccinations would be cheaper if I had of just gone to a normal GP first, and he said they're the same price everywhere, and it's likely that Medicare (our free health care) wouldn't have covered any costs as this is all a 'lifestyle choice'

    Anyway, that was long winded, but I hope it helps =D

    The consulate we are dealing with is Sydney. I might have clicked something else in error. Thank you SO MUCH for your response. Now we know we can do the vaccinations by another doctor. But I am guessing the medical is still necessary before to do in his home country before the interview? That would be great if we could do the medical in the US!

    He emailed support at USTraveldocs. It honestly seems illegal to me. How can you deny a refund to someone if your system double charged? It's like they purposely make their system unreliable so it charges people twice so that they can then inform the person that "we do not issues refunds." this is the message they wrote back to him.

  19. Oh wow! But have him get the vaccinations elsewhere (or not at all for K-1) and only pay the $600 for the medical exam. Wow!

    Does that mean he doesn't have to get all of his vaccinations before he comes to the US? Could he still get approved at his interview and get the vaccines at a later date? Or even in America?

  20. Ideally, my fiancé and I would rather live in Australia (his country) but the cost of the visa is $7000 vs $2000 for him to come here, so we opted for him to move here. So we THOUGHT the cost for the k-1 would be $2000 for him to come here... it is SO MUCH more. Please everyone, be aware that there are many more expensive hidden costs.

    That cost did not include the cost for the D-160 which was $300. Listen to this though... he filed the D-160 and attempted to pay it online and it said "payment denied" so he tried it again and it said it went through the second time. Later that day while checking his email he noticed that there were two receipts, so he was charged twice. When it said the first payment was denied, the payment went through. So he got charged the $300 twice. He emailed them explaining and they basically said tough luck and that they will not refund any money paid under any circumstances. Isn't this like illegal!?!?!

    So anyways, my very patient finance let it go that they charged him an extra $300.

    Next comes the medical. All health care is free in Australia. Yes, we expected to pay for a medical but they said the cost of his medical would be $600!!! $600 to have a doctor quickly evaluate him!!! THAT PRICE DOES NOT INCLUDE ANY VACCINATIONS HE WILL NEED. With the vaccines factored in to the cost, we can assume that his medical will cost closer to $1,000.

    So this so far is an additional $1600 that we were not planning on paying and we haven't even gotten to the interview step yet.

    We can only assume that there will be many more hidden fees as we move along in the process. What is heartbreaking about this is that if these costs keep adding up they will be close to being as expensive as the Australian visa for me to move there and we preferred to live in Australia anyways, but we went this route because we thought it was so much cheaper.

    Lastly, we received his alien registration number hand written on a document and we seriously thought it was a joke how bad the person's hand writing is. We can not make out like 4 of the numbers. Can not make them out no matter how hard we try!!

    We showed both of our family and friends and no one can make out this persons hand writing. Why on earth would someone not take the time to write clearly on such an important legal document? It is like they are intentionally trying to make this harder on us than it has to be. So they can't issue his medical until after we can provide them with this number but there is no phone number to wherever this document came from. His interview date is coming up. It actually came up too quickly. As soon as he filed the d-160, they issued the interview for 22 days later. He hadn't done his medical yet or his police finger prints. The police finger prints take up to 15 days and the medical says it has to be done at least 3 weeks before the interview, but they gave us the interview date for 3 weeks away. How do they expect that to work? We emailed them asking them for a later interview date and they said no. AHHHH!

  21. Hi the $300+ you paid to USCIS was only for the application for the K1 visa, you still have to pay for the Visa fee and also for the medical fee. Unfortunately one of the downside for the K1 visa is a payment for the AOS fee of $1000+. Check the US embassy website for your beneficiary to see what is needed.

    Hey, thank you for your response! Alright then, now I know that there is still the visa fee and a medical fee. But I am still confused that the ds-160 form must be completed for a k-1 when its not listed on the k-1 flow chart or mentioned anywhere it seems like. Is this step normal?

  22. Hey guys... I'm a bit confused.

    So we have already received our NO2 and today I received an email from the embassy in Sydney Australia about my fiance needing to go to a website and create an account and then email them back. The email says this...

    Dear K Visa Petitioner,

    The U.S. Consulate General in Sydney has received your approved petition. Please have your fiancée create a profile via (...) and email our office at (...) In the email they must advise the following information:

    Name:

    Case number:

    Email address:

    Phone number:

    Passport Number:

    DS-160 confirmation number:

    The thing I am confused about is that there is is nothing mentioning this step or the ds-160 on the k-1 flowchat. In order to get the ds-160 confirmation number my fiance has to fill out the ds-160 online and submit $265. I didn't know that for a k-1 you had to fill out a DS-160.

    I thought when we mailed in the whole k-1 application to the dallas lock box facility that THAT was his application. Now he has to pay again? I know we have to pay like another $1000ish fee for an AOS but I never read anything about having to pay for another step like this. Is this just a step for Australians? We are confused. Any help would be appreciated. My apologies for any ignorance on my behalf. Thanks.
