  1. In my home State of Michigan I filed a mandamus lawsuit against the US Department of State after our case had been in AP 2 years. In Michigan I could act as my own lawyer and the court here gives instructions on how to file one. I was nervous and scared after filing the mandamus because ai didn't know what the outcome would be. Everything happened very quickly after the Department of State got served with the legal papers. Within 2 weeks they made a decision on our case. They denied the visa. It took 2 weeks to get a NOIR that said we were not legally married in Pakistan because I am non-Pakistani Christian married to a Pakistani Muslim. Also we had a very small wedding and his neighbors didn't know he was married. We only had 30 days to respond so I hired an immigration lawyer here in America to research the marriage. Turns out the embassy was wrong and we were legally married. We got letter from his friends and family members saying they knew about the marriage and we sent other things to prove we had an ongoing relationship. USCIS reaffirmed our case within 2 weeks and sent it back to the embassy for another interview. That's where the embassy decided to mess with us again. After all that they put our case back in AP for another 2 years with constant updates. Finally he was asked for a new medical, affidavit of support and more proof of ongoing relationship. His interview was done with 2 people in the room and they screamed at him and told him he was only trying to come to the USA in order to work and send money back to Pakistan. He stayed calm and answered all their questions. In the end they said he would get his visa but only because they could tell his wife really loved him.

    The mandamus worked for us. I don't know if it would work for everybody. In many states you have to hire a lawyer to file it and that can be expensive. I was lucky to be able to do it myself and not have to spend one day in court.

  2. I Practically had tears in my eyes after reading your story!! I can not do anything but pray! :cry2: These people can be so heartless

    But you should either go for some sort of lawsuit or try to apply from some other embassy as Russia etc

    well my category is IR-1/CR-1 spouse visa and until this case finish i can not apply from any other embassy

    and yes i am thinking about lawsuit.....but some says its useless some says it is good.

  3. I am so sorry for your suffering. There is only one good thing I can tell you. Because you are married your petition at the embassy will not expire. I had a dear friend who was in AP 4 years waiting for a fiance visa and his petition expired so they had to get married and start all over again. He left Pakistan and went through the American Embassy in Russia. After 2 more years of AP there he got his visa and is with his wife. He has been in the USA 2 months now. I wish I could tell you and your wife why it has taken so many years. That is something you will never find out. They will just ask for updated medical, proof that you are still married such as emails, phone logs and such and maybe a new affidavit of support. When they request these documents you can be almost sure they will issue the visa. It took me 4 years to get my husband's visa from that embassy. I understand your pain. All you can do at this point is live your life with your wife with love and understanding. I believe God will replace the years stolen from us by giving us a longer life span to spend our old age together.

    you know what.... for me this news... petition will not expire is a drawback .......... because embassy says they can not predict time limit......

    we have already lost almost 8 years to get USA visa .......... almost 5 years in administrative processing....... still embassy says they can not do anything.

    they can not predict about time frame... so what does it mean ??? have to wait whole life ???? how many years 10 , 20 30 50 years ???

    i wish they can say your case is expire and apply again ......... i want some action on my case ....... they are just doing torture .......... because

    in last 5 years they didn't ask for new medical, new affidavit of support or any other document..... no objection on any thing...........

  4. At the interview did they keep ur passport. You need to get help congressman something its to long really. I have been waiting six monthes and i feel sick and worried everyday get help you need to

    yes after interview they kept my passport and said your case seems ok and you will get your visa one to six months.

    after an year i got back my passport as i had to visit uae.

    We have contacted senator and congressman etc. but all useless as yet...

    Please pray for me ........... I am in administrative processing since last 4 years and 9th months........... overall case duration 8th year.....

    only one interview one medical nothing else. for almost last 5 years us embassy Islamabad did not ask for any thing

    not even did objection on any thing ....... interview was good. every thing ok as per CO reply and embassy reply by mail but in administrative procession

    since 4 years and 9th months.

    our marriage is arranged. families are in same city and are family friends.

    my wife checked with homeland security and other departments in USA they said case is in us embassy Islamabad.

    us embassy Islamabad last mail reply was that... yes case is with us but we can not do any thing until administrative processing finish and can not give you time frame ......

    when this hell of administrative processing will end ?????????

    we have already lost 8 golden years of our lives and us embassy still says they can not predict about administrative processing time frame.

    should we wait whole life ???? i have a daughter she is 3 years and 7th months...

    I and my wife spoke to many lawyers regarding administrative processing issue............. some says go for mandamus some says its useless

    waste of money and time and the answer will remain same that your case in administrative processing and is in US Embassy Islamabad ,no body can do any action etc.

    I request to all of you please remember me in your prayers as we are very very upset and tense and in a painfull life.

  6. congratulations!!!!! to all of you who got their visas!!!!!!!!!!!

    remember me in your prayers ........... i am in administrative processing for last 4 and half years.

    interview was good, CO said you will get your visa within one to six month, every thing seems ok .

    only one interview, one medical and from interview day to till now embassy didn't ask for any thing, not even objection for any thing.

    for last few years they don't even bother to update my visa status,,,,,,,,,,, until I send them a inquiry mail

    and most of the time they don't bother to reply or even update the status,

    .......... this is called routine administrative processing which destroyed our routine life ...

    God please guide them to stop playing with people lives. ameen!!!.


  7. No went from refused to AP then ready only few days after 2nd interview and today this horror status of expiring soon. If someone reading this and experienced then kindly share ur experience

    Don't worry this expiring soon status is nothing, just send a email to embassy or wait one week it will be back to administrative process again.

    this is what happens after an year of completion of administrative process, as per my observation and experienced.

    I have seen my status of expiring soon in first consecutive 3 years of administrative process.

  9. salam dear all, i need opinion from u guys

    its been over 4 months since my interview

    i was in AP for last 3 months and since 1 month the CEAC status says refused

    i got few emails from embassy saying i am still in AP ,even CEAC status says its refused.

    i asked them through email why it says through embassy e-mail that i am in AP & CEAC says refused. ,they replied that its in AP and until AP is over they will not be able to contact me or review this further, until AP is complete

    they never answer why its refused and in AP at the same time

    rather they said its in AP ,its confusing for us to understand where we are in this process.

    DOS dont have any information ,they have the last update in early december saying its in AP.they dont have any updates( if its refused) as it says AP in their system...and its been over a month since CEAC says its refused.

    embassy have my passport,since the day of my interview ,,thats nearly 4 months,they never ask to submit any docs.

    my senator enquirer when i was refused thats last month asking why i am refused, but he got standard reply saying i m in AP ,without explaining any reason of refusal

    i want you through light , how im in AP if i am refused,does any one else experience the same thing?? any thoughts would be appreciated

    what i should be doing ..??next step

    whatever you said its just temporary refusal of 221g due to administrative process only.

    just be calm and relax nothing wrong in it.

    just do one thing keep mailing embassy after few days regarding case update.

    they have your passport and they have sent you mail that your case is in AP, you dont need to be worry or confuse , just follow the email of embassy.

    for last many years on ceac website case status were showing "administrative processing? but for last few weeks i have heard few cases they putted status as refused not as administrative processing.

    just pray pray and pray and keep remember me in your prayers as well, thanks

    You people in the government throw the word entitlement around like it was a sword. He never said he felt entitled to anything only that he has been going through the visa process for 7 years and 4 of those years has been spent in AP without knowing why. Not everyone has the money to travel to Pakistan to visit their loved ones and must make do with skype and phone calls.

    It took me 4 years to bring my own husband to the United States due to an error on the embassy's part. They thought they knew the marriage laws of Pakistan and I had to spend large sums of money on an attorney to prove them wrong.

    Sometimes it is best to just shut up and let a person express their feelings without comment. You say the security of the United States comes first yet we have Syrians here that did not go through years of AP. The embassy in Islamabad represents America at her worst. You can defend those who work there if you want but do not attack a man who has watched countless others get their visas while he is in Pakistan suffering.

    first of all sorry for this late reply and thanks for your speech but whatever you said ....every one knows........ nothing new......

    rules should be follow ......right said .......like embassy asked me about my original birth certificate even i already submitted that but as per their saying

    i got a duplicate and funny thing is that at the time of interview they have returned me documents with my original birth certificate :) yea u r right rules should be follow :)

    here in this visa journey last year one of the guy got his visa and visa issue date was 3rd January 2014 and expiry date was 2nd January 2014 ........ this is what they follow rules :)..........

    lot of examples u will see here ...........from dedicated people who follow rules

    in this whole process my case not being update many many months ?? well there is no justification for delaying the case even this is 7 year plus........

    God knows for last 7 years they are following what type of so called rules ............ but justice delay is justice denied....

    no doubt embassy people are so nice and gentle at least if i compare them with Pakistani embassy people......

    and yes about red flags ..... Alhamdulillah i have no criminal or fraud record , my wedding was arranged and my family keep visiting me back and forth but as a matter of fact this really not easy for us to afford.

  12. Here is the email they just sent to me they say it's in Ap but it also still say Refuse on the immigrant status. I'm so confuse!!?? can you pls explain?

    Please refer to our email of 20 January 2016. This email indicates that administrative processing is still ongoing in your case. Until administrative processing is finished, we will not be in a position to contact you or review this case further. We cannot take any action on your case until administrative processing is complete.

    dont be worry, its 221g temporary denial by counselor officer, which is called administrative processing.

    they put every one on that after interview but some get visa in days some in years.

    but now a days for all new applicants, they are finishing this process in days, as per my observation.

    so dont be worry its not denial its just normal thing .... as carolyn mentioned too.

  13. I really hope you get it soon, 7 years is a bit too long. Did you try getting in touch with the congressmen or a lawyer?

    Keep us updated on your status, hopefully we'll heard the good news soon

    yea we are in touch with congressman and senator etc. but up till now no good news.

    Can you please elaborate it.This process sometimes seems fishy fishy to me. There is no set pattern I have found about the IR1.

  14. My wife had her interview on the 21st of Jan 2016. The CO didn't ask many questions and didn't congratulate after the interview either. He said 3-4 weeks. My wife asked her if the application was approved and he said Yes. I checked CEAC and its on AP. Status updates on 21, 22,25 and 27th Jan. Still in AP. Any one else having the same experience? This is making me nervous. :(

  15. Seems like everyone's visa apps moving right along!! Hopefully those who are waiting would hear the good news soon. A while back I ran into a colleague who is posted in Islamabad. Understand that an exceptional group of extremely dedicated people is working on your files!!

    I hope whatever you said is true ........ but as far as I see ... nothing is change , 4 years and 5th months in Administrative processing, no objection,

    never asked for any additional document, interview was good and as per CO, every thing is fine and you will get your visa one to six months.

    Total case duration is 7 years plus....... case is IR1/CR1.........

    I have an american born 3 years and 2 moths daughter and she asked her mother many times in a day , baba kab aye gey........

    when she talks to me on skype she says baba aap ka visa agaya hay ab ajaoo na ........

    first me and wife suffered and now our baby girl suffering due to this administrative processing...........

    who will bring back my last 7 years ??? who is answerable for whatever we as a family facing???? due to this visa.

    Alhamdulillah I have clear record , they have my number, address come and check about me , my parents ....my family background

    come and check each and every thing.......... but please finish this so called pain full "administrative processing".

  16. It took 3 interviews, 2 field investigations and 4 years before my husband got his visa. Do not lose hope. I know another couple that are still waiting after 6 years. Karachi_Guy I do not understand why there have been no updates on your case but believe me the embassy has not forgotten about you and at some point will begin work on your case. To them the years they make us wait are nothing. You still have every chance of getting your visa. Continue to pray for it. That is all anyone can do.

    Carolyn, thanks for all you said, but desperate thing is that my immigration process started in 2009 and i got interview call in September 2011.

    since my interview to date embassy did not do any action , embassy did not ask for any thing as yet, not called for any other interview, no field investigation,

    from day first to as yet one reply, your case in admin process ....normal process, nothing wrong, etc. etc.

    At least in last few years they should show some action on my case?? isn't it??? even since last 2 years they dont even bother to reply emails.

    if some time they reply then case update and then forget and stop.

    I am very tired and desperate now, if they dont want me to give visa at least they should reject me but putting me in this waiting phase, its just killing me day by day....

    Can you tell us any RED FLAGS regarding your case

    brother, well red flags i found only is that i am pakistani, my first and last name shahzad and khan a red flag even i am not a pathan,

    red flag is that i am from karachi as karachi have not good reputation and red flag is that after all these things i dont have criminal record (Alhamdulillah),

    after all those red flags i dont have bank or any other fraud Alhamdulillah and yes Alhamdulillah in my area i have good a reputation,

    otherwise my case is in this immigration process since 2009 and no objection, at the time of interview CO said every thing ok,

    no issue no objection. arranged marriage,there was not a single tiny issue so its been now 4 years and 3 months i am in plain AP.

    They did not ask for any additional thing.

    Specially for last 2 years they only update my case if they get inquire by me or my wife or senator or congressman. thats it.

    yesterday i got case update as usual due to my wife email inquiry and reply mail text was same.

    so this is called "Administrative Processing" A NORMAL PROCEDURE.......

    Alhamdulillah finally Issued! Went from ready to AP for 2 days and now issued. Thanksgiving delayed things after his fingerprints/oath.

    Congratulations and pray for rest of us who are bearing this hell AP. thanks.

    What do you mean by NO update.. Its 3.4 years. Are you saying you were not updated the whole time.Correct me if I am wrong

    yeah if i say for last 2 years only they updated if some one contacted from us or congressman or senator even

    mostly they don't bother to reply.

    in last 4 years and 3 months they never asked for any additional document or new medical etc.

    the last quickest updates I saw only in November 20th 2013 till December 17, 2013 , around 13 updates and after that it

    seems they putted my case in some where in backyard.
