  1. Ok..so to give you a bit more information...

    ...The guy that interviewed her told her that once she submitted the materials, he would contact her.

    Now, after thinking about this, I'm wondering if she interpreted it as a 2nd interview, when that isnt what was implied. The paper she was given was literally a copy of the things you bring with you that she HAD brought..(I-134, birth cert, all that stuff, and then a few items to RFE)

    The thing is, they DIDNT keep her passport at the first interview, so it seems that no matter what happens, if there was going to be an approval after reviewing the stuff, that she'd have to go back right? Or would they request she courier the passport in at a later date?

    The information requested was additional evidence of our relationship prior to engagement and copy of previous passport/I-94 regarding the time she was denied entry at POE for unathorized work. We had checked that there was no ban on her or anything for that (voluntary departure...application withdrawn) so perhaps they wanted her to help them review quicker any possibility that she'd need a waiver based on that trip...but no waiver was mentioned at all during first interview. What was really going on whas the officer was atleast making her feel like that previous trip was signifying that our engagement was for immigration purposes, which of course is not.

    So...I guess then we wait to see what type of notice they provide to us....whether it IS actually another appointment, or if it is documentation. I guess the best case scenario would be a request to courier the passport in cuz its been approved!!!! Praying for that!!!!

    Does any of this help any of you see where this might be going?

  2. Hi...we are waiting to hear back about when our second interview will be after responding to an RFE from the first interview.

    Has anyone else had to go back for a 2nd interview? How long after you submitted RFE materials via the courier provided were you notified of its date? I know there is a 4 month legal time frame from when I-129F is approved and for when visa has to be issued..and that is quickly approaching...

    Also..if anyone HAS had to go to a second interview to discuss RFE (proof of relationship et al.)...how did it go? Same person? Similar questions? Deeper questions? Longer? Shorter?

    Trying to give my fiance some peace of mind and any shared experiences would be really helpful!

    He said that it is probably under review because she did not disclose the nature of her previous visit with the I-156 because it was a tourist vist, but she had worked. That they are required to prompt a second interview because of this to further explore the possibility that that is the reason she is reapplying for another visa. This was noted to me by someone else on VJ as well. I'm not sure who here may have actually had a second interview scheduled as opposed to just sumbitting the requested evidence while the passport was still being held at the consulate. It seems almost as if a redo...like...ok...the first interview did not satisfy the concerns/investigaton he needed to disregard this red flag...

    She left with her evidence, passport etc....including original birth docs and such.

    They made copies of them.

    She was told to courier back the requested stuff (it was on a checklist of materials that included the I-134 etc of which she obviously had at the interview). The RFE was for additional evidence prior to the engagement...of which we have sent back via the embassy courier they gave us.

    She was told that she would be scheduled a second interview.

    I dont know if this is a guaranteed action or not, or only if she satisfies the RFE to remove any doubt.

  5. Her previous visit was 2 years ago.

    She had left, and returned to enter after a few months and when she got to POE, was stopped for this very reason. She was given voluntary departure...no deportation or anything like that. They spoke about that at the interview too...what happened at POE. (she was on a 10 year tourist visa at the time btw). Our lawyer said that because of the voluntary departure, that she was absolutely 'eligible' for a new visa of any kind, including tourist technically...

    I know that infractions on previous visas is a huge red flag for interviewers, of which we clearly had one...but in light of not hiding it, addressing it, and trying to prove our case....I'm hoping that it is does NOT make her ineligible for the K1. I dont know...

    Let me re-phrase and try again - how much time between submitting the material and the start of the interview?

    Enough time for the interviewer to have glanced at the material? Maybe even enough time to have looked through it, and decide on the issues that they wanted to probe during the interview?

    From what she told me, the entire thing took about hour and half...between submitting the I-134, all that stuff, and the actual going through the interview process to leaving the embassy. They were separate transactions...one person took all the official documents and a different person did the interview. Apparently the first was very nice. She had a very early morning appointment. 9am.

    Yes..from what i understand..there was a bit of time delay between handing in the materials and going into the interview...but not much. 30 minutes maybe, though I suppose that is enough. It did seem that the interviewer had a pretty clear direction in which to take in questioning....most of the questions were concerning the previous visit to the US in which she had worked. Questions such as where did she live at that time, how much was made, who were the other people living there, how did she pay for it all (since it wasnt a living income obviously)...and kept reminding her that 'that was illegal'...which she did not question or deny. So, I do believe that possibly the interviewer had determined what he was going to probe about to question the case a bit in advance, as otherwise, I dont think anything stood out as unusual.

    But of course the binder of evidence that she brought with her..which included a copy of the original I-129f and additional materials, plus the originals of that in the petition, were made available to the interviewer on the spot. Like I mentioned...he did not go through it very thoroughly...the additional pics, correspondace, etc.

    I'm hoping that this isnt a lost case, in that her willingness to admit and accept the previous visit, and continuially provide all proof she can or our legite relationship will make its case as a non denial. I dont know what technicalities this would or wouldnt involve for a denial, other than the subjectivity of the interviewer.

    any thoughts?

  8. Oh..i should probably add...so anyone who might know can help...

    the form given said that the visa petition was 'suspended' until the recieved the stuff (RFE).

    I hope that we are contacted soon about what the next course of action is.

    I cant believe this is happening. We are sending back everything we can muster up of relationship evidence, though apparently the guy didnt even look at the photos or hard copies of cards and stuff at the interview. The only thing that gives me hope is that we were not given a denial, intent of denial, or anything like that...

    ...just a horrible treatment and intimidation.

    ...my fiance is so scared to have to go through this again, but I dont even know to tell her if she'd have to go for a second interview, or just get info in the post...I have NO idea how to help anymore....or atleast tell her what to expect. AHHHHHHHH!!!!!

    yeah..thats true...perhaps my wording was wrong...

    ...the evidence of our relationship...to prove this is not a fraud marriage for immigration benefits...I guess that is more accurate.

    Do they get back to you soon? Do you have to go in for a second interview?

  12. This is probably a really dumb set of questions...but...

    ...I have spent so much time in the other forums...just leading up to our foreign consulate interview, and am just now beginning to grasp what to do once my fiance arrives...I was wondering, if someone could help me with a few basics I would like to understand to go forward with confidence....

    First:

    ...If we file our EAD and AOS together, do they get approved separately?

    ...as in, will she likely get her EAD and be able to work while we wait for the AOS to finalize?

    Second:

    ...What exactly does a biometrics entail? Is it just processing? fingerprints and such? or is it interview?

    ...Is there a separate biometric for EAD and AOS?

    Third:

    ...When we have the AOS interview, we both go right? Thats when they confirm we have been legitimately married and all that? And then her greencard is good for 2 years right?...until she reaplies for a lift on that?

    Finally:

    ...Assuming I got the above right...once she gets the first greencard, how long does it usually take for the next step...the more permanent residency to go through? I'm assuming under 2 years since the first runs out in that time....

    I have been browsing through the timelines, and info here, and I 'THINK' I have a grasp, but if anyone could clarify very simply these questions, I would be very grateful...and ready to join you with the finer details and experience of our own case as it unrolls! THANKS SO MUCH!

    When we emailed we both just got automated responses...the whole "this is automated, dont write here if you havent been directed to, if you need to it will be answered in order it was recieved"...all that.

    So...if you call the number, you dont have to go on hold for super long time?

    I know we're probably over shooting this..just that everyone seems to have gotten a date already.

    We didnt have any changes or anything unusual for our Packet 3, and our medical was a week ago. My fiance called and they told her that they HAD sent the medical. Ah well..we'll see I guess.

    Then again..i DO see that some people who sent in their packet just a few days before us JUST got their packet 4..wich gives me hope. But hey, for those of you who dont have a P4 recieved listed....how did you find out? Was it thru email? Phone? What was the turn around?

    Good luck to you...hope we both get a Packet 4 or an email soon!!!!!!

    Thats correct right? How did you get your date? Packet 4? Were they fast about emailing?

    ....and if we call...will we def be able to get thru...eventually?

    I've heard people have had trouble with the phone system, besides the fact that it cost a ridiculous fortune.

    I'm sure we are just being too anxious and the info is on its way.....

    Oh I just want to know the date!!!!!! ;)

  15. No interview date yet...

    ...I dont know whats going on..its been like 3 weeks since we sent in Packet 3.

    We have both emailed the embassy and so far just the automated response back after a few hours.

    My fiance sent her first email like 10 days ago.

    No packet 4 either.

    Should we be concerned???? I am feeling concerned...or perhaps just anxious...

  16. My fiance wants/needs to get a letter from doctor about medication she is on for anxiety to take to the medical. We understand that they will ask her questions about being treated for mental health, etc, so would rather come in with something than have to go get something.

    My question is, is it ok for the doctor to produce a simple business style letter stating the medication she is on, why she is on it, and that the condition is not serious, etc, and have the doc sign it whatever? This would be more helpful for us than getting some sort of offical hospital or NHS document, cuz they told us they could not prepare that in time for our medical.

    I'm curious as to what anyone has brought with them, or perhaps been asked to produce for such a situation. I could prepare a great template letter that the doctor could simply approve and sign! What do you think???

    I am routing for you...hope everything gets sorted soon.

    It sounds like a burden, but I'm sure you'll be fine cuz it doesn seem like your fiance is ultimately inelligible for any immigration rights. I'll be watching your case to see what happens!

    I have a question for you...my fiance's medical is coming up in about 2 weeks time in London also.

    She got some meds for panic disorder (well...was having some panic attacks) which a doctor at NHS prescribed. The doc said was just stress/anxiety induced..that she was totally healthy...she has never seen a formal pyschiatrist or psychologist..just the GP at NHS

    ...When/Will this come up? I know they'll probably ask if they are being treated during the questionaire part with the doctor. It seems like a minor issue, but do you think we better get a statement from the doctor who prescribed the meds (which were only for short term - but she is still taking)....or will it be ok just to explain?

    We wont lie and say "no, never seen a doctor for anything".....

    I know this case is probably minor, but we're nervous and you seem to be the closest person in the boat to us.

  18. My fiance has the packet...not me.

    She is perpetually confused.

    From what I can tell, the packet says...make appointment with case number and bring medical and vaccination history with you.

    Which led me to my question as to how detailed a medical history people brought.

    I have nothing to go by....so any suggestions I can pass on to my fiance from someone who ACTUALLY attended a medical is what I'm looking for.
