    I just don't know whom to ask since the officer said that I could apply for my husband too after I explain the whole situation.

    I just want to make sure that our co-sponsor not gonna have an effect from my action.

  2. Hi guys,

     

    My husband came here with spouse visa. We using a co-sponsor and signed that he wouldn't be using any government benefits. I was just wondering If me and my 4 year old son can apply for food stamp since we both us citizen. (Apply for 2 household members instead of 3) I just want to make sure that nothing will have an effect to our co-sponsor. ( My husband already apply for a citizenship, but due to covid the process taking much longer.)

    My family live in Thailand and wanted to come to see my baby with the tourist visa. ( I gave birth in Dec 2017)

     

    I was wondering if I need to write an invitation letter for them? Also my sister doesn’t work right now but she needs to bring my mom and dad here however she’ve been to US as a student and never overstay. She also studied and traveled abroad a lot and never overstayed. (Europe & Asia) I was wonder if that would be an issue. If my parent plan on being here for 1mth.. Is it ok to leave earlier since my sister can only stay for 2 wks. Can we change the date of staying during an interview?

  4. Hi guys!!

     

    I'm a USC. My husband just arrived in USA with an IR1-DCF. (We used a co-sponsor.) He still looking for a job and I'm about 7 mths pregnant.

     

    I was just wondering If I apply for food stamps, will it have any affect to our co-sponsor or my husband? (To get a citizenship) I really don't want to do this but I can't work much and my husband didn't start working yet. Any income would help us a lot!!

    Nothing is ever quick, but at least you aren't going through the 12-14 month wait most spouses have to go through.

    Hopefully we're at the very end of the process since the case is filed for over 2 yrs already Lol It would be better for me and the baby to have some support from my husband asap :)

    @Coco8 True, but typically emergency medicaid is available for LPRs since it is not a means tested benefit (versus regular Medicaid, which is). That usually covers a good portion of pregnancy and child birthing costs.

    Thank u so much geowrian :) Yes, we have a joint sponsor since I was in Thailand and we thought we would come to US together. However the lawyer suggested me to come over here first as a prove of domicile.

     

    We've been told that it shouldn't take that long after I arrived to US. However it've been over 2 mths since I got here and just recently found out that I pregnant.

    It's not so easy to be alone while pregnant so my friend suggests me to apply for WIC and other benefits from the government. I was not sure so I didn't apply for anything but Medicaid since I need to see the Obgyn. 

     

    I also asked my lawyer and he never give me a clear answer Lol 

     

  8. Hi everybody,

     

    I'm a USC. We filed for CR1 DCF in Bangkok, Thailand. 

     

    After my husband went for an interview. The consular've been requested for more documents and we sent it back. ( Form I-864 has expired so we submitted the new one and prove of domicile so I moved back to US) Now It've been about 2 weeks and we didn't hear anything from them.

     

    We checked on our case from the website and it said that it've been in proceeding and can take up to 60 days.

     

    The lawyer said that was a good sign that they didn't request anymore stuff because normally we'll hear from them within a week. Could you pls tell me how long does it takes before they send the passport back? Do they need to send all the documents to get approve from US. I've no idea how the process work. Are they checking on all the documents that we submitted? Thanks so much!!!!!!!

    If you're currently unemployed, it's not an issue if you have a co-sponsor to cover everything. Just write a letter explaining your situation and why you haven't filed taxes. Looks like you have a lot of evidence for proof of domicile so that shouldn't be an issue.

    More evidence that I didn't submit including the car that I just brought. Also I just received my driver license because I  transfered my driver license so I've shown them a temporary one.

     

    I've filled all my taxes even though I didn't have any income for the past 3 years. The only thing that I didn't do is write a letter explaining why I didn't have a job however I just moved back about 3 weeks when I submit all the paperwork.

     

    Right now we're waiting for the answer. Please advise if anything else  that we can do ? Thank you so much once again!!!

  11. Hi guys,

     

    I would need an advice from you guys about my CR1 DCF in Thailand. I'm an American citizen and try to bring my husband to US.

     

    After summited all the documents, the consular said that I need the prove of domicile so I move back to USA. I was living in Thailand for the past 3 years. Now it's my 3rd weeks that I moved back to US.

     

    Since I got back, I showed the consular that the lease on an apartment. I registered the vote. I transfer my driver license to the State that I moved to. I showed that I brought extra funds over and open a new bank account. I also show that I got 3 credit cards from 2 different companies. Since we have a co-sponsor, do I need to show that I have a job and also my income?

  12. I hope you will come back to V J to let us know what took place about domicile issue.

    My husband also used a friends address . There wasn't one question about this subject. Nothing wrong with being prepared

    I don't think you will have a problem because as a U S citizen petitioning for a husbands visa its pretty clear you will be domiciled in the USA.

    When everything is all good, I'll definitely let's you guys know how it works. I think my case would be a good example for others.

  13. Then you will not need it for domicile as you could use your friend address you also have a bank account to use to help prove. An address and a bank account in the usa is pretty good. I think you should sell the land here, I think you could get more. Of course I am just assuming as I do not know what type of land you have here or in Thailand

  14. undeveloped land has an address. It may only be it's lot number but in reality when you buy a home, you buy the land and all developments upon it. That's why on a title or when you make an offer for a home it includes this lot number.

    You can use this land as an asset. It needs to be appraised and any money you owe on it (mortgage) subtracted from the appraisal value, and that is how much you have in assets. Assets do NOT have to be liquid but they must be able to be made liquid within a year. You cannot use the home you reside in or your only car but everything else if fair game including 401k etc... Some assets are easier to prove than others. Foreign assets are much harder to use than domestic.

    Thank you NLR. I'll see what will be the best option for us since I have to change it to my name and get it appraised. Is it better to sell it? I got this piece of land from a tax auction. I did a mistake on biting on my friend's number. I thought that I won't be in US to take care of the paperwork mind as well bit on his name. I've been doing this for the past 4 years and never got anything but the interest Lol

  15. I had heard you could delay the process a little. I do not know for sure as I am going thru this process to. the only difference I am not doing DCF

    Is there a reason you do not want to sell your land here/ It seems you might get more for it ,and maybe use a friend or family address

    I would love to sell my land in US. The only reason I want to keep it is to show the Consular that I have some assets for Domicile or for Affidavit of support. If it's not going to help in both cases, I'll put it for sell asap. I'm using my friend's address since I already changed my driver license to her address. Also my mail is going to her place.

  16. There are many U S citizens that lived in Thailand long enough to file DCF. That means they have a situation similar to yours. Problem of domicile , income & ability to support proving that its possible to overcome the problems. Each one of those cases were unique as is yours.

    Your plan shouldn't be too hard to determine once you begin. I assume the idea is to travel together to the USA. I suggest you begin the plan based on the interview date or something close to that. Explain briefly how you will begin life in the USA such as where you will live, probable employment ect. Explain what your husband will do to begin his new life. Include a budget based on your income. If he is going to go to school indicate where. His possible job prospects, research he has done into this.

    You may or may not have this domicile problem. Keep in mind that your land has a U S address. I don't suppose anyone except you knows what is on that land at that address. Why bring it up?

    Yes, our plan is going back together. Thanks for all the guidelines. I'll start working on this now.
