  1. Hi!

So my fiancé got approved today at his interview at the London embassy. He completed his medical before the interview and he was missing 3 vaccines (MMR, flu, and tetanus). They didn't give it to him there because he's allergic to penicillin so they said to get it after the medical. Now we're finally reading that although they told him in the medical that it'd be fine to get the shots later that we don't really understand what happens from here.

We know we need to get the shots he needs and then have the records certified by a civil surgeon, but how does that work when submitting our AOS packet? I am under the impression that the form I-693 is in a sealed envelope that he gives to immigration at his POE. Do we submit an entirely new I-693 in our AOS packet?

Thanks for any/all help you can give us!

  2. Hi all! My fiancé and I are currently waiting on his passport, and it probably won't be here until the middle to end of April which will put us in dangerous territory of going past the expiration date on our petition (5/19/15). How does this part work? I'm hoping it'll all be ready and we'll have our interview before then, but what should we do preventatively? I have heard something like submitting another letter of intent from the petitioner. So can I just send my fiancé (the beneficiary) a letter of intent without a typed date and sign it and he can date it closer to our interview? We are at the London embassy. Thank you in advance!!

  3. Hi!

    I have a question about Form I-134:

I make well over the poverty line now, but as of my tax return I was not making enough. On the VJ guide it says that I should just supply 2 proofs of income (i.e. paystubs, letter from my employer). On the USCIS instructions for Form I-134 it states

Submit in duplicate evidence of income and resources, as appropriate:

    A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account:

    1. Date account opened;
    2. Total amount deposited for the past year; and 3. Present balance.

    B. Statement(s) from your employer on business stationery showing:

    1. Date and nature of employment;
    2. Salary paid; and
    3. Whether the position is temporary or permanent.

    C. If self-employed:
    1. Copy of last income tax return filed; or 2. Report of commercial rating concern.

    Form I-134 Instructions 02/19/14 Y Page 1

    D. List containing serial numbers and denominations of bonds and name of record owner(s).

So from this information it sounds like a tax return isn't required or even suggested, right?

So therefore I would just need the following as evidence (since I am not self employed and without a bond):

    1. Bank statement with date acct opened, total deposits for past year, and present balance

    2. Employer statement

    Is that correct?

  5. Hi! My fiancé looked into the medical stuff a bit more and found this information:

    http://www.uscis.gov/sites/default/files/files/form/i-693instr.pdf

It looks like for the AOS there is a huge list of vaccines and I'm wondering, do we need all of those for AOS? If so, shouldn't the beneficiaries be working on that now before they get to their medical? Is there some kind of exemption based on where you're immigrating from?

  6. Our NOA2 was sent electronically on 1/20. We're working on renewing passport, birth certificate, affidavit, etc. right now, but I want to make sure we're staying on top of the NVC stuff because it sounds like it's going to take awhile since we got approved through CSC.

How do you know when NVC receives your case (and therefore when the 35 days starts)?

  7. Hi! My fiancé and I just received our NOA2! We are in the process of collecting documents for Packet 3, and have a question about the passport.

His passport expires on November 1st, 2015 and we are aware that the passport must not expire at least 8 mos. before you get the visa.

He is traveling abroad to Bucharest and needs a passport on 2/20 and since it's more then 6 weeks away from when he's applying for a new passport we're worried about him getting it back in time to travel. We're wondering what the best option is so that he can have a passport to travel and also have a current passport for the visa process. We will most likely get packet 3 by 2/21 and get our interview by 4/21. Here are our questions:

    1) Is a passport required when submitting documents with packet 3?

    2) What is the best option to get this process done the quickest?

  8. I seem to recall folks receiving 2 RFEs before being denied???

If that is the case, and if that was your first RFE,

should that becomes an issue, then you might get a second RFE.

    Someone can correct me...

Yes that was my first RFE. Does it make a difference if it's a RFE for a specific form that wasn't originally included and then when I did include it, it didn't have an original signature? Does that count as 2 RFEs for the same thing?

  9. Oh phew! I was worried! Thinking a RFE is the least of your worries. I think you guys should be fine

Thank you! I appreciate the positive thoughts! This process is enough to make anyone go crazy, especially people missing the people they want to spend the rest of their lives with!

What do you mean by "thinking a RFE is the least of your worries?"

  10. I would not worry about the original signature thing. That's a topic of great debate on VJ (or has been in the past). I submitted copies for almost all my documents. No RFE and received our NOA2.

    What was the RFE for?

And from what i've gathered on this forum, they don't take forever to respond to your RFE reply.

In other words, I think you should be OK. Have you heard of cases of being denied to providing copies and not originals?

Thank you for your words of encouragement!

I got a reply to another post about this and I got very discouraged. Our original RFE was for all evidence unfortunately. We are both very careful, meticulous people but for some reason we did NOT do sufficient research by any means and read only read one site online that said to send in the papers and then they'd request the evidence later. So they had a LOT of evidence to go through on this RFE.

Sorry your profile confused me, it says you guys were married and then submitted a i129f?

Haha no! Sorry for the confusion. I'll go and change that now. We are planning a wedding on August 16. Wishful thinking I suppose :)

  11. I made a terrible realization yesterday that the forms I submitted for my RFE were all copies (because our original 129-f package got lost) and therefore didn't have the original signatures. I am terrified that we're going to get straight denied because we didn't response adequately to the RFE. But, what I'm most afraid of is waiting forever just to get denied and then have to start the process all over. At this point I have prepared a new, better, more detailed and very correct package that is just waiting to be sent. What should we do so that my fiancé can get here as soon as possible????

Here are the options as I see them:

    1. Wait to hear from USCIS. We were told we'd at least get a case update by March 7, 2015 and we would (hopefully) know by then if we were going to get denied, get another RFE, or that they didn't notice or didn't mind that the signature is a copy.

    2. Withdraw our petition for alien fiancé and refile as soon as possible. However, I don't know how long this process will take to process the withdrawal.

What experience do people have with this situation? What should we do? I am distraught :(

  12. Agh

So I sent in my response to an RFE with all of my papers and originals of evidence and then it got lost. I sent in the copy of all of the originals of documents as the response again before the deadline and I am now realizing that all of the signatures will now be copies. Am I going to get another RFE?? Has anybody had any experience with this??

We originally filed 11/14/14 and we have been planning for our wedding to be 8/16/15. I am getting more worried every day about making this deadline. What do you guys think? Should we move our wedding? Will it all be done by then?

Please let me know what your thoughts are :(

I appreciate all of your help!

  13. Yes eight hours is a killer! We met in June 2013 and have been trying to spend as much time together as possible ever since! We met at a summer camp also haha :) But I do love Oregon and I think I will like living here (if I get my visa!)

It is so great to talk to another fiancee that's dealing with this crazy time difference and a fiancé from summer camp! Jack and I would have done long distance for much longer, but we were both very ready to get married and be in the same place. I can't imagine doing this distance for longer than a couple of months at a time! When have you found to be the best time to Skype? We usually Skype when he wakes up in the morning (around 10:45 pm my time) and when I get off of work (around midnight his time). We are both feeling pretty sleep deprived! You will absolutely love living in Oregon. Jack loves it here and can't wait to live here!

  14. Just wanted to add- the medical for a K1 visa is not the same (based on my experience) as the medical for a J1. For my J1 visas, I just had my local doctor sign the medical forms for me. For a K1, the medical has to take place at Knightsbridge in London (costs about £245 right now). This is the only US approved physician in the UK so unfortunately, we cannot get the medical done anywhere else. Again, more info regarding this can be found on the London forum :)

I've noticed you're Oregon also- that's where my fiance lives! Like your fiance, I have also had J1 visas before and I personally think this makes things easier as the US government already has a fair amount of info on you. Just a theory though ;)

Once you get your NOA2, your petition is sent to NVC. You can start called NVC after a week or two to get your London case number. Once you have the case number, you can book your medical. However, it takes about five days for the petition to get from NVC to London and you want to make sure his medical results arrive AFTER your petition gets there from NVC so they can match them up to the appropriate file, so bear this in mind when choosing his medical date.

There are more specific details about this in both the K1 flowchart (in the guides) and the UK forum, with a particularly good thread pinned to the top of the UK one about all the (London specific) steps following NOA2. I recommend reading it!

A UK police certificate is good for 12 months at the London embassy so he could go ahead and order that now.

Anything else just let me know, hope that all makes sense :)

Good news about the J1 benefit. My fiancé and I had the same thought :) Yeah this timeline is sounding more and more familiar. Learning about all of this visa stuff is like learning a new language! That's good to know about booking the medical. I've read through the k1 flowchart and the UK forum with the london specific guide is amazing. This forum has been such good resource. Great news about the police check. That part about the medical is unbelievable! 245 is a lot of money!!! Good thing our bank account will be combined soon! haha!

  15. Hello!

There is no way of knowing the exact effect it will have on processing times, but as you're at CSC it will be fairly quick. Assuming you have no other RFE's I think it's safe to say you'll have your NOA2 within the month. At this point, you can start preparing for the interview by gathering stuff for the affidavit of support, obtaining police certificates and thinking ahead to booking your medical. Remember, your visa will expire six months from your medical date, not your interview date.

There is lots of helpful information in both the K1 guides (for example, the flowchart) and also the UK specific forum which you'll want to start reading through as your approach your NOA2.

    Hope that helps a bit.

    Good luck! :)

    Wonderful!

Thank you so much for your quick response!! Yes I'm reading lots of good things about CSC! Yes that's a good point. Getting another RFE is our biggest fear at this point! I'll look up more information on how to obtain the police certificate, and start getting together the affidavit materials :) As far as the medical, can we book that now?? He has had a J-1 visa before and has gone through that process so he's very familiar with how that medical part of this works. I've read a couple of issues with people having trouble booking appointments for medical. It makes sense that we'd just book it now and assume like you said that we'll get it within the month!

  16. Hi!

My timeline has gotten a bit messy lately and I'm looking for more information on what to expect next.

11/8/14- My fiancé and I hastily put together the I129-f forms (the 6 page packet only, no evidence)

    11/14/14- Received NOA1

12/8/14- Put together all evidence that we didn't originally submit as advised by USCIS employee. We went on our trip to visit his family thinking that everything was taken care of with the evidence.

12/17/14- Received RFE (This was not posted in our case status that we were checking daily to see if they'd received our packet. When I came back from my trip on 1/2/15 I received the hard copy of the RFE and sent it the next business day with 1-day shipping)

    1/5/15- Sent response to RFE

    1/6/15- USCIS received RFE response

    Here are my questions:

    1) Since our timeline was delayed by 19 days due to the RFE I'm wondering what that will change about our timeline. Since they're having to process ALL of the evidence will it take longer? Do we just add 19 days onto the typical K1 timeline?

    2) Now that we've had a misunderstanding we definitely want to avoid any future delays! What should we get ready for the interview and next steps? What paperwork should we prepare?

    3) We currently have our wedding planned for the middle of August. Should we change the date??

Thanks to all of you for any help you can give us! We are so in love and so ready to be in the same place!!!
