  5. He makes $50,000K a year, That is enough right? I'm just looking at this letter and it says " based on the documents submitted with the affidavit of support for the petitioner/sponsor, the income did not meet the 125% poverty guidelines"

There is only 2 of us living in this house. Lol! But we did not submit any evidence what so ever, just sent the affidavit of support, do you think this is why they say this? Cause we didn't send any evidence.

    most definitely.

  6. I did try uploading the picture, but I can't. I had my RFE through the post today. It was about the affidavit of support.

    It says:

The petitioner/Sponsor on form I-864 affidavit of support must submit a completed federal income tax return submitted to the IRS for the most recent tax year.

The petitioner/sponsor income on federal income tax does not meet or exceed the 125% of the poverty guideline, The petitioner list their current income on the I-864 as an amount to be considered as sufficient, however, no evidence has been submitted as proof of current income.

Submit all supporting tax document (W2'S, 1099's, form 2555 and all supporting tax schedules) submitted to the IRS for the most recent tax year.

based on documents submitted the petitioner/sponsor, The income did not meet the 125% guidelines for the petitioner household.

Now, My husband makes $50.000K a year, which is more than enough. Can anyone shed some light to what exactly we need to send, Cause to be honest, I am clueless. Would it be okay to just send W2, IRS tax transcripts, pay stubs for 6 months.

Or if anyone could help me on how to upload the picture of the letter, It says the file is too big to be uploaded.

    Hey,

    http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf.

i would advise you check this site to see if your husband's income versus number of dependents is 125% of income as required, if yes, your husband can quickly request for the tax transcript for the past 3 years from IRS, these is what they need.

You can also add the most recent pay stubs and employment letter (where necessary), but if your husband's income is less than the 125% required, fill another i-864 but this time get a co-sponsor, put the information of the co-sponsor on the i-864 and get him or her to fill the i-864a. The co-sponsor shall also include his/her 3 years tax returns (advice him/her to get the tax transcript from IRS also) and submit it, the co-sponsor can be anybody you know

RFE Response received by USCIS: 01/23/2015

    RFE status update: 01/26/2015

Response To USCIS' Request For Evidence Was Received

On January 26, 2015, we received your response to our Request for Evidence for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number MSCxxxxxxxxxxx. Our National Benefits Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you.

  8. Got another letter from USCIS saying that they couldn't proceed with my Service Request to expedite my EAD because the I485 is on hold for additional evidence. They attached the I485 RFE to the mail. The mail date from January 20 while my RFE was received and the case resumed on January 21. I am not lucky.

Hopefully, next week they will approve. I also recontacted my congressman and he Call back USCIS, then they required that I signed consent form from me not my wife since I m the applicant of I765. What I did and sent back to the congressman office. They Confirmed to me that the SR have been resent. I am just waiting now.

    A day
