  1. Before your husband can hire a foreign worker, he needs to go through a Dept. of Labor certification that he cannot find a US mechanic and that is why he needs to bring over a foreign worker.

    This is not a DIY. If your husband is serious, then he needs an employment immigration attorney. He will need to pay the attorney's fees if around $5000. It's illegal for the employee to pay for the process or reimburse your husband. The business must pay for the entire visa process.

  2. He has to go through a process to obtain permission and such to have a work visa issued for the person. I assume the person lives in Belgium currently. They have to have a work visa to come here and work.

    I need some help to figure out what should I do.

    I have a sister that lives in Belgium and she is a citizen. She has a baby girl and she will be divorced in May 2011. I am trying to start the process to get her here so we can have each other closer. I know that is more complicated because she will probably have to get her ex-husband's permision to leave Belgium with her daughter.

    My main concern is that if I introduce her to somebody here and lets say they will want to get married will that affect in any way the process that I already started to get her here?

    I will appreciate any advice.

  4. Thanks to everyone. I will purchase the tickets for a round trip a little less than 6 months. I was first thinking of buying a ticket for 3 months and change the date later but considering that at the border they can put the stamp with only 3 months and of course the fee for changing the date is so high it didn't seem like a good idea. I just didn't want them to feel forced to put 6 months stamp but..... i guess I worry to much and my parents have the rights to stay till up to 6 months.

    I am not sure I am on the right forum but maybe somebody will be able to help me. I am a permananet resident and I am going to have a baby at the beggining of January. I am planning to have my parents come for 6 months to visit and also to help us with the baby. They already visited USA for two months last year and they do have a valid tourist visa. I know that the maximum period they can stay is 6 months but..... my question is: Am I allowed to purchase a ticket for a 6 months period?

OK, so i found out that Romania accepts dual citizenship, I am about to apply for a U.S. passport and my romanian passport expires next year, I intend to keep my romanian citizenship so I will try to renew my romanian passport. Now the question is do I renew it in my maiden name or my married name.

    I hope somebody has an answer.

    My romanian passport is expired now and I am not even considering to get a romanian one even if I will have dual citizenship. Why? There are a lot of papers and fees and the romanian embassy/ consulat are the worse (everything is handwritten and they will tell you one thing on the phone and another thing when you'll get there). I e-mailed them to ask about the papers that I need and they told me something different than what they have on their website but I was not suprised. It will be easier I heard if you go to Romania and get your passport there but I advice you to get it with your married name but that means you have to get your american marriage license recognized at "starea civila romana" and that takes time or bribe or both. For me it doesn't make sense to waste time and money on it.

    I filed I-795 Removing of Conditions in August 2008 and I got my first NOA on September 2008. I also had my biometrics done and now I am waiting for the GC. My case is at the Vermont Center so..... if they are procesing files from March that means I have to wait at least another 5-6 months if I am lucky.

    I am thinking of appling for naturalization but I do not know if it has to be 3 years from the date of marriage (which i June) or 3 years from the date of my first GC (which is October)?

    I am not really sure that I am on the right topic but I hope somebody will be able to help me.

    I have a very good girlfriend from Romania that is now in US. She got married to an US citizen and moved here one year ago along with her son. She has her conditional green card. Her husband wants to adopt her child but...... the boy's biological father is not on the romanian birth certificate and he did not recognized the child. One lawyer told her that he thinks she needs to obtain the termination of rights of the biological father before doing anything. Is that true despite the fact that the father never recognized the child?

    Please, I will greatly appreciate any kind of advice.

    I have a question related to the Income Tax Return. I came to USA with a K1 Visa in 2006. I got my Green Card (conditional) in October 2006.

    I worked all year long in 2007 and of course I paid all the taxes. Now it is time to file for taxes. Me and my american husband filled it jointly. We got all the documents (W-2's and everything) and we sent them to the accountant. I just found out today that he said we have to pay a lot (almost $4,000) in taxes because I am a non-resident. My question is: AM I A RESIDENT OR NOT? From my point of view I am definitely a resident because I have a Green Card. The other stupid thing is that my earnings during 2007 are around $9,000 with taxes so how is it hard to belive that I have to pay half back :o .

    Does anyone has any experience with this?

    I just called the USCIS and they confirmed what everybody said.... I appologize again :( !

    PS: On the back of the card it says "The person indentified by this card is authorized to work and reside in the US"

  11. You don't have to renew your EAD. Your GC is proof that you are employment authorised and a (conditional) permanent resident. In fact, you don't even need your EAD anymore. Just put it away in your immigration files as a souvenir! :)

    ARE YOU SURE? I HAVE A "CONDITIONAL GREEN CARD" so I amnot a permanent resident.

    CAN I CALL USCIS TO CHECK? WHAT NUMBER I SHOULD CALL?
