  1. I cannot believe how incompetent the embassy is... she is there crying outside the embassy.... the in charge there told her that they cannot reissue the visa because she did not get a AOS before she left!!1

    She even showed them the code REQUIRING them to review and reissue...

    SOB!! We have until September 14th on our current visa and the $#$#$@# said we need to start completely over!!1

    What bullsh*t!

  2. Well bad news... and I am very upset about it.... the "vice consul" just told her that they cannot "reissue" her K1 visa!!!!

    She even showed them this:

    9 FAM 41.81 N6.3 Reissuance of K-1 Visa

    (TL:VISA-2; 08-30-1987)

    If a K-1 visa, valid for a single entry and a 6-month period, has already been

    used for admission into the United States and the alien fiancé(e) has

    returned abroad prior to the marriage, the consular officer may issue a new

    K visa, provided that the period of validity does not exceed the 90th day

    after the date of initial admission of the alien on the original K visa and

    provided also that the petitioner and beneficiary still intend and are free to

    marry. The alien’s return to the United States and marriage to the petitioner

    must take place within 90 days from the date of the original admission into

    the United States in K status.

    I can't even f'ing believe it!!!!!

  3. It is so frustrating that the embassy does not respond to ANYTHING.... emails, phone calls...

    There has been NOTHING from the IV unit, and I have sent 4 separate emails spaced evenly apart over the past MONTH

    So Darnell and Vol... thank you again :) So you both think that she should fly to Manila and just go to the front gate directly?

    And go there after lunch?

    I even sent the email requesting her name be added to the guard's list and nothing...

  4. Hi TBone TX!

    Well... the emergency was complications with her sister's first pregnancy... Filipino families are so very close to each other...

    When her sister said she was having issues, Maria was so worried that she flew back to be by her side...

    Now things are stable, but there is no "medical evidence" that I can get...

    It will only be her explanation of why she left the USA...

    I hope that is enough?

  5. Okay... Thank god all of that is still current, including the medical...

    I am glad to know that she may not need to bring anything because it is all here in the USA because I was fairly certain she could come back...

    Luckily, the embassy has the case file and we were there in May of this year..

    Hopefully this is the last question... where should she go? or who should she ask for once she is in the embassy?

    I went to our visa embassy appointment with her and it is a confusing place at best...

    I just want to be able to tell her to "go to window A" or "Ask for the immigration desk",,, something like that, so she understands what to do once she is in the embassy

    Well... part of the issue was that I had been referring to the K1 problem as "Getting the K1 Visa Re-Validated"

    During my search for the right place to send the email... I was corrected by the USCIS... I am asking for a "K1 Visa Re-Issuance"

    So the email I sent to: support-Philippines@ustraveldocs.com

    Do you feel the procedure you gave me is the same?

    I am worried because we only have until September 14th...

    Plus, Maria lives in Cebu, so I have no problem flying her to Manila, but I should be fairly certain what she should be doing there before she goes...

  7. OMG! It has been two and a half weeks since I sent the email to the Philippine Embassy!

    That is the ONLY option for a K1 Visa re-issuance...

    I call there every 3rd day, the staff is always polite to me, but there has been no decision at all!

    Also, you CANNOT talk to the immigration Officer who might be deciding your fate...

    The Embassy staff just checks the "notes" in our file, and tells me that "your file and request has been escalated to the immigration officer and you should be receiving the emailed decision soon"

    Wow! I guess I need to PM the two members on here that were successful in their re-issuance....

  8. Okay, I have been on this hard-core for 3 days now...:)

    All leads point to the Embassy in Manila to get this done (Thanks to all!)

    The crazy thing is that yesterday when I was on the phone with the embassy in Manila, the officer told me to go to the "Waivers" section, he really didn't tell me why but it looks like I may need to file a I-601 - Application for Waiver on the Grounds of Inadmissibility

    At this point I am trying to get back in touch with the embassy to find out EXACTLY what forms I need to fill out, what fees need to be paid, and when should I set an appointment at the embassy in Manila...

    So frustrating because one department has no clue what the other department is responsible for! I love our country but this is so unbelievable that there isn't a simple guideline to assist us.

    I'm in CA so the embassy isn't open yet, BUT I will ask again at the embassy what should I do. It has been shown to me (THanks KayDeeCee!) that it is possible to get this done in the original 90 day K1 period we have already.

    OH WELL.... Updates will keep on coming!

    And Hank, THANK YOU! you are 100% correct that it is the embassy's responsibility for all of this to happen...

    OMG! I have contacted (in no special order...) The USCIS, DHS, CBP, Both Embassy's, TravelDocs, the Department of State, The NVC... I could go on and on with the email contacts as well.

    VOL...I will head over there if I need to... no problem there!

    My name is Mike and I am a US citizen and the petitioner for my fiance'. She is from the Philippine's
    We are some of the fortunate ones who got our visa approved and actually got my true love here to be with me in the USA...
    She was issued her K1 visa by the manila embassy in May of 2015, and she first entered the USA on June 17th, 2015.
    Her 90 day visa expires on September 14th, 2015
    On July 21st, 2015, she had to return to the Philippines for a family emergency. At this time, things appear to be more stable with her family emergency and she should be ready to return in a few days...
    Unfortunately, at the time she left the USA, we were not married yet, and we had not filed for the Adjustment of Status.
    I read that at the USCIS discretion, a K1 visa may be "re-validated" uder the following conditions:

    Does anyone know who we can ask for this exception?, We do intend to marry well within the original 90 day date of her initial admission into the USA.
    I have been calling different numbers all day and night... The one person I talked to at the US Embassy in Manila finally told me to contact the DHS/USCIS Visa Waiver section... I have been trying that with no luck at all....
    Does anyone know what to do before it is too late?

  11. I think the most difficult part of deciding whether or not for her to return home is.... "should she really leave now... or wait...?"

    Compatibility between us was NEVER an issue. We loved every minute of being together, whether I was in the Phils or not.

    It had nothing to do with me leaving her at home when I went to work, because I own my own business (a retail car store) and she was able to be with me all day long. I really think it was because I encouraged her to spend time with her family back in the Phils before she left, I made sure she had enough money to have her parents visit her frequently, and I also went to the Phils 4 times to be with her in the 7 months we were applying for the visa.

    It is hard to explain what I mean by her "spending time" with her family, but when we first met, I asked her when was the last time she saw her Mom and Dad... she replied "it has almost been one entire year..."

    So hearing that, I made sure that while we were processing the visa, she did not have to work (I sent her enough money for her apartment, clothes, and food) and that she had enough money to see her family, buy gifts for birthdays etc...

    It was this factor (me providing her the ability to have frequent contact) allowing her to see her family so much just before we left, that I feel really started her missing them so soon. In fact, the night before we left, no less than 12 relatives and a couple friends were there at the "Bon Voyage" dinner I hosted for her...

    In addition, I am not "keeping" her here against her will... she is a beautiful person with good common sense. She knew what she was getting into before we even started the visa process. I tried my best to encourage her to stay longer...

    I did have one question and member posted on this thread... He said to notify the Philippine embassy and the USCIS? Does anyone know for what reason? and also, the proper way to notify them?

  12. Hi Everyone...

    Well, not everyone has a happy ending for their story. After 8 long months of working toward the goal of getting Maria her K1 visa completed and approved, it finally happened!

    Then, after she arrived in the USA (Sacramento, California) she became so homesick and overwhelmed, I finally had to give in and I booked her a flight home tomorrow night (June 26th, 2015)

    My question is, and even though we are cutting it off between us (I mean what choice do I have? She is returning to the Phils) I want her to be comfortable, and to have a stress free return trip home.

    Is there anything else she needs to leave the USA besides her valid Philippine Passport? Obviously we talked about her "Losing" her ability to stay in the USA by leaving before we get married and file the AOS... I just want her to be able to get on the plane in Sacramento, California without any hassles if possible.

    I'm heartbroken and completely hurt by all of this but I am a gentleman and I care for her a lot...

    Any help would be greatly appreciated as she is scheduled to leave in less than 24 hours...
