    How to Apply to Remove the Conditions

    You and your spouse must apply together to remove the conditions on your residence by filing Form I-751. You should apply during the 90 days before your second anniversary as a conditional resident. The expiration date on your green card is also the date of your second anniversary as a conditional resident. If you do not apply to remove the conditions in time, you could lose your conditional resident status and be removed from the country.

    But my card expiration date is different from my second anniversary....

  2. I have seen conflict statements about when to file I751. Some say its 90 days within two year anniversary and some say its 90 days within card expiration date. I don't know if its a mistake by USCIS, but my card expiration date is different from my two year anniversary. Its 2 years after the card was approved, so its a about 7 month later after my 2 year anniversary. I wonder when should I file the I-751. If I file it within 2 year anniversary, will they reject it because its filed too soon?

    I was thinking about self-sponsorship as well. :(

    I just received my I765 and I131 approval notice. I did got a Request for Initial Evidence apparently they need bank statement for the past 12 months. Also they said I was missing tax forms for my spouse (i mailed W2 and 1042 because I could get the online tax transcript at that time) and also I was a F1 so they request evidence to show I was able to work at school.

    For the RFE, I mailed my I20, tax transcript for my spouse, updated I863 and 12 months of bank statement for all 3 of my banks.

  4. We had our EAD expedite request say the same, but decision was not made for another two weeks. You still need to fax the info.

    Thanks for the input. I faxed the document the same day. I plan to start working in Mid Feb and really hope they can process mine before that date. Do you think contacting local congressman will help expedite even if I already request expedition?

  5. I'm the applicant and my wife is the U.S. citizen. We want to include my mother in law to sponsor us but she doesn't live with us. Can we still use her as out sponsor?

    I notice USCIS says the sponsor has to be a household member but I don't know if I understand it correctly because I see lots of people using their parents as sponsor even if they don't live with them.

    If I can use my mother in law, do I need to resubmit i864 or i864a?

  6. I am the immigrant and my wife is the us citizen. Currently I earn 2000/mo and my wife has no income. We have a baby son. So we are $400 short on the 125% income poverty line but we have enough asset to compensate that.

    The problem is:

    My W2 taxable income is only 18xxx last year because I am currently on F1 visa and a graduate student at a University and my home country China has a treaty with USA that for the first 5k income it is not taxable. However, I didnt explain it nor include the treaty in my package. Will this be a problem?

    I did include a letter from my employer saying that I earn 2k/mo. And my wife stopped working this march but she still had income last year and her W2 plus mine will exceed the poverty line in 2013.

    Also, if the officer thinks we dont have enough income, will they simply deny my application or ask me to provide more document or include co-sponsor?

    Also if i include co-sponsor, does he has to be living with us in the same address or he can be living in other states?

  7. I sent my i485 i130 i765 g1145 etc to chicago lockbox in Nov. 21 and noticed my check was cashed electronically on Dec. 1. However, I haven't receive a recipt number and I called USCIS and they say my filing are not in the system yet. They asked me to wait for another few days. But the problem is my job will start in feb. 18 and I really need my EAD card before that.

    Does anyone have the similar problem like the cashed check but no receipt number? Or do you know how long will i receive the receipt number after the cashed check? I hope they didnt forgot to log my file to the system....

    I also called my bank and they say they cashed the check electronically so they dont have the photo of the check so I cant see the back of the check which could show the receipt number there.

    Do you think it is possible to receive my EAD card before Feb 18?
