  1. Hello Guys, I have Applied for my brothers to come to the US in 2020 and 2021. USCIS sent me the approval letter in October 2023. I tried to start my NVC process today, but I found the following message:

Due to the numerical limitations on immigrant visa issuance prescribed by law, this petition is not eligible for further processing at this time. The National Visa Center (NVC) will retain the petition until an immigrant visa becomes available. The NVC will notify the petitioner, principal applicant, or attorney of record when this petition is eligible for further processing. The principal applicant should not make any firm plans such as disposing of property, giving up jobs, or making travel arrangements at this time.

I couldn't pay the fees and the fees choose is highlighted (grayed).

    The interview in Jerusalem, Israel.

    Priority date :  NOV 25 the 2020.

    what I'm I expecting here?

Agree with this timing, the prior poster is referring to an incorrect category wait time.

If you start filing right now and everything happens as soon as it can the older child may be ok, I wouldn’t delay at all, him being 18 now and 3 years probably being about the shortest possible time to get it all done if you file immediately, and your parents move and file as soon as they can. You may get lucky with a long approval delay helping to protect him via CSPA.

Re leaving kids behind, one or both parents can file for re-entry permits allowing them up to 2 years out the US without jeopardizing their green cards so they can go back home for that amount of time. At the time of the children’s petitions becoming current, they would need to show intent to re-establish domicile in the US and probably get you as a joint sponsor as they won’t have US income; alternatively, one parent can be the sponsoring parent and stay and work in the US while the other goes back if needed to assist the children on a daily basis, until they get their visas.

Thanks for the answer!!!! I have a question about my brother who is over 21 and he is NOT married. Does it affect him if he gets married in the future? And can I apply for my brother who is married and have kids?

    Thank you!!

No your parents and siblings can’t come at the same time due to being in different categories.

Your parents being immediate relatives would get thier visas within 2 years but your siblings have a longer wait somewhere like 7 to 10 years.

What you can do is file for your parents and when they get thier green cards and come to the US they can then immediately petition for your sister and brother. The problem with this is they would have to leave your siblings behind temporary and the 18 year old sibling will almost certainly age out.

    Thank you for the answer!!!

  4. Hello everybody,

I'm applying for citizenship based on marriage. I have 10 years Green card. I have everything ready but I have a taxes problem. We have been filling together since I came here to the US 3 years ago. She is makes most of the money but we didn't pay what we owe. We owe them 6 thousands dollars. I started a payment plan with IRS last month but her name only shows up on the IRS letter. We have our both names together that we filled. I personally owe nothing to IRS but we are married and fill it together.

Should I tell them in the application that I own taxes or not since it's all under her name? Any suggestions?

    Thank you

  5. Hello everyone,

I have hit my 3rd year in the US last week. I have a 10 years Green card. I came in on a spouse visa. I'm filling N 400..I have couple questions :

    1) do I need to send a pictures of me with N 400 papers ? ( passport style) or they going to take pictures of me when I do the fingers print.

    2) I didn't leave the US since I came here. Should I put the traveling history for the last 3 years or 5 years?

Any advice before I send the package?  Thank you!
