    Well Ive got our airplane tickets today. We are going to Juarez next monday night..!! I have everything ready, just finishing gathering evidence for a waiver in case I need it, I still dont know.. and I hate not to know!! :angry: I wish to know what is gonna happen to me certainly... But I decided just relax, have faith and wait to see whats next.. travel to NY o wait months!!

    I've been looking for a response on my case of less than 180 days of overstay to know if I will need to file a waiver.. and I found a great Law forum (free) where moderators and laurel scott respond to most of the questions..     oh! by the way, Today I filled the DS-156 from the Juarez consulate website and it is just updated!! Now they have the last edition expiring 9/30/2007. and every page has a warning "previos edition obsolete".. :whistle:

    Please advice me! Im going to my k1 interview next days. Im afraid thinking if I need a waiver: :crying:

    My overstay is for 130 days. the day 130th they cancelled my visa and gave me a hearing with a special permission to remain the US until that hearing. After that hearing judge ordered a voluntary departure within the next 90 days. I left the US ontime on a plane. Was I inside the TOLLING period? :unsure:

    my question is: the days between my cancelled visa and the day I left the US are also in my overstay count?

  8. Nobody? :crying: Looking thru the internet I found this answers from an attorney website. Maybe those days beetween visa cancelled and the day of departure from the US are "tolling".. I leave this info in case someone is in my same situation.. and more opinions are welcome.. Please!

    Yes, you are now out of status. The Department of State (DOS) issues visas from consular offices. This visa will give you the opportunity to apply for a visa from the Bureau of Citizenship and Immigration Services (BCIS) at the border or airport. The visa issued by the BCIS is what I call the 'true' visa and appears as a stamp on your I-94 card. If you remain in the US after that stamp expires, you are out of status even if your DOS visa does not expire for years.

    No, you are still in a period of authorized stay called 'tolling'. Your stay is authorized until BCIS makes a decision on your case. If you receive a notice that it has been denied, you begin accumulating 'out of status' time at that point and must leave the country immediately.

    *The number of formal denials has increased from last year, but it is in line with the increase in workload. For example, last year the consulate referred a total of 3,900 applicants to the USCIS office for waivers, while in the last month alone it referred 1,213 applicants. Applicants who know they will be denied at the consulate based on unlawful presence, fraud, or criminal convictions cannot submit the waiver prior to leaving the United States or prior to the consular interview. This is because the consulate must first review the application, weigh all the possible grounds of inadmissibility that might apply, and make a formal determination. In contrast, applicants who will be denied based on a prior deportation or removal are allowed to submit the Form I-212, Request for Permission to Reenter after Deportation or Removal, at the USCIS district office having jurisdiction over the deportation/removal, and have that adjudicated prior to the consular interview. But applicants who will need to submit both an I-212 and an I-601 waiver are instructed to submit both at the time of the denial at the consulate.

    I stil dont know if Im gonna need the waiver.. But I will be prepared .. emotionally!! and with paperwork..

    KITKAT, the extreme hardship is just for the US citizen? or could apply for the foreigner too? I mean.. I know is a silly question, but since I read all in english Im confussed.. WHO has to suffer in the evidence provided for a waiver??!! :wacko:

    Waiver is needed when an overstay in 180 days or more? is that correct?

    Ive been far from home, but Im back now :whistle:

    For our paperwork Im usind a big binder and each document and evidence is inside a plastic sleve (don't know the name!) ... Do you think is a good idea keep it like that..? Maybe if the consul wants some documents he/she just pulls it up, keeps it for himself, and keep going thru the whole binder..

    ALE, or anyone, what is the order you gave to the documents and other evidence? Pictures are better in photo albums?

    KitKat, Lucy.. How big is the space the consul have to spread paperwork and check..? Or they just get the paperwork and get it inside an office? How do they check? right in front of the applicants??

    My fiance is driving me crazy... ( I know Im not the only one!) :crying: He just gave me a letter he received 10 days after the NOA2, maybe is the letter Ucla Cutie was talking about..? It says our case has been fwd to CdJ and has a new CDJ case number .. is that the letter we were talking about..? the one to ask for a copy in the information both?

    and I have a question for kitkat or Lucy que ya fueron a CDJ.

    Do I need my mexican birth certificate translated and notarized..? if we both are in mexico can we notarize w a mexican notary..? should we go to the american embassy..? :crying:

    I sent it months ago to my fiance while he was in NY and he did nothing to it!!!!!!!!!!! I even sent the translation and he forgot.

    Please advice..

    what other mexican documentation has to be notarized?

    Jamie, I hope Oliverio gets his passport soon. The ID is really necesary (cred de elector) if he has it, the passport only takes 5 hrs to get it.

    I just got mine and it took 2 days because it was lost, so I had to fill a special form, get it sealed by a federal instance, provide more documentation, such as college degree, certificates, etc. but they were fast anyway.. good luck! Im sure u will be in Juarez soon wir Passports!

    Thank you! as always you are a great guide.. Its just that im very worried about getting the waiver.. my overstay is like this:

    between I-194 expired and the day border patrol took my visa: 130 days.

    That 130th day, the police at the border gave me a permission written in a little paper. The permission was to remain the US until my hearing day.. (20 days more)

    Then I lost the hearing and they gave me a deadline to leave the US. (90 days permission) I remained 85 out of those 90 days and I left the US on time.

    I dont want to assume that from the day I was cought to the day I flew aren't to the overstay total.. Am I correct..?

    :innocent: I know im just bugging!! but Im so afraid..when I think of another year waiting I wan to be very catholic and go to church!! stop eating candy and pay for all my sins!!!!

  15. Otra cosa, you don't have to wait until you receive your package in the mail. You can actually use the package that Michael receives in NY. All you really need is the letter from the packet, everything else is useless. Y tambien recuerda that you need to do the online DS-156 form with the barcode imprinted on the forms.

    Was he supossed to receive another letter or anything after NOA2..!!!?? please girls let me know if u know something about this, so we can call her mom, maybe she can check his mail in NY and send us important documents via FedEx..

    so if I understand it right, CAN I GO TO CDJ ANYTIME..? since we are ready, with all evidence and We also received an e- mail from CDJ noticing us they have our case at their post..

    But they don't fly from DF, right? We paid around $450 DF-CDJ-DF but that was a last minute, fully refundable ticket. For the next one, we'll book in advance and hopefully it will be much less expensive. Then one more round trip for me to go there after the visa pick up date and one ONE WAY ticket for my honey to finally come home with me!

    Brenda, are you in DF for the holidays? I'm planning to be there early December through mid-January. We might have to meet in person!!!
