My wife is on EB2-NIW when we got married, she filed for it last year and has already gotten work permit, and SSN. She works and goes to school. she is in the process of waiting for her green card to be approved.
I wanted to know if I should just file I-130 / I-485 (plus other necessary forms; I-864, I-131 etc) for her. Is it complicated? What other information should i be aware since she is already in a process. do we have to cancel that EB2-NIW process and start a new one where i file for here?
What do i need to know for this situation

I'm a US citizen and my mum is visiting.
i had filed I-130 a month ago. It's been 110+ days since she has been here now so i want to submit AOS.
I have prepared all documents for submission, and wanted to check with you guys if you can please validate i have everything they'll need:I have completed: I-485, I-765, I-864, I-94, photocopies of both hers and my birth certs, copies of her passport and vise page, 2x passport photos, my tax return from last year (for I-864)..
Is there any other doc I am missing?

just a receipt notification.
so i'll have to wait for that before i file i-485?

Yes, the only number on there is the receipt number starting with IOE

I filed I-130 for my mum (she has been in the States for 4mths legally on a B2 tourist visa).
I tried filing I-485 after i filed the I-130 but it is asking for an A-number?
Do I wait until I receive this number before I file the I-485? How long does it take to get it after filing I-130.thanks

Hmmm Murican you know what? I did not provide them with a number to call and that is why they went to the address provided. My lawyer said Oh... don't give them any numbers to call if they never ask or request. I think it is good that they visited her personally and she explained to them in details.
How many weeks exactly did it takes ? By mail? Did you sign for for automatic update from the USCIS website? Did they update that as well? I am heading for the info pass appointment that I made last week.
I don't think you need to schedule an infoPass.
If they went to you ex wife then they are working on your application.
I say give them 3weeks (that's how long it took after they called my ex wife for me to get the mail)
They also told my ex-wife they were happy with here response and they would go ahead and approve the application.
So I guess you might want to ask her if the I/O gave her any hint on the decision he was going to make based on her answers.
But yea, I would say wait a few weeks (3-4weeks)

So for Murican and Worried_joel they went to ex spouses. I am not sure if this is becoming the trend. If it is, I am very concerned. Because my ex would falsely say I tricked them just to get me into trouble. I had a nasty divorce. Should I worry? They have given me good faith marriage waiver and a permanent green card. If my ex says falsely that I ticked them will uscis deport me just because of that after giving me perm gc? Thanks
Since you got a marriage waiver, I don't think they would go back to your ex.
But then again they are doing things they haven't done before so...
If you ask me, I think you should make peace with your ex wife.

New UPDATE on my case!!!
I/O went to my ex-wife house and knock on her door early in the morning.
They questioned her about our past marriage and child issue.
They seem convinced. They said it is part of the standard procedure to investigate.
Did anyone of you got the same thing going on?
Yup, I guess that is the norm now, like I said earlier in the thread they called my ex-wife too and after half an hour on the phone, the I/O said he was convinced. a couple of weeks later...
I got my oath ceremony notice mailed to me and I'm scheduled to have my oath ceremony next month.

Well, on the paper where I went for my interview result. It says 120 days. (A decision cannot be made at this time)
yea that's true.
I see it in fine print at the bottom.

I have the same kind of situation. It has been 3 months. I was told to wait for 4 months. 120 days of torture. I will let you know what is the outcome
I wish my I/O called my ex wife! because everything is real and I am ready to answer them.
I thought you had to wait 90 days (3months).
Who told you 120 days (4 months)?

.I am sorry, I don't see anywhere on the N-400 form where one has to provide prior spouse's contact info. (I see Part 9, question 9 - but that has no Contact Info in it)

It is in the N400 form you fill.
under spouse contact info. they ask for your spouse address and phone number.
What if she moved or changed her phone number? like I am so lucky

So My ex wife just called me to tell me she got a call from an immigration Officer about our marriage.
She was on the phone with the IO for up to an hour. they asked how we lived together and why we divorced and if I married her for love or if it was a scam?
Is this normal for IO to call your ex? what if you had a ugly divorce and your ex has a grudge against you and as a result lies to hurt you?
Is this fair practice to call an ex? I haven't read anywhere this is done

I have been a California resident for more than 2yrs but we did every filing process in NV cos she lived there. This is my first experience with California uscis.
And yea, I have heard things are difficult here

I had two interviews not one.
They called us for a second one because of the living situation.
We went to the second interview with all the proof of how we have been living and plane tickets and how I visit Vegas regularly and that wasn't a problem, and that's how I got my 10yr GC.
So I was only surprised during my n400 interview, when he asked the same questions from the second interview.
I'm not taking any actions, nor will I, its too late now. The elections are done and over. So they can take their time, I only wanted to vote. I just hope this is finalized before 2016 pres. election, I already see people from this forum who have been waiting a year+ just odd

I read (somewhwere on this forum) you can go to your senator/representative to find out what is going on (if no decision has been made after 120 days)
Dunno if this applies?
I will wait 5 weeks, if I do not hear from them then I will either call their 800 number or book an infopass appointment to see what the hold up is.
if nothing comes of it, then I will pay visit my representative, I guess this is the best way forward?

My online status still says interview, so that's not reliable.

they can question your GC at any stage. Event if you apply through 5 years rule and you still married and live with your usc wife, they may still question that. Once you get your USC it's out of their hand to revoke your citizenship except if they have a strong evidence of fraud which they can represent it to the federal court. So, that's why you see they question your marriage at almost all stages.
I think you will be good just a matter of time before you get your approval. Do you think your ex might talked to the immigration and she claimed fraud ?

Oh I thought the path to citizenship via I-130 was better than going via EB2-NIW...
So it looks like I can just file an AOS and enter all the necessary info (like her A number, SSN etc) when filling out the forms
