  1. I am in the same boat. Its ridiculous, unfortunatly its not backround checks or anything like that. Its just that we have an extremly incompetent USCIS as well as many other branches in our govt. I am here in Colombia now again with my wife the second time we are hoping to get an approval while im here. I have wasted time with worthless phone calls and everything else one might think would help. Its very obvious when you speak to these people that the education and knowledge levels are lower then 3rd grade. Incredible.

I can only imagine how the people are feeling that are unablee to travel for long periods to be with love ones while being tortured by our govt.

  2. Hi Craig,

I noticed you fax'd a Form OF 169. What and where exactly is that form? I checked the form page on this site and do not see it. You and I filed around the same time, I am still waiting on my NOA2s but getting everything ready prior to flying into Medellin.

Hope all goes well with your interview time.

I would like to ask a couple of questions: NOTE: My family is coming on K3/K-4 VISAS

    1) We are waiting to receive the interview date from the Embassy in Bogota. Karina has FAXed in the appropriate documents (DS-230s for herself and daughter and Form OF-169 plus copies of the main pages of their passports.)

My question is: How long until the Embassy sends a return FAX with the interview date?? We have all the Packet 4 information ready and waiting....we just need to know the date. Or, is the date available on the US EMBASSY website? When is it available?

    2) After her arrival in the USA, does she have to wait for Adjustment of Status in order to work or will she be able to work as soon as she finds a job? She intends to work immediately but I am unsure if this can happen. Help Please? She wants to work and she needs to work. Thank you for your help.

    Sincerely,

    Craig

  3. I used to buy phone cards every week, but then found out Vonage had an Intl plan that runs only 15us per month and all my calls now to Colombia are free. Dont know about Egypt but you might want to check the Vonage list of Intl calls. Another option you have is to buy a Majickjack and ship it to them, as long as they have high speed internet all the calls are free to and from, it plugs right into the side of the computer and has a phone jack on it, they assign a US number to it.

  4. We are waiting as well from July and August NOA1s. I called several times and spoke with different people different answers however today the lady put in a request as its over the normal time period. She stated I would be notified by mail within 30 days.

Waiting patiently holding off on my next trip for at least the approval and then going to Bogota with her for the interview.

  5. I'm on a similar timeline also.

    July 21, 2007 Mailed 1-130

    July 23, 2007 I-130 Received

    Aug 4, NOA1 Arrived for I-130

    Aug 6, Mailed I-129f

    Aug 8, I-129f received

    Aug 17, NOA1 Arrived for I-129f

Wow good link. Thats not the best news. We shall see, at least I got my notice from the first I130 still waiting on the notice from the I129f, the good news is i did get my check back so that tell me they must be looking at it. I am taking off to Colombia for the month. Looks like it might be Xmas in Colombia as well, ticket prices are through the roof for December and very little availibility, the worst part is cannot book now becuase dont know when the interview date will be.

  6. Craig,

Yes her daughter will need a passport as well. My step son also needed a passport and i orig. thought he didn't and that the visa for him would be stamped in the mothers passport, I was totally wrong as my wife investigated this further with the passport agency as well as the notary office. The good news is the Colombian passports are very cheap(less than 150mil pesos) and done the same day.

  7. Sent my i130 july with check for 190.00 then sent the i129f August included a check just to be sure and today got the check back with a letter that the $190.00 in the i130 covered it.

Also sent the k3 direct to California instead of the normal TX or Chicago.

Does anyone know if things get slowed down for the Thanksgiving and xmas holidays? We are hoping to get it done before xmas.

  8. I have read here in several k3 subjects that if the i130 is approved prior to the k3 they automatically abandon the k3. With me the k3 is my only choice with a child involved since I did not send a seperate i130 form for the child. What if you do not want them to abandon the k3? Can you call and request that is doesnt get thrown out?

    Thank you

For the K-4 to adjust status you will need an approved I-130... so you may want to prepare accordingly....

Thank you for your comments, always very helpful. As far as getting an approved i130 for the child for the aos can that i130 be done here in the local immigration office or does it have to go through the same process in the CSC?

  10. I have gotten mixed responsed regarding bringing a minor child in with the wife seperate i130s??. Not sure if it is a requirement. Or only if you are going the CR1 route do you have to have this, it just seems strange to fill out an i130 for a child 2 years old.

Also for a k3 do you have to do a g325a for the child seperate? Seperate passport fotos and passport for the child as well??

    I really appreciate your help

  11. jimmynuetron,

    Why?

If you really need to submit an I-130 for her, then you may need to submit one for her son as well.

    Yodrak

I am currently doing a i130 for my wife. .....

    Yodrak,

Isnt the i130 the correct way to do it.? There is a part on the i130 C17 that says to list all children of spouse. So I was thinking that the child can come on the same visa? Am I wrong? There has to be others here that have married someone with kids and brought them back as well??

    Thank you

  12. Most of us Colombian women keep our maiden names in Colombia. In fact, changing your name to your husband's is pretty much unheard of. I think that if she wants to have her new name on her Colombian passport, she will have to change her cédula as well. She should call their office to find out what they tell her. But as far as I know, most Colombian women keep their maiden name in Colombia and use their husband's name here in the States.

I appreciate the response, to be honest I think it will be alot less complicated for her to just keep her name through the process and while here in the states get the SS card and DL with my name. She would like to change the name completley here and in Colombia. I will have her call the office of the Cedulla to start with to see what they say about this. By the way its nice to see other people that got married in Medellin as well, actually Bello for me, but I live and always stay in laureles.

By the way I noticed in your timeline that you didnt do the i129f along with the k3. Any particular reason for that? Thanks.

  14. My wife would like to get the Colombian passport with the new last name on it. Are we able to get that with the marriage certificate in Colombia? If so will we be able to file the K3 and I129 papers with the new name as well? Anyone done this in Colombia?

Thank you for any help with this.

  15. Thanks alot Fmor very informative.

I did a fiance visa in the past with Colombia but withdrew it and it got approved anyways but never did the packet 3 since it was withdrawn. However there were no kids involved with that one. So this info really helps, i will keep you advised on the progress.

    Thanks again.

This link is extremely helpful and informative.

4.3)...What type of paperwork does the fiance(e) receive from the Consulate?

A...Exactly what gets sent will vary depending on the Consulate, but the first packet to arrive will most likely contain the following:

DS-2001 (or OF-169 or UK/85) -- This is your main set of instructions. It is also a checklist of items required for the interview.

OF-167 -- information sheet about financial responsibility. You may also receive an I-134 Affidavit of Support form.

    DS-230 or OF-230 Part 1 -- biographical data sheet.

DS-156 -- Nonimmigrant visa application form

    DS-156K -- Nonimmigrant fiance(e) visa application

DS-157 -- Supplemental Nonimmigrant Visa Application (for all males between ages of 16 and 45)

You may, at this time, receive medical exam information, and a list of required immunizations.

DSL-1083 -- An information sheet about police certificates, military records and more.

In December, 2001, the State Department announced a change in the name of Packets 3 and 4, which were the instructions, forms and appointment information. They are now referred to as "Instruction Package" and "Appointment Package". Some of the forms are renamed slightly as well, so if the exact form numbers are different, just follow the instructions.

Sometimes, the Consulate may forget to send extra copies of these application forms for the children for whom a K2 visa is intended. If so, contact the Consulate to obtain the forms.

  16. Does anyone out there have experience with a fiance from Colombia with a child? In my case the father of the child has nothing to do them. I am trying to find specific info regarding this in Colombia, would we need to locate the father of the child to sign anything? Do I have to go through an actual adoption prior to getting the fiance visa? Or can I just apply for the i129f and add the child?

I am sure a few of you out had this same experience in Colombia. Please advise

    Thank you

  17. Have been doing searches for K2 visas with no luck. When getting a K1 and she has a child does she need permission from the father of the child to get the visa and passport? if so what form do they need to sign?

I know here in the states you must have permision from both parents. Also I dont see on the i129f application space for the child, do you just fill out 2 of them and send the extra fee or what other docs are needed for this?

    Thank you
