  1. I got conditional green card through marriage to a usc. I got divorced before the 2 years mark applied for I 751 gfm waiver, got approved for 10 year card. Since it was a nasty divorce I am wondering whether uscis calls ex spouses to determine whether the marriage was real. My ex might lie to the uscis and tell them it was not real or i tricked them just to get back at me. My ex did accuse me of fraud via email and I candidly sent that email to the uscis along with proofs of good faith marriage when I applied for I 751 waiver. Do you think if uscis calls and my ex lying and telling marriage was fraud when it was not or me sending my ex's email to the uscis where they accused me of fraud will cause any troubles now? Should I be worried? I want to ensure I have a solid case before I file for n 400. I will be filing under the 5 year rule.

  2. Oh one more thing...

    My ex spouse did accuse my of marriage fraud, lying and cheating on them (again on baseless grounds) in the emails we shared. When I applied for good faith marriage waiver I did send love emails and hate emails including the ones with the accusations of fraud to the USCIS and they approved my permanent green card.

    I got my initial green card (conditional) through marriage to a USC. The marriage ended in divorce before 2 years and I applied for I 751 good faith marriage waiver which was approved. Now I am applying for Citizenship. I strongly suspect that my ex spouse might have written a vindictive letter to the USCIS after my permanent green card (10 years) was approved claiming I married for green card. I also suspect that my ex spouse might have asked their family and/or friends to also write a vindictive letter to the USCIS claiming the same. There is no justification behind such allegations. They are completely baseless since it was a real marriage and I had tons of proof for it with the I 751 waiver application.

    My question is that at this point when my I 751 good faith marriage waiver is approved, will letter(s) from my ex spouse and/or their family and friends will lead to reopening of my I 751 waiver and lead to denial of my Citizenship and revocation of my permanent (10 year) green card? Should I be worried and reconsider whether I should apply for citizenship. Is the risk of denial worth the effort of applying for Citizenship in this case?

    Has/is anyone been in same situation?

    Please advise.

    I have 13 traffic tickets in the last five years. Most of them are from last year. The traffic tickets include speeding tickets, parking tickets (meter expired), and red light photo enforcement, ez pass violation. All tickets are paid and I never went to jail. None of the tickets are above $500. My driver's license was suspended once for one day due to late payment on one ticket. It was reinstated the very next day. I am very concerned about this. I have the following questions:

    1. Will immigration officer at the Naturalization interview deny me Citizenship because of bad moral character because of the number of tickets and/or driver's license suspension?

    2. What can I do to remedy this. For instance, can I do volunteer work and/or defensive driving course to prove good moral character?

    3. Has anyone been in this situation before?

    4. If I get denied because of this, how soon can I reapply?

    Please help I am really concerned.

    I had one ticket before I applied for I 751 waiver. After filing application I took documentation for the ticket I mentioned to the interview. However, I got 10 more tickets after filing the application but before the interview. At the interview I do remember that officer asked me about the ticket I mentioned but I do not remember whether he asked whether I have got any other tickets in the meantime. Since I do not remember whether he asked about the other 10 tickets or not and what I said. In case he did and I said no will I be in trouble now during N400 for any misrepresentation or anything and get my green card revoked? Please let me know. Thanks

  6. I have a few traffic tickets. The total of all travel tickets combined is above $500 but each individual traffic ticket is less than $500. These are the only citations I have. Should I check YES or NO to Q23 in the N 400 form "Have you ever been arrested, cited or detained by any law enforcement officer (including an and all immigration officials or the US armed forces) for any reason"? If I am supposed to check yes am I supposed to send court depositions showing all fines were paid. Or can I just check yes, take the court depositions with me to the interview but not send them with the application? Please advise.

  7. I am planning to apply for N 400. So far I have 5 parking tickets (all under $500), 5 speeding tickets (all under $500), 1 ez pass violation, and 3 tickets for red light photo enforcement (all under $500). 1 red light enforcement was for speed, one was for turning and one for not stopping for red light. One speeding ticket was a "petty misdemeanor" in MN even though it is a traffic violation. I am applying on N 400 based on 5 year rule. Can these lead to denial of N 400? Should I be worried. If I do get denied after how long can I reapply?

    Am I supposed to mention speeding tickets on N 400 Citizenship Application? What about parking tickets?

  8. Obviously this is a VERY unusual case. I have the following questions for you:

    1. Did you hire a lawyer when you applied for I 130, I 751 and N400?

    2. Did you get something that stated that you need to go to court because of possible green revocation or initiation of removal proceedings?

    In this case please hire a lawyer before you take any step and I mean any step because this is a very critical case.

  9. Since you got your I 751 waiver approved the previous marriage should be a non issue unless something changed after I 751 waiver and now. If it didn't this is very unusual. Did the same officer interview you twice? Is there any chance your previous spouse might have written a letter to the USCIS saying you married her for GC with some sort of proof? In my opinion you should do the following:

    1. Get second opinion from another lawyer. Find a lawyer through AILA that has a LOT of experience. I understand this is cumbersome and expensive but that is probably what it will take. The lawyer should either do an infopass and/or discuss with you regarding contacting senator in your area to enquire with the USCIS.

    2. Last resort would be to take the matter into the court if it is getting too delayed. But that is something for you to decide because you do not want to take the matter into the court and have USCIS deny it and put you in removal proceedings.

    3. Do not worry. You have a green card so they cannot just take away your green card because they feel like it. They will have to PROVE marriage fraud in court in order to take away your green card. Since you are a permanent resident you have no issue staying in the country and living here.

    But please be advised that you need a thorough review of your case with a VERY competent lawyer for red flags.

    I am concerned about your case. You mentioned that you married a US Citizen and applied for I 485 adjustment of status. Now I have the following questions for you:

    1. Did you apply for I 751 removal of conditions jointly with your first US Citizen spouse and than got divorced OR did you get divorced before 2 years and applied for I 751 WAIVER yourself to remove conditions?

    2. Did you meet your new wife right after divorcing or during the previous marriage?

    3. Did you have any kids from the previous marriage that got you I 485?

    4. What kind of evidence did you present at your I 485 and I 751.

    I will wait for you to answer these questions before responding further. This way I can better understand your case.

So even if my ex spouse writes a letter or letters from their family and friends against me to the USCIS at this point, it will not make a difference because I 751 waiver has already been adjudicated? Moreover, does living together for a little over a year before and after marriage have any effect on N 400 decision after I 751 approval? It was almost a two year marriage and we lived separately for 1 year of that marriage. Thanks


    Worried Joel - Did you hire a lawyer. I am not sure why they are reviewing your case so much? Any criminal history?

  12. I married a USC and adjusted my status by I 485. Unfortunately, marriage did not work out and we got divorced after living together for about a year together. At the end of the marriage when we were fighting my USC spouse accused my of marrying them for immigration status and also accused of lying and cheating on them throughout the marriage. When I applied for I 751 good faith marriage waiver I candidly mentioned every detail of the marriage in the affidavit and supporting documents including these accusations. I also submitted pictures, emails, travel, insurances, band account, tax, memberships, cards, gifts etc. I 751 good faith marriage waiver was approved. Will USCIS question me again on my previous marriage and/or readjudicate my permanent green card which they gave me after I 751 waiver approval? Will these accusations or previous divorce lead to denial of N 400, revocation of green card and put me in removal proceedings? Should I be worried? Please advise. Thanks.
