    Hi,

Your profile shows that you have filed in the F2a category.  That category has been current for 15 months, so your PD is already current and it's not going to be current in September.

What's your PD?  Has USCIS approved the I-130?

My pd is 11 april 2016.

Yes uscis approved my i-130 and sent to nvc for processig. But in 4 april 2018 nvc sent me a letter saying that my f2a pettion turns into f2b and i have to wait till my pd becomes current.

I was f2a category but because of aging out in 2018 my category turns into f2b

    Ok.

Your petitioner will have to wait a few more years for the NVC to contact her again with the bill for the DS-260 and I-864 fees.  Once those fees are paid, you would need to upload a PDF of your birth certificate.

In the meantime, you need to go get a certified copy of your birth certificate.  It will be extremely hard, if not impossible, for you to get your original birth certificate back from USCIS.

Why it will take few more years!

Current date for filing according to the july visa bulletin is " 01 feb 2016" and my pd is 11 april 2016

    Hi,

Never send in an original document.  You will not get it back.  There is no way to get it back to you.  It's gone forever.

The instructions for the I-130 states to only send in copies.

For the NVC, you will upload a PDF of your birth certificate after you pay the DS-260 fee.

For the visa interview, you will need to have an original or certified copy of your birth certificate.  You should start on getting a certified copy.

    ---------------

On a separate issue.  Do you qualify for CSPA protection?  If you qualify for CSPA protection, when did your PD become current?  Did the NVC send your mother a bill to pay the DS-260 and I-864 fees?

I am not qualified for CSPA protection.

NVC only send me the case number saying that my petition converted to f2b and i will have to wait longer

That's correct. The instructions say to never send original documents, unless specifically told. I'm not sure, but chances of getting the original back from USCIS are probably slim... Are you able to obtain an new one?

Also - NVC cases die after 12 months of inactivity after case creation, did you check in/make updates regularly?

My priority date is 11 april 2016.

Currently the dates for filing in f2b is 1 feb 2016.

  6. My mother applied for me in F2a category in april 2016. But my petition got converted into F2b category because i was over 21 years old in 2018.

Nvc alloted me a case number in 2018.

    MY question is-

    1) When my mother petitioned for me for F2a,  we gave the original birth certificate to USCIS to prove relationship,  now will we have to submit it again for NVC processing?

This part of the Visa bulletin of April is actually quite good news for us.

    1. The VB moved 4 weeks not 3 weeks as initially projected

    2. There is currently low demand, but, they keep the F2A moving at steady speed

while working on rapid F4 speed up

    3. They will, at more demand, keep the F2A moving still steady, but halt the F4.

Seeing this, we can count on steady movements in the next couple of months:

    ----------------------------------------------------------------------------------------------------

    D.  RAPID MOVEMENT IN WORLDWIDE FAMILY FOURTH
         PREFERENCE CATEGORY

Despite the forward movement of the final action dates, the level of demand and resulting number use in several Family preferences has been below expectations.  This lower than expected demand has resulted in advancement of the April Worldwide Family Fourth Preference date at a pace that covers the period of several months projected in the March Visa Bulletin’s “Visa Availability in the Coming Months”.  This action will allow the overall desired allocation level of number use for and through April to be met.  There are signs that demand in the other categories will increase in the coming months, resulting in the higher monthly allocation totals required to allow number use to reach those desired levels.  The Fourth Preference date will then be held for a period of time while the anticipated monthly allocation levels in those other preferences increase, without drastically altering overall workload patterns.

will f2a move at the pace now it is going or it will go fast?

I aged out this month. But I have still 5 months extra processing time ( the time USCIS took for processing my aapplication)

Disappointment for me as my petition will move to f2b.

I agree that the Illegal , DACA and others will change. Employment based will be another that will be overhauled to make sure companies can't play the system or grey areas anymore. Family based i could see changing based on green card holders bringing family but unlikely in my opinion. US citizens bring spouses or family i think is highly unlikely, some of these would have voted for trump.

The main focus is going to be on the people who have no claim to be here, a green card holder / perm resident is paying tax and putting money into the system. We don't have access to public funds etc.

I am more worried about the ignorant employers / employees that don't understand the way it works legally than immigration reform.

In family based green card did you mean f2a?

Sure. I personally think it's unlikely that any significant immigration reform will come in 2017 alone, but it is possible. Only the DACA repeal/changes piece is something that I believe has a decent shot of happening within the first 100 days. But that's just my guess on the political climate...nobody can predict the future. :)

    yes offcourse.

But what about visa bulletin (family based) will it be increased /reduced?

  10. Case was approved last night.....

    Thanks to Almighty...

The verification time can vary for various reasons .

The type of documentation you have provided could dictate the along with many other variables. My suggestion is wait for another 2-4 weeks and then start calling USCIS on a regular basis until you get hold of an agent and find a satisfactory answer.

Also bear in mind, the timetable for RFE is not something standard for all case type, scenarios, and situations.

    Best of luck

  11. Thank you hellraiser.....

If my mom come back and immediately apply for re-entry permit then will she be able to get it?

If she get it then how much time it takes to get it?

Someone on LPR can move back into USA if it's not more than 12 months. I've seen this happening with two family friends. Keep in mind; 12 months is a cut off time. If you exceed the cut off time, you may need to kick off the immigration process all over again based on the assumption that the person adondoned reaidency.

Like Penguin_ie stated, this should not be an issue for your immigration unless other issues comes from other areas.

    Good luck.
