  1. I got this in the mail:

    ...

We are writing to inform you that we cannot pay you benefits as of November 20, 2006.

In order to be entitled to regular benefits, claimants must be able to prove they are capable of and available for work, and unable to obtain suitable employment.

Your status as a non-immigrant prevents you from working in the United States of America, as you do not possess a valid employment authorization. For this reason, payment of benefit is suspended for so long as this condition exists.

    ...

If you disagree with our decision ... you can appeal it within 30 days of receiving this letter.

    ...

NOTE: Please forward a copy of your Employment Authorization card by mail or fax, when received, so that we can immediately reconsider the above-mentioned disentitlement.

I thought that K1's were eligible for EI benefits with or without the EAD stamp. I applied in mid-November and my I-94 expired January 28, 2006. I thought that I was entitled to benefits for the 90 days.

Can someone clarify or give advice on what to do?

Any input will be greatly appreciated!

  3. R.I.P. (F)

They sure were great while they lasted. At least I can live with the knowledge that while they were around........I made good use of their service.

I had a feeling something was up when I could not get through on any of their 3 lines for the past 2 days. Now I just saw this thread.....which clinches it. I also just saw the red notice on their website.

    Damn......

Already had to pay up and go back to my old calling card today(Nobel). :crying:

    Yup :-(

I tried using it several times over the Christmas holidays and I could not get through! I thought something was up, and now this. Poo! It was good while it lasted.

  4. YUM!!! Thanks guys, I now have some lovely places to visit and get good food :) My fiance is from Vancouver. Whenever I visit him, I take advantage of that city and its variety of restaurants. I came back last week and had been really spoiled, eating sushi, Thai, Middle Eastern, Greek during the trip (the rule was, I was not allowed to eat anything that I could get in my town :) I am craving sushi like you wouldn't believe, but if I want it, I have to drive an hour and a half each way :(

Sushi is actually easy to make. You could take the time to drive to an asian food store and stock up on the basic ingredients (nori, sushi rice vinegar, wasabi paste, pickled ginger, and don't forget the bamboo rolling mat!). You can get rice, seafood/meats and veggies that go inside the sushi roll at your local grocery store. Don't be afraid to use fresh raw fish from your grocery store... just make sure it is fresh (no strong fishy smell!). There are recipes you can find online.

Sushi's actually quite fun to make too!

    Here's a mouthwatering pic for ya :P

  5. We went through Vermont. I knew what the norms were. I was optimistic. I was not deceived into thinking they were owed me.

Nor did sarahsmiles or myself think we were owed anything. So we shared our worries and our frustrations? We weren't expecting to be molly-coddled NOR belittled.

Last time I looked, VJ was a community where people supported each other. And in my opinion, belittling is not a form of support.

  6. this whole thing started i guess because i wanted to know what ajmc wanted after only two months, same as sarahsmiles.

Actually, I thought I made it pretty clear when i said, "It's not like I want us to be approved tomorrow."

And what rebeccajo says is true : "Everyone wants a piece of it." Isn't it natural to feel that way when people ARE getting approved so quickly?

No, I don't think it should be natural. It's something new and could be done away with at any moment.

It might be natural to be envious and to want it. It's not natural to expect it.

I guess what we're dealing with here are two sets of mindsets: Optimism and Pessimism. Let's just agree that some of us are optimistic, and some of us are pessimistic. Because of this, our opinions on this matter will never agree. Let's just embrace that fact and move on.

  7. Simply put - there are some VERY unrealistically high expectations in AOS these days.

When we filed (11/05) we fully expected to not be interviewed until mid-summer 2006. And that was if things went smoothly.

Now there have been some changes. Everybody wants a piece of it. IMO it's most unsettling.

Look at it this way. What do you think when you see a Vermont poster rattling on in K1 about not being approved after 14 days?

That they need to stay patient because the average time it takes to get an approval at VSC actually takes a month and a half, not two weeks?

My expectations were not unrealistic, not to me at least (if you read my post a few posts back). I think it's just that some people are more optimistic about this process than others.

  8. If all that had been said was "OMG what the heck are you worried about," then I wouldn't be participating in this conversation. And I don't think that lending a little support is molly-coddling. That's the way I see it.

what IS it exactly that I said that was so offensive? there were 3 posts by ajmc stating she wanted some kind of action in her case.... um again. just filed 2 months ago, relax! I was making a correlation that people assume to have nothing happen = stalled case. why do people think that? you even said yourself you wanted to be sure your case wasn't rotting somewhere!

    peeps need to chill.

It wasn't offensive. It was more... belittling. And I think that is disrespectful behavior. When you come to a place like VJ, you don't expect to get disrespected.

But I now understand where your cynicism and bitterness come from. And I have empathy for you and everyone else in your boat. There is no need to belittle others... it only creates a hostile and negative atmosphere.

  9. I know we need MMR- measles, mumps, rubella

    Tetnus/Dyptheria

Chicken Pox- they will take oral testimony, but I do have a note from my childhood Doctor.

Is there anything I am missing? I do have the complete list but I know not all of them will apply to me. I did show that list to the Doctor before I got sent to the Lab for my Titres.

I got my Titres results yesterday. I'm glad I did this early! My Lab work showed no immunity to dyptheria, I had my tetnus/dyptheria booster in November, so I don't know what happened there. I also showed low on measles immunity. I went today and had another tetnus/dyptheria and another MMR. I will do another Titres in a month- to make sure everything shows up in my tests. I just want to make sure they are testing for everything they need to.

If you're between 18-64, I think you're all set. Good thing you did do it all early!

  10. I can not believe It has been now 1 year since I have filed all my documents and I have not been denied nor accepted.

My EAD is expiring in April and I do not want to loose my job I get good payed and I love it there.

I filed a new EAD 4 weeks ago and they havn't even cashed the check yet.

Therefor I called the Hotline today and all they can do is to let MSC know that I called.

Does anybody know what else I could do.

    Susann

If I were you, I wouldn't rely on the misinformation hotline. A year's been long enough. If you want "real" answers, get an Infopass appointment and speak to an actual Immigration officer regarding all your concerns.

  11. I think its easy to have high expectations when so many other people on here are reporting CSC transfers. Its also easy to get frustrated when people report getting their green cards in 60 days from application and suchlike. A healthy dose of reality can be had by looking at the timelines features on this site.

I agree. It also doesn't help to compare yourself to those who have timelines similar to yourself (like Miranda&James said).

How I interpreted the "average" timeline was like this (just by looking at other people's timelines on their signature NOT the timelines feature on this site):

    - NOA1 within 2 weeks of Chicago having received the applications

    - biometrics appointment in 2 weeks to 1 month of NOA1

    - interview letter within a month or so of the biometrics appointment

    - interview appointment within 2-3 months of getting the interview letter

    - greencard in your hands within 1-2 months of the interview

That totals around 6 months... the average time I have read it takes for AOS. So I would say that is pretty realistic. It's when people start getting close to or past the "average" timelines that they start getting their panties in a bunch (like my #######-retentive self).

With all that being said, guess what I got in the mail this afternoon? My interview letter. And they've fixed my name too. Hahaha. I can laugh at myself now for getting worried over nothing!

  12. Just goes to show that timelines can vary so much so when you have fallen behind those who filed around the same time as you it only serves to get depressing when you start comparing :(

Yup :(. But oh well, c'est la vie. I think it's all just about luck when it comes to the visa journey.

You were transferred to CSC... it's any day now! Keeping my fingers crossed for you since it looks like you've been waiting a while. At least you now have your EAD! I could care less about waiting for my GC if I had my EAD... I can't get my driver's license without it and I live in a place where the bus only runs every hour, so imagine how frustrating it can get not being able to go anywhere or do anything while the hubby is at work. Poo.

  13. sure let your frustrations out! It's what VJ has become! A vent-all! I was really responding to your mulitple posts about no touches and no interview notices post-biometrics, and thinking maybe you may be stalled. All local offices are different, in my case we didnt receive a biometrics letter for WOW a WHOLE 4 months after filing!!!!!!! imagine that. four months with no word. The world is ending obviously. Then the interview 3 months later!

obviously I am being sarcastic, but there is such a crazed trend on this forum with boo-hoo 3 months and no word... :crying: something is wrong with my case!!!!!

Sorry to hear that... 4 months for the biometrics is so out of the norm. But at least you're all done (for now). We're all human... it's okay to get anxious. Some people obviously take anxiety it better than others

yes well, im not really done, seeing as though i am stuck in namecheck since Oct 2005

Ah... so that's what the sarcasm is hiding. Again, sorry to hear that... if you've been waiting almost 2 years, they say you should be getting your 10-year GC instead of the 2-year one. Hey, at least you won't have to worry about filing to remove conditions if this is the case. And I hope you did file for your EAD and/or AP (and get them!). (Sorry, you have no timeline so I don't know).

  14. sure let your frustrations out! It's what VJ has become! A vent-all! 15. Again, look at my sig.

I got a touch on July 7th, then another one 2 months later. In between that time I had my biometrics and got my interview letter. I don't think what you're experiencing is that odd. Frustrating? Yes. Unusual? No.

BTW - I got my interview notice about a month after biometrics, so you're within errors there too.

I'm not just talking about touches ;) ... I'm talking about ANY kind of action on my application. I've had nothing, nada, zip. I'm hoping that I will get something soon (hopefully the interview notice!) - some of the people who got their NOA's around the date I did (see here), already have their interview notices or were transferred to CSC!

what exactly do you want to happen? Does everyone sitting in the AOS forum want instant-gratification-Greencard-when -transferred-to-CSC????? Seriously, you filed less than 2 months ago, I cannot understand when people don't see these vague *touches* they somehow think their cases are stalled! Seriously, just relax.

Not just looking for touches--I know they don't mean anything. I'm specifically looking for notices. I called in 45 days ago to report a typo of my name on my NOAs (wrong middle name), and they said they'd send me a notice saying it's been taken care of within 45 days. I have nothing so far. But I've made an infopass appointment and hoping I can get it fixed there! The 1-800 is definitely the misinformation line. I worked for the government back in Canada, so I know how long it can take for things to get done. It doesn't hurt, however, to let one's frustrations out.

  16. Why do you think the 0800 is called the misinformation line....

They are not USCIS officers they are a callcenter that follows a script... they can only send a general email to the service center....

Make an infopass and talk to a real USCIS officer and they can access the computer to correct any mistakes, or they can call the person dealing with your case and check what spellings they have for you...

But it up to you what you do...

    Kez

Thanks, I will try that Infopass!
