  1. Got our NOA1 in the mail on Nov 25, but the NOA date they gave us was 11/17 so that's nice.  5 whole days before the GC expired! :o:)

    So I thought about it right after I typed that and decided to include all the paperwork from our offer on the house, and then where we signed and accepted the seller's counter-offer. That's a legal contract, so I figure it's a good start. That literally all happened this weekend, so timing is working out okay after all on that. Thanks for the idea!

I think we have pretty good evidence.  All our finances have been joined since the beginning, we have a joint lease, we have joint insurance and list each other as beneficiaries on everything like retirement and insurance stuff, and filed joint taxes, have a joint loan and joint credit cards and bank accounts. We don't have a baby or a mortgage yet (though we're buying a house this month- no real paperwork to show for it yet, unfortunately) but our finances are all tied together. I'm including some mail and a few pictures as "fluffy" evidence.  The affidavits are a hassle at this point- I hate to bother other people with it.  So I'm gonna skip those and hope for the best!  Thanks, y'all!

  5. Right now I'm leaning towards listing the new address as my own current physical address, but leaving his mailing and physical address as our original address. Then I'm answering the question 22 affirmatively and listing the address and explanation in the "Additional Information" section. 

    This way both addresses are accounted for, but I explain that we have both been back and forth, and maintain a residence in both locations, but  consider the original address our permanent address and our mailing address. 

  6. So, we are working on our i-751 for my husband. (I'm the US citizen, he's the applicant). 
    Question 22 says "Have you resided at any other address since you became a permanent resident?"

    We have, but we did not submit a change of address because our living situation here has been somewhat volatile and we maintained my parents address (also our first address) for most legal documents.  It's in another city, but within the same state, and we go back and forth frequently. I still work for an organization in the original city, though I work from home.

    All our bills still go to that address, and my drivers license is still there, although my husband's has been changed to the new city. But evidence such as the lease on our apartment here is in both of our names, and would be helpful for proving our married status. We've technically been at the new address for about a year.

    Are we going to face a lot of questions or negative consequences because of this?   We still plan to list my parents' address as our mailing and physical address, but should we maybe put our new address as our physical address?  Is that going to get us in trouble because we didn't submit a change of address form to USCIS?  

    Anyone else have any experience like this?

  7. Amazing! Your whole AOS time frame was 96 days (3 months and 4 days) from your NOA dates!!!! Congrats!!!!!

    I am a little concerned about this for us. Ours says 'blanket waiver', which I think this means we are okay, but I'm not entirely sure. Our health insurance was just adjusted this week to include my husband, but we plan to mail the petition next week. He asked for all the vaccinations at the panel physician, but we aren't too confident he received them all. If we get RFE, we will deal with it then.

    Good luck to you! I hope you have the same results as well. Our whole process with AOS went infinitely better and faster than i could ever have dreamed it would. It's pretty crazy!

  8. We were approved! We received the notification via mail. I hadn't even been checking because I expected it to take much much longer. So I checked the case status to make sure we weren't dreaming. I guess his interview was waived. It says the card has been mailed now!
    I'm so excited I don't even know what to do. We've been a late approval with most everything so far, so to have this happen so fast blew my mind.
    He's now working, has a SSN, has a driver's license, and should have his green card in hand in a week or so.

    Can someone tell me what our next step will be? I had been prepared to wait so long I don't even know what comes next.

    Still do not understand why he did not pay his own way.

    Because he lives in one of the poorest countries in the world, where a working man can expect to make roughly the equivalent of $2/day. I didn't really expect him to save all of his money for 3-4 years on the off chance he would need to buy a plane ticket to the US for his brother's wedding. He's family, and family makes sacrifices for each other where I am from. Fortunately some agents with airlines were more sympathetic to our plight than most folks commenting here and wound up refunding us a decent amount of the ticket prices. I do still regret that we lost some money, but I stand by my conviction that the consular should not have acted in the way that he did. The final story we got was that because my brother in law was not married with children, he was considered too much of a risk and they wouldn't let him travel. A friend of ours who is employed at the embassy also related that the consular did not believe I had written the original letter or invitation, although he admitted he had no real reason for thinking so.

    I'm assuming that it would be something related to the average GDP per capita being under $250/year.....

    Even with a good, stable job and a high standard of living in Malawi (enough to qualify for a tourist visa), $2000 is a whole lot quicker and easier to make in the US than in Malawi and is a less overall hardship for the person spending it. I'd see it as part of the overall cost of my wedding to make sure my husband's family could be there, if the choice came down to it.

    My future in-laws enjoy a very nice standard of living in Costa Rica (not quite as good as the wealthy North American retirees do there, but more than comfortable) but still their tickets to join us for our wedding would be a significant burden, to the point that it may be cost prohibitive. Me though? Easy as cake to make up that amount of money. I'd just keep my second job a little longer than planned. I'd barely even notice it, I work so few hours per week (I work there Fridays after work, but get out still early enough to socialize if I want to,and Sunday mornings or afternoons), direct-deposited into a savings account and by the time I think to check on the account, there's another thousand dollars in there. That simply can't happen in a place like Malawi.

  10. I have evidence of many different friends who have been through this process with virtually no problem. I've aided 3 individuals in getting various types of visas at different times through this embassy with little to no evidence of any of the things Anthony was asked for. I'm not looking to get into an argument with strangers on an internet forum. You've said your piece and blame me for buying a plane ticket. However, reason and experience informed my decision, and although I knew it was a risk, I made what I felt to be an informed decision on good faith, trusting a united states official to keep his word. If he could not guarantee anything, he should not have informed us that he could. if the visa was not approved, he should not have said that it was and kept the passport to give further appearance of that approval. THAT is my complaint.
    I lived in Malawi for several years of my life and understand how the system and culture work. I have recently seen a trend in the embassy making guarantees that they do not honor. I also know the tendency for corruption in the government systems in Malawi, and have seen that the embassy operates more by Malawian standards than American ones. I would only like my voice to be acknowledged and accountability to be in place. I really don't feel that's too much to ask.

  11. I respectfully disagree. An official of the US Government should not have the privilege to tell an outright lie, (i.e. "Your visa is approved, come pick it up tomorrow."). Yes, we jumped the gun a bit. But we were assured time and time again by the consulate that we were doing the correct thing. We were told to bring more evidence, and that plane tickets would be a good addition to that evidence.
    I get that the consular has the right to deny the visa, but should he tell an individual that with a bit more proof, approval will be his tomorrow? Because he did so.
    I am familiar with how things work in Malawi, and I am familiar with government agencies which operate very impractically, i.e. asking for proof that they advise you against having in the first place.
    I do not wish to complain about the denial of the visa, but the fact that we were led to believe untrue things on multiple occasions by authorities in positions of power. That should not be so.

  12. Does anyone know how/where you can file complaints related to an embassy? We have applied twice for a B1/B2 visa for my husband's brother (my hubby is a K-1 holder). We wanted him to be the best man in our wedding ceremony, which is planned for the end of this month, but we didn't want to buy a plane ticket until they approved his visa. So he went a couple weeks ago to interview for the visa and the consular gave him some trouble because there wasn't an ink signature on the letter that I wrote for him (I signed it and scanned it to him). However, they told him it would be approved and kept his passport and said come back in two days to pick up your visa. At this point he told us it was approved so we purchased a plane ticket for 2 weekends later. When he went back to get the passport and visa, the consular told him they changed their mind and needed more evidence. I attempted to email more evidence on his behalf to the embassy using the email address they listed on their website. The email never went through, though, apparently. When he arrived the following day with more evidence, the consular refused to see him and eventually told him he needed to reapply altogether, because he was rejected.
    So we spent the money to re-apply and submitted his application again and scheduled another interview. This time we sent him with all sorts of documents, including the plane tickets we purchased, the wedding invitation, copies of mine and my husband's passports, letters from his employer and his school, as well as an additional letter from me asking them to contact me if anything else was needed, because we would happily supply any documentation to keep us from losing this $2000 plane ticket and the best man at our wedding ceremony. In the end, the consular acknowledged that there was more than enough evidence but told him that he thought he didn't have strong enough ties to Malawi (i.e. a wife and kids) or anyone powerful to vouch for him (keep in mind the man in the office next door vouched for him, and we had letters from his employer and college. When we appealed to our friend at the embassy to look into it, he said the consular told him that he didn't believe that I wrote the letters, and that my husband forged them.
    Also keep in mind this same consular granted my husband's K-1 visa a couple months ago with no trouble, and even wished him well and had extensive conversations with him, giving him marriage advice, etc.

    So essentially, I've had to cancel plane tickets and hotel reservations, not to mention we're less than 3 weeks away from our wedding and the best man isn't able to come. I've lost around $1700, simply because the consular mislead us and then decided to hold some unknown, untrue, unprovable grievance against us. I'm livid.


    Where can we file complaints? If they embassy has done this to him, I'm sure it's happened to others. I've had so many problems with them saying one thing and doing another. They rescheduled my husband's K-1 interview 3 times and then promised him his visa would be printed for 3 days in a row without actually doing it. Who can we contact about these things??

  13. Okay, I've read up about the I-693 and ds-3025.
    It seems, based on the pinned post regarding these things, that my fiance/husband (K-1 visa holder) does not need to file the i-693 because his medical exam was only a couple months ago. It seems, however, that he would need to fill out the ds-3025.

    Our problem is that he wasn't given a copy of the ds-3025 by the civil surgeon. He was given a copy of his chest X-ray, but not the ds-3025.
    According to the pinned post, we can just not submit anything and hope that all goes well.
    I realize that's not the ideal option, but as he isn't yet covered by any health insurance, and the nearest civil surgeon is a couple towns away, this is the option I'm leaning towards.

    Does anyone have any relevant experience? Has anyone else successfully not submitted even the ds-3025?

    Could we include a note explaining that he wasn't given a copy?
    Are we basically just asking for an RFE here? Even if we are, I'm tempted to let that happen, because at least by then he will have health insurance. We can't afford to pay hundreds of dollars for the full medical exam and all his vaccinations again.

    He's pretty certain they're all in order, but we just don't have proof.
    This won't earn us a rejection, will it?? Oh the stress.........

  14. I called today and got our case number from the NVC, and I know for a fact that it's already at the embassy in Malawi. I saw it with my own eyes. When I attempt to track it, however, I get the "your search didn't return any data" thing over and over. So I guess the conclusion is that it's not working properly?

  15. Forgive me for my ignorance. I've been with the fiance in Africa for 2 weeks with minimal access to internet. His packet arrived the day before I left, but I still don't have case numbers from the NVC.

    Do we need the case number or something from the NVC to be able to fill out the DS-160? How do I get that? Do I need to call the NVC? Will they even have it now that the packet has left there?

    I'm sure some of these questions are answered somewhere but I'm jet lagged and back at work already and just can't concentrate long enough to read through everything.
